Pro-Life Hero: The Real Kelly Ayotte

Perhaps the most important Supreme Court decision regarding abortion in recent years was Ayotte v. Planned Parenthood of Northern New England. Yes, that Ayotte, Kelly Ayotte.

Another time, a more detailed diary on the legal merits of that case may be warranted, but a quick summary should suffice for now. At issue in that case was the New Hampshire Parental Notification Prior to Abortion Act. Former New Hampshire Republican Governor Craig Benson signed that act into law in 2003. Planned Parenthood sued.

Governor Benson’s Attorney General, Peter Heed, defended the law. However, Planned Parenthood won at both the district court and appellate court levels. Soon after, Heed left his office and Governor Benson appointed Kelly Ayotte to replace him. It was her decision to appeal the case to the Supreme Court.

Prior to making that decision, John Lynch, a Democrat, was elected Governor. In New Hampshire, the Governor appoints the Attorney General. Ayotte’s re-appointment was due. Lynch was a conservative Democrat, and the Attorney General position is not overtly political. Ayotte was competent and popular. It was possible that Lynch would re-appoint her despite party differences, but no one knew for certain.

Lynch adamantly opposed the New Hampshire Parental Notification Prior to Abortion Act. He made it clear that he wanted Ayotte to cease her appeal to the Supreme Court. By working against the wishes of Lynch, Ayotte faced the possibility of losing her appointment. Ayotte appealed the case anyway. Governor Lynch went forth and filed his own Amicus Curiae brief opposing his own Attorney General, Kelly Ayotte.

Ayotte believed it was her duty as Attorney General to defend the law. Those who know her well also know that she is also committed to protecting life. She risked her re-appointment and put her principles ahead of her career.

Ayotte went to the Supreme Court and she won. Although the Supreme Court had quibbles with the New Hampshire law, the Court ultimately upheld a state’s right to enact parental notification laws.

Planned Parenthood was devastated. The Pro-Life community was elated. The case has been called the decision that ‘lays the foundation to chip away at Roe’. If you have a parental notification law in your state, you can probably thank Kelly Ayotte for that.

Many in the legal profession and the Pro-Life community worked with Kelly Ayotte on that case. A member of the National Right To Life Committee wrote the following about Kelly:

First, full disclosure. I work for Citizens for Life, the National Right to Life affiliate in New Hampshire. We were the lobby that got the law passed when no one thought it could be done. Needless to say, pro-abortionists immediately challenged the law in court.

We were treated very kindly by State Attorney General Kelly Ayotte. She kept us close by during her heroic struggle to defend the law all the way up to the highest court in the land.

In my role as a conduit for information from the experts to the decision-makers. I was privileged to see the brilliance and fortitude of the scholars and leaders who made the whole thing happen

Once the law was enjoined, the fight was on. To take this law up to the First Circuit Court of Appeals in Boston and then on to the Supreme Court was a decision entirely up to Kelly Ayotte, our attorney general. She did it.

As primary season descends, the ‘Race To The Right’ commences. Many candidates will talk, but it is just talk. Some will speak with great gusto and passion, but it is still just talk.

Everyone has all of sudden become the next great Tea Party hope. But where were they in the past? What does the record show? Are they competent? Can they win?

Kelly Ayotte will not fare too well with the bullhorn and pom-pom crowd. She is not loud or bombastic. She is judicious and soft spoken. But her actions speak for itself. Behind that calm demeanor lies a fierce and principled prosecutor. And that fierce and principled prosecutor will soon become a fierce and principled Senator.

Yes, I want a conservative Senator, but I also want a good Senator. I want someone with integrity. And I want someone who can win. Kelly Ayotte is all four.

helps. I am glad to know this. So in Kelly Ayotte we already have a candidate who has taken a pro-life stand and is on record for same. Not quite the same as in California, where the Carly Fiorina crowd is trying to paint the picture.

She does certainly fulfill the requirement of being pro-life that would be an absolute requirement to obtain my vote. With that being said, her second amendment stance on the castle doctrine is troubling. The support for the porkulus bill is also a red flag. Her health care position shifted immediately after her meeting and fund raiser with Judd Gregg.

