With EPA Nomination, Trump opens up an easy way to end the Clean Power Plan: Non-Defense

Throughout the Obama Administration, one of the favorite tactics of left-wing states in the Culture War was to ‘refuse to defend’ laws that the state AG disagreed with, when someone sued the state…

Meanwhile, Obama was racking up thousands of new EPA rules, with 50BN/yr in compliance costs…

When discussing Trump’s cabinet appointees, the New York Times loves to remind everyone that all of these rules are now ‘final’ and thus cannot be reversed without a ‘public comment’ period… As if this is some consolation to leftists who now see their world falling down…

But wait…

The EPA is being sued by the states over these rules…
So in a bit of irony, the new Administraiton can simply ‘refuse to defend’ Obama’s regulatory agenda and let it be dismantled in court, by an uncontested plaintiff’s bar…

All without playing the game NYT insists we ‘have to’ play…

Which is somewhat deliciously ironic…

Even to someone like me who *still* opposes much of the rest of Trump’s domestic agenda…
