Gird your loins, friends, for the seemingly never-ending tale of "Maryland Man" Kilmar Abrego Garcia, an illegal from El Salvador with an extremely questionable past, just took yet another turn. Tennessee District Judge Waverly Crenshaw, Jr., an Obama appointee, has canceled Abrego Garcia's human smuggling trial and will, instead, hold a hearing to determine if, to borrow Susie Moore's expression, St. Kilmar is being prosecuted "vindictively."
This move by Crenshaw comes on the heels of Maryland District Court Judge Paula Xinis' decision last Monday to extend the temporary restraining order, which she also issued, that prevents the Trump administration from taking the illegal alien into custody. (Paula Xinis, by the way, is also an Obama appointee.)

Kilmar Abrego Garcia was set to face a late-January trial in Tennessee on charges that he engaged in human smuggling. Those charges stemmed from a 2022 traffic stop where he was found to be driving the car of a convicted human smuggler and, weirdly, had eight people stuffed into the car; those individuals were thought to also be illegals as none had any documentation on them. Fox News Bill Melugin obtained the video from the Tennessee Highway Patrol. It shows police confronting Abrego-Garcia after he was pulled over while driving a convicted human smuggler's car. In the vehicle were eight other people, none of whom appeared to have any real connection with him. He was also carrying $1400 in cash, which the officers suspected was his payment.

Pretty suspicious, especially for a dude who allegedly beat his wife and possibly has ties to the notoriously violent MS-13 gang,
Now, however, Judge Crenshaw has axed the human smuggling trial and will, instead, hold an evidentiary hearing on January 28 to determine whether the illegal alien is the victim of vindictive prosecution, having already determined that Abrego Garcia has made a prima facie showing of vindictiveness.
In the ruling, the judge said the evidence provided by the defense had turned the case in Abrego Garcia's favor long ago – at least on the due process issue of whether the prosecution is vindictive.
Crenshaw wrote, "The burden-shifting framework controls the Court's analysis. Specifically, once a defendant establishes a prima facie showing of vindictiveness, 'a presumption arises in defendant's favor.' The Court has already found that Abrego has made such a showing, entitling him to discovery and an evidentiary hearing on why the government is prosecuting him."
Meanwhile, it looks like St. Kilmar is very much enjoying his freedom – not to mention the perks that come with being the Democrat Party's favorite illegal – and is embarking on a career as a TikToker. In one video, he is seen mouthing the words of what appears to be a Spanish-language Christian song.

We're never going to be free of this guy, are we? After watching the hero's welcome he and his wife got outside Paula Xinis' courtroom last week, I was struck by the thought that the two will soon get political makeovers – think Ozempic, Botox – and start touring the country as Democrat Party surrogates.