I can support her if she wins the primary because anybody would be better than Paul Hodes, however she is not someone I get excited about. I prefer someone with proven conservative credentials.

and I am sad to say I no longer believe New Hampshire is a red state too many Massachusetts voters have moved in and taken their same failed politics with them

I also think we need to be more diverse for our party’s new faces.

It is amazing that you have to attack a good Republican and misrepresent him to the rest of this website all because you want to overstate your favorite candidates’ position on the issues.

First, Kelly Ayotte is not the pro-lifer you make her out to be .

It is fascinating that you believe pro-lifers would consider a candidate pro-life when Ms. Ayotte supports abortion in cases of rape, incest and medical emergencies.

As most pro-life veterans know, “medical emergencies” are not limited to cases where the life of the mother are at stake but is a loophole that means abortion whenever a woman or a doctor says she should have an abortion.

I would also like to understand the logic in saying an innocent person can be murdered if they are a product of rape or incest before they are born but cannot be murdered after they are born.

Moreover, Ayotte needs to clarify ambiguous statements like the one she made in the following article:

Second, Ovide Lamontagne does not need someone to tell him he is not prolife. He has adopted several children and has long held prolife positions.

Third, what will happen when Ayotte actually has to speak for herself and not parrot talking points given to her by Washington Republicans. She has already changed her positions on healthcare legislation from her 2006 positions .

Fourth, you have to wonder if she knew Gregg was not running for reelection and she was looking at the political advantages she would gain in a NH republican primary by sticking with the appeal.

Back to your criteria…

Where were they in the past…

Lamontagne is one of the most loyal Republicans in the state. He won the 1996 NH republican primary for governor by defeating a sitting Congressman who was the epitome of the Rhino Republicans who have used the Party to gain power than abandoned every principle the party stands for …. By the way, he supported Hoffman while Ayotte never said anything about that race.

Ayotte will not tell us who she has ever voted for in the past and she will not compare herself to any sitting US Senator, even her political godfather, Senator Gregg….

Are they being opportunistic ???

Ayotte promised Governor Lynch to serve her full term as the state Attorney General if she was renominated but resigned once Gregg told her he was not running . I suspect she also knew former Senator Sununu was not going to run again either…

Lamontagne has one of the most successful law practices in the state and serves on the Board of Directors for the oldest credit union in the nation. He would have to take a paycut to serve in the US Senate… Ayotte would get a payraise.

I think Lamontagne will show NH voters that he is a great policy wonk who has substantive answers to questions on health care, job creation and terrorism…

I believe Ayotte is parroting sound bites she gets from Washington consultants and she will be vulnerable when she has to debate specific issues in a primary. Lamontagne is a pragmatic conservative in the Reagan tradition and he will not change his postions because Washington politicians or lobbyists throw money at him …..

Can they win

Start with the fact that both Lamontagne and Ayotte lead Hodes in the polls, not just Ayotte…

For some reason, people think that one’s gender is a decisive attribute that appeals to voters. Granted, we would always like women to take their rightful place in society but the more important question is where does Ms. Ayotte stand on issues and does she have the backbone to stand for Republican principles. In short, is she just another Olympia Snowe , a RHINO who is currently giving Ms. Ayotte alot of advise or will she be more like Margaret Thatcher ?????

Lamontagne has actually won a statewide primary against a sitting Congressman, Ayotte has won political appointments. Lamontagne has the ability to appeal to independents in the same way Ronald Reagan appealed to voters. Ayotte may be in over her head and it could become very apparent once she has to have to come out from behind the curtains and speak for herself.

I think the difference comes down to this. Ayotte has the support of the same Washington Republicans that used the party to gain power then abandoned Republican principles in the name of moderation and were defeated for acting like democratic socialists.

Lamontagne will win because this country is still right of center and he really believes what he says and has not only the courage of his convictions but also sophisticated policy solutions to the modern problems our country faces.
