Big time argument at the Supreme Court on Tuesday on transgender athletics: 

  • Little v. Hecox — Whether laws that seek to protect women's and girls' sports by limiting participation to women and girls based on sex violate the Equal Protection Clause of the Fourteenth Amendment.
  • West Virginia v. B.P. J. — 1. Whether Title IX prevents a state from consistently designating girls' and boys' sports teams based on biological sex determined at birth. 2. Whether the Equal Protection Clause prevents a state from offering separate boys' and girls' sports teams based on biological sex determined at birth.

MORNING MUSING

As noted above, the Supreme Court is hearing oral argument today in the companion cases of Little v. Hecox and West Virginia v. B.P.J., both of which involve challenges to state laws aimed at protecting girls' and women's sports — in other words, preserving them for biological girls and women. 

As someone who attended school in the 1970s and 1980s, my female peers and I were keenly aware of Title IX because it had been enacted so recently. We were the first generation of girls and young women who got our own sports teams and were guaranteed the opportunity to compete athletically. 

That measure was enacted for a reason, and the fact that so many — particularly on the Left — have blithely glossed over its purpose — and necessity — over the past decade or so is maddening. I don't care where you land on the issue of transgenderism. The fundamental principles of fairness and equality that undergirded Title IX's enactment require the preservation of sex-segregated athletics. Let's hope SCOTUS recognizes that — even if one of its members remains confused about what a woman is.
