As RedState previously covered, a Trump-appointed judge in Texas put the kibosh on Biden’s plans to largely cease deportations of illegal immigrants (see Federal Judge Plunges Dagger Into Democrats’ Open Borders Agenda and Twists It Slowly).
This per Jeff Charles.
Fox News reported, “U.S. District Judge Drew Tipton indefinitely banned enforcement of the Jan. 20 memorandum that would have implemented a 100-day moratorium on most deportations.”
Prior to this ruling, the judge had imposed a two-week restraining order on the measure after Texas Attorney General Ken Paxton argued that it was a violation of federal law as the Biden administration did not consult with Texas before taking such an action. Due to an agreement with the Department of Homeland Security (DHS), the administration is supposed to check in with the Lone Star state before issuing this type of order.
Now, we are starting to see our first reactions to the news from the left, and to say it’s an enjoyable experience is an understatement. Here’s Ian Millhiser, one of the resident hacks over at Vox.

I love this so much because it is perfectly the inverse of what Democrats were cheering under the Trump administration. Remember, we had random judges from Hawaii and California routinely giving unilateral edicts to stop Trump executive orders that covered all manner of topics. A single judge stopped the building of the border wall for a time. Other policies, including those that kept would-be illegal immigrants in Mexico to claim asylum, were also scuttled at first. Things got so bad that Justice Roberts, known for his propensity to never dip his toe into controversial topics, allowed the Supreme Court to slap down some of the prior injunctions.
Well, turnabout is fair play, and Democrats are having to live under the judicial dictates they once attempted to wield against their opposition. Trump may not be in office, but his appointments to the judiciary are just getting started.
People will argue about whether the ruling by Judge Tipton is correct, but it doesn’t really matter. The delays are the point. They were the point under Trump, and they’ll be the point under Biden. Running out the clock is nearly as efficient as garnering a final, favorable ruling. Is this a preferable way to govern? No, I don’t think so, but no one made Democrat judges lose their minds in the previous four years. They set the precedent for this kind of politicized lawfare.
Of course, there’s also the very real possibility that this judge is right and that Biden doesn’t have unilateral authority to just ignore immigration laws. That’s something the Supreme Court needs to finally be forced to deal with. Trump’s attempt at getting rid of Obama’s DACA executive action was stopped by technical arguments (disingenuous ones, in my opinion). Something more final must be handed down, or we’ll keep having these same arguments every four years.
Regardless, it’s comical seeing Democrats and their media allies gnash their teeth over a judge blocking Biden’s order. They wanted this type of governance, and they get it good and hard now.
