Bergdahl to be Charged with Desertion

We knew this true last August:  President Obama traded five vicious Taliban terrorists for a deserter.  And now the U.S. Army nods in agreement.

Army Sergeant Bowe Bergdahl will be charged with desertion, among other violations of the Uniform Code of Military Justice (UCMJ), according to Briebart and The Washington Times reports.

Sgt. Bowe Bergdahl, who was released by the Taliban last year in exchange for five prisoners, is being charged with desertion, retired Lt. Col. Tony Schaffer told Bill O’Reilly on “The O’Reilly Factor” Monday.

Mr. Shaffer, who now works for the London Center for Policy Research, said two separate military sources have confirmed to him that Sgt. Bergdahl’s attorney has been given a “charge sheet,” listing out the articles of the uniform military code that have been violated.

Shaffer also revealed this on “The O’Reilly Factor”, and Fox News is reporting the story.

Back in August, USA Today published a story noting that the GAO issued an opinion that the Bergdahl swap was illegal.

That’s because the administration failed to notify Congress at least 30 days before the transfer, as required under a law passed in February. The Pentagon notified Congress of the deal on May 31, the same day the transfer was made.

And because Congress did not authorize spending for the exchange, it also violated the Antideficiency Act, a law intended to protect Congress’s power of the purse.

The Department of Defense spent $988,400 on the transfer, the Pentagon told the GAO.

An intentional violation of the Antideficiency Act is a crime punishable by up to two years in prison, but those criminal penalties are rarely enforced.

As Special Agent Sadusky said in “National Treasure”, somebody’s got to go to jail.  And it’s going to be Bowe Bergdahl.  Granted, the Taliban would likely have put Bergdahl to death at some point, although their treatment of him is worlds better than how ISIS treats its captives.  Releasing more Islamic terrorists “into the wild” is not just a dumb idea, it’s dangerously stupid, to the point of treason.

Bergdahl’s dishonorable actions deserve justice, for the sake of the soldiers who died trying to rescue him.  But really, maybe we’re prosecuting the wrong person.
