You remember how ObamaCare was all about making health care more affordable and protecting the most vulnerable, right?
And, surely you remember how much money and resources (i.e., members’ dues) the purple behemoth known as the Service Employees International Union (SEIU) put into the fight for ObamaCare—even going so far as (allegedly) beating Kenneth Gladney at a St. Louis town hall meeting.
Heck, it was SEIU’s then president Andy Stern who pushed for the tactic known as “demon pass” that gave us final passage of ObamaCare, formally known as the Affordable Care Act.
Well, somehow we missed this last week:
One of the largest union-administered health-insurance funds in New York is dropping coverage for the children of more than 30,000 low-wage home attendants, union officials said. The union blamed financial problems it said were caused by the state’s health department and new national health-insurance requirements.
The fund is administered by 1199SEIU United Healthcare Workers East, an affiliate of the Service Employees International Union. Union officials said the state compelled the fund to start buying coverage from a third party, which increased premiums by 60%. State health officials denied forcing the union fund to make the switch, saying the fund had been struggling financially even before the switch to third-party coverage.
The fund informed its members late last month that their dependents will no longer be covered as of Jan. 1, 2011. Currently about 6,000 children are covered by the benefit fund, some until age 23.
The union fund faced a “dramatic shortfall” between what employers contributed to the fund and the premiums charged by its insurance provider, Fidelis Care, according to Mitra Behroozi, executive director of benefit and pension funds for 1199SEIU. The union fund pools contributions from several home-care agencies and then buys insurance from Fidelis.
Of course, when it comes to the SEIU, it must be someone else’s fault.
The union said in a statement that the state required the fund to participate in a new program — the Family Health Plus Buy-In Program — beginning in 2008. The union said it expected that by joining the program, many of its members would qualify for state assistance for health-insurance coverage. “Instead they raised insurance rate increases without any increase in funding, and then cut Medicaid funding to the same workers nine times in the last three years,” the union said in a statement.
And, more importantly, the union expects someone else to pay for their mistakes lobbying efforts.
“We hope the state of New York will do the right thing and provide the funding necessary for this most vulnerable population of direct caregivers,” the union said in a statement.
Karma. It has such a nice ring to it. Yet, it seems just too kind of a word to describe the SEIU’s dilemma.
It’s sort of like the SEIU made a big batch of Kool Aid, and now the members’ kids are the only ones drinking it.
[There's only so many waivers one can get from reality.]

The declining rates of union membership before organizing efforts were moved into public sectors were in large part symptomatic of this. jeffreywturner (Diary) Saturday, November 27th at 11:42PM EST (link)A simple per curiam decision by 5 members of the SCOTUS (the 4 conservatives plus Kennedy) acknowledging the unconstitutional nature of the individual mandate might do the trick, since there is no severibility clause in Obamacare.
This is probably the best chance, since it does not require any cajones on the part of so-called conservatives in elected office.

I wouldn't bank on the lack of a severability clause carrying the day
JSobieski (Diary) Sunday, November 28th at 12:06AM EST (link)Its pretty much an axiom of judicial action that constitutional provisions are severable from unconstitutional provisions.
The best way to repeal Obamacare is the push for HSA legislation now. Exclude HSAs from the Obamacare regulations and you will kill Obamacare via trojan horse.
My rules of the road for primary season.
Rule #1: Vote for YOUR first choice in the primaries
Rule #2: Vote for the R in the general.
Rule #3: Don’t let anyone convince you to violate Rule #1 or Rule #2
Rule #4: When in a center-right argument, reaffirm Rules #1-#3–it will help us all to get along better.
Rule #5: If you are using the language of the left, you probably aren’t furthering conservativism
Rule #6: The priority is issues first, candidates second, and supporters third. Nobody is bigger than the issues. Conversely, if you spend your time focusing on supporters, you are wasting everyone’s time.
STOP THE MADNESS!
A reduction in the rate of spending increases is NOT a cut!

Requiring someone to pay their medical bills is NOT an individual mandate!

Agreed on severability.
Vasser, I think the election reduces the likelihood of the need for civil disobedience in the streets, but I think the issue ‘ski discusses raises the issue of how intractable many aspects of ObamaCare could be to repeal unless the GOP does everything right as they gain majorities etc over the next two election cycles, but I think the public may get mad if Dems block repeal very long.
And then there’s the courts and how long that takes on the mandates…

Agree, but just so everyone's aware,
cactusjack Sunday, November 28th at 10:37AM EST (link)in the real world, the new hire lawyer who fails to include basic boilerplate such as severability clause, choice of laws clause, assignability clause, in a simple business contract, will be disciplined if it blows up and might be let go if it costs the firm millions of dollars. It’s very basic Business Contracts Law 101 and at the pedestrian level of affairs can and has killed a deal or an otherwise good contract many times. It is plain on its face here, that they were just in a rush for this cramdown and forgot it, there is no good political or legal ,excuse not to have it in there. THey should pay the consequences, if the forced buy is unconstitutional the whole 2000 page bill should fail,,but agreed SCOTUS probably wont have the moxie to kill the bill in this case – though they should and would in almost any other case.
I don't see it happening.

Looks like, in this case, the plans aren’t paid for by the parents, but by the parents’ union (i.e. a “benefit” of union membership) so .. too bad.
A little surprising SEIU couldn’t get a waiver or something to continue the kids program until the full government-payer option is available, then dump the parents *and* kids into it. Bad timing.

