Mississippi Mother Could Lose Children After Her Son Was Shot by a Police Officer

A Mississippi mother could lose custody of her children nearly one year after her 11-year-old son was shot by a police officer in their home. The shooting, which occurred in May of 2023, garnered national headlines and elicited outrage from the community.

Now, the mother is ensconced in a court battle to retain custody of her children.

The incident occurred on a late evening when Officer Greg Capers responded to a domestic violence call at Nakala Murry’s home. Now, one year later, the state is accusing Murry of neglect.

A Sunflower County, Miss., woman could lose custody rights to her children nearly a year after an Indianola police officer shot her then-11-year-old son, Aderrien Murry, in the chest at the family’s home in May 2023. In court filings, Sunflower County Prosecuting Attorney Gwendolyn Jimison cited the shooting while accusing Nakala Murry of neglecting her three children.

“To have to even think of losing her kids at this point over something that is not her fault is just unbelievable. It’s outlandish,” Nakala Murry’s attorney Carlos Moore told the Mississippi Free Press on Thursday.

Jimison filed papers in the Sunflower County Youth Court against Nakala Murry that alleged an unnamed witness saw Murry’s ex-boyfriend, John Nolden, frequently assaulting her in front of the kids. The petition says the witness said the shooting of 11-year-old Aderrien Murry was a “result of the mother and boyfriend domestic violence that have been happening for years (sic).”

Murry’s legal team is pushing back against what they argue is a gross miscarriage of justice. Moore slammed the prosecutor’s effort to terminate her custody rights as “unfair because the officer is who shot her son—not Nolden.”

Adding further insult to injury is the fact that Officer Capers is still employed by the police department.

The original incident started when the father of one of Murry’s children came to her home.

Aderrien Murry was shot in the chest by an Indianola Police Department officer early Saturday morning while the officer was responding to a domestic disturbance call at the child’s home, according to his mother, Nakala Murry, and the Mississippi Bureau of Investigation.

Murry told CNN that the father of another of her children arrived at her home at 4 a.m., “irate.”

Concerned about her safety, Murry asked Aderrien to call the police.

Murry said the officer who arrived at the home “had his gun drawn at the front door and asked those inside the home to come outside.” Murry said her son was shot coming around the corner of a hallway, into the living room.

“Once he came from around the corner, he got shot,” Murry said. “I cannot grasp why. The same cop that told him to come out of the house. (Aderrien) did, and he got shot. He kept asking, ‘Why did he shoot me? What did I do wrong?’” she said.

The shooting happened within what felt like “one to two minutes” after the officer asked those in the house to come outside, Murry said.

The boy was given a chest tube and placed on a ventilator at the University of Mississippi Medical Center in Jackson after developing a collapsed lung, fractured ribs and a lacerated liver because of the shooting, his mother said. He was released from the hospital Wednesday. CNN has reached out to the hospital.

Two other children, including Murry’s daughter and 2-year-old nephew, were also in the home at the time of the shooting, she said.

This case could become even more controversial depending on how the court rules. The mother is preparing to fight for custody of her children at her court appearance, which is scheduled for April 17.
