Politico Tries to Pre-Game SCOTUS by Publishing Leaked Draft Opinion Overturning Roe

POLITICO is at it again, trying to manipulate the news, rather than report it.

Peep this headline:

Supreme Court has voted to overturn abortion rights, draft opinion shows
“We hold that Roe and Casey must be overruled,” Justice Alito writes in an initial majority draft circulated inside the court.

Excuse me? Since when do you leak draft opinions? When you’re trying to gin up the bloodthirsty pro-abortion crowd into a frenzy, that’s when.

Between May and June is when the SCOTUS rulings on the cases of consequence—like Dobbs v. Jackson Women’s Health—begin to come down, and Americans watch with bated breath.

However, with the way things have been going for the Left and the Democrats (but I repeat myself), they are not confident that a Supreme Court with three Trump appointees will do their bidding; especially in light of their rulings on vaccine mandates and the Texas Heartbeat law. My colleague Bonchie has already weighed in, as have other SCOTUS-watching attorneys like Jonathan Turley. From reading the oral argument tea leaves, the prognosticators indicate that Roe v. Wade will definitely be affected, if not oveturned.

POLITICO knows that few people are going to look past the headline—they are simply going to react. If the meltdown this week over Elon Musk purchasing Twitter is any indication, look for another nuclear-grade explosion from the Pro-Choice, Pro-Aborts, and Baby Killers far and wide.

Here’s some meat from the article:

The Supreme Court has voted to strike down the landmark Roe v. Wade decision, according to an initial draft majority opinion written by Justice Samuel Alito circulated inside the court and obtained by POLITICO.

It hasn’t voted anything yet. A “draft” opinion is just that—a draft. Talk about inflammatory.

And “inside the court”? So the question is, who leaked this? The Supreme Court has not been known for leaks until the last few months: first with the leak of Justice Stephen Breyer’s retirement by White House Chief of Staff Ron Klain, and then the ridiculous “Mask Gate.” Guess whose aide was responsible for that one?

As my colleague streiff reported, Justice Sotomayor has also been a bit leaky in her rants, indicting she knows which way the winds are blowing. Time will tell, but all bets are on her wing for this leak too.

In the meantime, POLITICO picks up the ball, using heated language to stoke more outrage:

The draft opinion is a full-throated, unflinching repudiation of the 1973 decision which guaranteed federal constitutional protections of abortion rights and a subsequent 1992 decision – Planned Parenthood v. Casey – that largely maintained the right. “Roe was egregiously wrong from the start,” Alito writes.

“We hold that Roe and Casey must be overruled,” he writes in the document, labeled as the “Opinion of the Court.” “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

Again, it is doubtful that anyone will get to this last paragraph. POLITICO conveniently buries the lede:

Deliberations on controversial cases have in the past been fluid. Justices can and sometimes do change their votes as draft opinions circulate and major decisions can be subject to multiple drafts and vote-trading, sometimes until just days before a decision is unveiled. The court’s holding will not be final until it is published, likely in the next two months.

This is a bare knuckled effort to rally the bloodthirsty base, and pressure the Justices into voting to preserve Roe. It would be wise for pro-life conservatives to push back just as hard and expose POLITICO and the Left’s tactics.