Make no mistake, the ultimat aim of the Obama/Pelosi/Reid crowd is to keep themselves and other like-minded socialists at the top and everybody else down. So many such schemes have been repeated throughout history with the same miserable results that it boggles the mind anyone would still buy in to them…
And I’m seriously hoping DefeatObama.com above is wrong. If the Lindsey Graham gang fails to get off the dime, we need to get rid of him and them. How many so called “conservatives” did I hear, even in the last campaign, proclaiming that they, if elected, will use their office to “Create Jobs!” Nonsense. This is exactly the wrong message to send. The true conservative must be held to proclaim, believe and act on the idea that he or she will use elected office to “Get gubmint off the backs of businesses so that THEY can create jobs.”
And BTW, private sector unions will soon be a thing of the past for the very reasons stated in the post. Eventually, even rapacious unions cannot steal enough from their members to pay for all the goodies. However, a reference was made above to “public sector unions.” These, I’m afraid, will be a much tougher nut to crack.
“Racial criteria are irrational, irrelevant, [and] odious to our way of life.” — Thurgood Marshall for the NAACP Legal Defense Fund in the 1950 Supreme Court case of McLaurin v. Oklahoma
In real history, one of the first things socialists do when they
davesinsanantonio (Diary) Monday, November 29th at 5:12AM EST (link)come to total power is to outlaw unions. This because they claim that they are looking out for the workers and so unions are unnecessary. Since unions were created to protect workers from rapacious bosses and if the masses really believe that the government is on their side, then unions would be superfluous. But, as Lech Walesa and Solidarity showed us, the government can be the most rapacious boss of all.
Our job, should we decide to accept it, is to give the government back to the people, and then they won’t need to worry about the government making them into serfs and taxing away all their property. We owe it to our children to accomplish this.
I said nothing about Obama liking unions
Warrior (Diary) Monday, November 29th at 9:35AM EST (link)and you fail to mention that when socialists come to power, they outlaw ANY threat to their power, e.g. unions, churches, guns, etc. But, you basically restated my point anyway. Socialists only USE unions until they get what they want. Granted, Solidarity was to the right of the Soviet Union, but that’s not saying much. And, as any cursory glance at a newspaper in the last 12 months would tell you, of course “the masses” don’t believe the gubmint is on their side — it’s on the side of the unions or vice versa. Chicken or egg questions are really beside the point right now, especially when many union members have stepped out on their (private sector) unions and voted opposite the bosses desires.
If you want “real history”, try reading David Horowitz’s “Radical Son” for an excellent example (from “real history”) about how the CPUSA used first the NY teachers unions and then the national teachers unions to make the disasterous inroads they have made in public schools today. They and their ilk have run Christianity out of the schools with obviously deleterious results, destroyed the discipline necessary for a learning environment in schools and allowed students to “lawyer up” by giving them due process rather than a kick in the pants and/or a ticket home.
Back to my initial point, however, a union FUNDED and EMPLOYED by the gubmint, i.e. our tax money, is going to be a mutha’ to control –take my word for it.
“Racial criteria are irrational, irrelevant, [and] odious to our way of life.” — Thurgood Marshall for the NAACP Legal Defense Fund in the 1950 Supreme Court case of McLaurin v. Oklahoma
If the 40-50% numbers are right
doncorleone Sunday, November 28th at 1:26PM EST (link)Of union members voting conservative/republican are accurate, those are the percentages that are needed to petition union leaderships to break down how much of our dues monies are going for political donations. Teamsters are averaging 80% of our dues monies going to democratic candidates, helping out those who are “friendly” to labour. The dues can then be lowered, if they are sending money to people whom you neither espouse or endorse. It’s an arduous path, but it’s one way to trim contributions to all of those folks, “friendly” to the” working man”.

It will also greatly affect the small farmer who may have to close down due to all the additional paperwork (due to all the additional regs). Think higher prices at the grocery store–as if you have not already noticed.
Even Glenn Beck didn’t mention it until one of his callers told him about it–then he spent about 15 min. on it and hasn’t mentioned it since.

The illusion of "free"
wtbrewer Monday, November 29th at 10:07AM EST (link)ObamCare notwithstanding, it was always possible to keep kids on parents’ policies and to cover pre-existing conditions.
You just have to pay the price.
For adult “kids,” the premium should simply reflect the additional cost of the requuired adult policy(s).
For pre-existing conditions, the premium would include the patient paying all costs plus a percentage of the costs to the insurance company as profit.
In the past, no insurance company would offer such arrangements because no one would buy them. The magic of ObamaCare was to portray it all as “free.” The real plan though is to force everyone buy the unaffordable. The reality will be lots of hypocrisy, backtracking, redefinitions, etc.
In the meantime, insurance is all about risk and “realized risks” (i.e., pre-existing condition) are inherently uninsurable.
The best one can do for realized risks is to make the provision of care more efficient and to prevent freeloading.
ObamaCare does just the opposite.

doubledok Monday, November 29th at 10:19AM EST (link)How can this irony not be the headline? If paying the union thugs to negotiate a “living wage” does not include hourly pay adequate for medical insurance, then evidence sits prima facie that the unions are pretty much worthless.
