Couple Beat Unborn Baby to Death, May Not Face Charges

 

 

In California, police believe a pregnant woman had her boyfriend punch her repeatedly in the stomach in order to kill their unborn baby.

Authorities say they are attempting to determine whether a crime was committed.

The woman — who, like her boyfriend, remains unidentified — was 30 weeks pregnant.

She arrived at Bakersfield’s Kern Medical Center May 24th, covered in bruises which she said had been caused by mopping.

Yes — mopping.

When doctors retrieved her daughter from her womb, the child had a fractured skull, in addition to other “traumatic injuries” which killed her.

Skeptical medical staff called the police, who interviewed the couple.

According to BakersfieldNow.com, she confessed that her boyfriend — with her consent — punched her stomach “at least 10 times,” until she “stopped feeling the baby move.”

For those confused, that’s called “murder.”

However, no charges have been as of yet filed.

On Monday, Deputy District Attorney Gina Pearl said the case isn’t so simple:

“We’re actively reviewing it. It’s a unique case. We’re still investigating. There’s a lot of different angles.”

According to penal code, murder is the “unlawful killing of a human being, or a fetus, with malice aforethought.”

However, California allows abortion until viability, which is considered to be between 24 and 26 weeks, though some babies have survived earlier than that outside the womb.

Pearl said there will be no charges if “the act was solicited, aided, abetted, or consented to by the mother of the fetus.”

Jennifer Bloomquist, founder of Pro Choice Kern Country, took away something very specific from the story:

“Of course, we don’t want anyone to suffer violence. We can prevent future cases by offering greater access and even funding for abortions. Safe and legal abortions, not induced miscarriages.”

So there ya go.
