What are they worried about? The woman is a nominee for the Supreme Court of the United States and Princeton University demands we pull down the Kagan thesis on socialism.

But if you had read the thesis in question, then your criticism of Erick is rank hypocrisy, because you happily violated copyright to the same extent as he did (note that we promptly took down the link once we received the letter to do so).

So: either way, you have to apologize now. I’m indifferent to whether you do it for being a hypocrite, or for being prejudiced against conservatives – just as long as you do it in your next post.

The real key to all of this is that Kagan didn’t release the thesis herself with the full support of Princeton University.

Because I’ll tell you right now, when she wrote it, she was very proud of it, and so was Princeton, and so was Harvard.

It wasn’t something they were ashamed of — it’s one of the reasons she became the Dean of the Harvard Law School. Based on her success arising from that thesis, she should have it published as an eBook instead of trying to restrict it.

Easy to get through online archive searches. But it did have a full and standard copyright restriction on the first page when I read it. Fair use would have been to excerpt key parts. Legally, it is hard to argue with the request that was made. The archives pretty much restrict their use to non-public or academic use.

excerpts for “Fair Use.” Can “Fair Use” be used for brief excerpts in this case? The page that gives the copyright warning includes these words:

“One of these specified conditions is that photocopy or other reproduction is not to be used for any purpose other than….private study, scholarship or research.”

Certainly that describes all of us as individuals. Guess they don’t like it that there may be a few thousand folks who wanted to access it for those reasons.

This also reminds me of the Washington Post and their “hit job” on then gubernatorial candidate, Bob McDonnell, and the release of his thesis. He didn’t try to hide it, nor demand cease and desist on it. If he had, the Left would have made mincemeat of him and Republicans. The double standard continues to exist with the Left and the Leftist media.

Makes sense for RS to accommodate them, not worth the legal hassle. Besides, out there enough now, can’t all be hidden….or destroyed, as I suspect is the case with Pres. Obama’s thesis.

I think we all believe in copyright. I also think we’re all smart enough to know the difference between protecting intellectual property and suppressing information.

What Princeton is doing is just the same as the Church of Scientology. The aren’t being deprived of economic value here. If their goal is furthering research then I think it is fair to say that more people have read and commented on Kagan’s thesis in the past week than in the past 30 years.

This is simply suppressing information that they are afraid will damage one of their own.

if anyone cares to litigate them. I believe an argument could be made that with her nomination to SCOTUS, the “educational” value of her thesis is an overriding public interest. If it had been posted in full anywhere else first, it gets difficult to claim infringement.

There is also the issue of value. Copyright is a property right. The loss by infringement can hardly be more than the total royalties it has earned for the archive to date. How much is that? My bet is . . . ZERO.

If the copyright is worth no valuable consideration, who gives a rat’s patootie?

And as to copyright–I taught journalism for 14 years–the mere posting of a work can be a copyright violation, especially if used for some kind of monetary gain or claiming the work as one’s own.

Biblical Archeological Review’s editor, Hershell Shanks, published a translation of the Dead Sea Scrolls in order to break the intellectual strangle hold the original study committee had on the historical materials. He credited the author but was sued and lost. On the other hand, now all scholars so interested have better access to valuable mss. previously denied for decades.

Kagan and little o fall into that abyss of “experts” and “intellectuals” who never published anything and have tried to lock away anything that pertains to their professional and academic careers. Odd in and of itself. But, worse, I think Kaga’s appointment is just a quid pro quo for her sealing o’s Harvard documents.

And why can’t someone access them. regardless? We had Joe the Plumber’s DMV records in 24 hours of his speaking to the precious one in 2008. o’s paper trail is some place and o’s needs to be revealed to the entire world.

It’s a bluff. They are not the copyright holders. They have no right to demand that you take the thesis down.

This letter deserves no reply. If they are serious about taking you on, they will send a DMCA takedown letter where they swear under oath that they are either the copyright holder, or are acting on behalf of the copyright holder.

This letter is an act of pure political intimidation.

The Kagan Thesis has gone viral, and it’s forever part of the public domain. As of this posting, a quick Google search of “Kagan Thesis” returns approximately 335,000 hits.

Besides, you and your handlers have more to fear from Princeton’s alumni and your own campus publication, The Daily Princetonian, than Kagan’s senior thesis becoming part of the public domain.

Fear and loathing in Brooklyn is just one example, and it’s even more damning.

It’s not about hiding, dumb bunnies.

It’s about intellectual property rights, and copyright infringement.

And headlining it “Kagan’s Socialist Thesis” is a deliberate effort to deceive. This isn’t about unveiling sparse truth, but about derailing an obviously well-qualified nomination.

It’s really easy to get access to the paper (which was written DECADES ago) if you want to read it personally; they just don’t want people to commercialize it and/or misleadingly edit it or misrepresent it (based on past experience, a valid concern).

I personally don’t like the current application of copyright law. I’m bothered that Disney makes minor changes to the original art of characters like Mickey Mouse in order to legally “loophole” their copyright extension, and I’m bothered that the group NSync sold nearly a billion dollars worth of music in a year flat and the vast majority of the proceeds went not to the performers, but to the record companies that produced them. I’m bothered that intellectual property law in the US has not made any effort to keep up with technological advances (think of the many stumbles in recent years regarding digital rights management, peer-to-peer file sharing, and the like) and then realize that Princeton, not Elena Kagan, is realizing the vast bulk of the profits related to her writing.

I figure what Princeton is doing is certainly no worse than what SME (Sony) does habitually. I think it’s interesting that suddenly a bunch of folks want to make a big deal out of the obvious modern misuse of intellectual property rights when a public university does it, but they turn a blind eye when a for-profit private-sector corporation does it.
