Barack Obama’s unconstitutional ‘recess’ appointees at the National Labor Relations Board continue getting smacked down by the courts. So much so, in fact, that one U.S. Congressman has introduced legislation to stop the NLRB dead in its tracks.
Here are your Union Briefs for Thursday, March 7, 2013:
Today, U.S. Representative Steve Womack (AR-3) introduced a bill to stop the NLRB from enforcing the rules, regulations, and decisions it has issued since January 2012.
“…[T]he U.S. Court of Appeals for the D.C. Circuit’s January decision gave us a basis on which to challenge the President’s appointments, and this challenge must be resolved before the Board continues its work. That is exactly what my bill will do. It will halt the enforcement of any decisions made by the Board since the time of the appointments, and it prevents additional rulings until the members are appointed in a manner consistent with the Constitution or until there is a final disposition in the courts.”
The National Labor Relations Board applies for enforcement of its order upholding a decision of an administrative law judge invalidating a decertification election based on findings that Arkema Inc. violated the National Labor Relations Act before an election by disciplining a union employee for allegedly threatening to withdraw help needed by another employee….The application for enforcement is denied. 5th U.S. Circuit Court of Appeals, No. 11-60877.
The panel’s decisions have enraged many small-business owners, and some of them are defying board rulings. It appears this discussion is only getting started, and we can expect (I hope) to see more employers standing up for their rights.

The Strongsville Education Association (SEA) is employing strategies pioneered by progressive activist Saul Alinsky in his famous book Rules for Radicals, Strongsville City School District Superintendent John Krupinski told Media Trackers. At publication, SEA – a local of the Ohio Education Association (OEA) – remains on strike, as the teachers union has been since March 4.

A consortium of environmental and consumer advocacy groups filed a Federal Elections Commission complaint Tuesday alleging that oil giant Chevron violated pay-to-play laws when it donated $2.5 million to the Congressional Leadership Fund, a “super” political action committee tied to House Speaker John Boehner (R., Ohio).

The complaint comes two months after Greenpeace met with dozens of other liberal interest groups at the National Education Association to discuss, among other things, punishing Chevron for contributing to the GOP, according to Mother Jones.

Nissan executives are all juiced up about their decision to turn their NISMO motor-sports brand into a global marque and the imminent opening of a new research outpost in Silicon Valley.
But the United Auto Workers is reminding the company that the union may go to the ends of the earth itself in its long-term attempt to organize employees of Nissan’s plants in the United States.
Union representatives on Wednesday traveled to the Geneva auto show to hound Nissan executives by passing out leaflets to the media hordes and by holding a press conference designed to embarrass the automaker on an important industry world stage.
So, elections do matter after all…
Top bosses of the National Education Association-affiliated Massachusetts Teachers Association (MTA) union are determined to foist a $1.9 billion tax hike on hardworking people across the Bay State. And they are enlisting the help of union-label Democratic Gov. Deval Patrick to make sure they get what they want.

Mr. Patrick admits that his complex proposal, which raises the state’s universal income tax rate from 5.25% to 6.25% and eliminates dozens of itemized deductions, but offsets the impact in part by cutting sales taxes and increasing personal exemptions, will raise the overall burden on roughly 50% of taxpayers.
Just a few weeks ago, responding to President Barack Obama’s call to fix our broken immigration system, AFSCME President Lee Saunders and Sec.-Treas. Laura Reyes said, “Immigrant rights are worker rights, and AFSCME will be on the frontlines of the march toward comprehensive immigration reform.”
