The Supreme Court on Monday granted an emergency application filed by the Trump administration, giving the green light to reverse a decision by the Biden regime to extend protections for more than 300,000 Venezuelans under the federal Temporary Protected Status program.

It’s a big win for the Trump Team, which has seen more than its fair share of busybody judges telling them they are not allowed to run the executive branch as they see fit.

The brief order noted that liberal Justice Ketanji Brown Jackson would have denied the application. Litigation will now continue in lower courts.

As a result of political instability in Venezuela, the Biden administration in March 2021 said Venezuelans were eligible for temporary protected status under the federal program that has existed since 1990 to provide humanitarian relief to people from countries reeling from war, natural disasters, or other catastrophes.

Department of Homeland Security Secretary Kristi Noem had tried to 86 the Temporary Protected Status program earlier this year, but was quickly stopped by a federal judge.

Noem terminated the designation — which had been extended by the Biden administration — in February, a move that would have cleared the way for Venezuelans to lose their government-issued work permits and deportations protections on April 7. But a federal judge in California blocked the action in late March and said her decision to terminate the TPS program for the Venezuelan migrants appeared to be "predicated on negative stereotypes" and may have been motivated by unconstitutional animus.

A federal appeals court declined to provide emergency relief to the Trump administration and pause the district court's order, leading the Trump administration to seek the Supreme Court's intervention.

Doubtless, we’ll continue to see many more cases and judicial action as Democrats and activist judges have shown they are more than willing to try to thwart almost any move Trump makes. For now, however, the president can notch a clear victory.
