Elections, Consequences and Kagan

We now have a Supreme Court Nominee, Elena Kagan, who just isn’t that crazy about the whole 1st Amendment Thingy. It seems that she feels some brands of speech are more harmful than others. Speech that in her not-so-humble opinion could cause harm; can be banned without regard to the disparate impact on the intellectual positions being represented by the speaker. Batshite Leftist nonsense from INGSOC mouthpiece, Elena Kagan, follows below.

“This does not mean that the government may never subject particular ideas to disadvantage. The government indeed may do so, if acting upon neutral, harm-based reasons.”

Believe it or not, I found Joe Biden to be more concise on this topic. If you disagree with V-POTUS Bite-Me, you really need to stop being such a smart-ass. Cut through the academic weasel-words, and Elena Kagan just told you to agree with her view of the world, or STFU. It’s that simple, and you know she only does it for your own good.

The supposed intellectual justification for her censorship is utterly bogus. Anyone who has even offered a cursory quantum of attention to Alternative Rock knows that these people spew some of the most blatant Anti-American bile imaginable. Admittedly, President William Jefferson Clinton was soon after impeached. That, however, had more to do the mess on the dress, rather than the crap used to defile a US flag as an act of symbolic speech. It also had nothing to do with the fact that Marilyn Manson habitually simulated wiping his butt with Old Glory nearly every time he played another venue during that period of recent history.

If this sort of speech had obvious harmful content, George W. Bush would have been shot and killed after some Leftist whack-job wrote a how-to novel about doing just that. People talk a lot of smack. Most of it amounts to nothing, once the inebriation wears off and common sense prevails.

To many, this represents just the sort of amateurish debate that we get treated to when taking Philosophy 101 at some citadel of higher matriculation. This should be the case, but isn’t. When Elena Kagan served as Solicitor General, she argued on behalf of the Federal Government in FEC Vs. Citzens United. She actually played the villain role in the debate and argued athwart allowing some avenues of free speech.

The case reached the US Supreme Court, and Justice Roberts asked whether some forms of speech could be banned under Campaign Finance legislation. Kagan’s solicitor answered affirmatively.

“If it’s a 500-page book, and at the end it says, ‘and so vote for x,’ the government could ban that?” Roberts asked, to which Kagan’s deputy, Malcolm L. Stewart, said the government could censor such information.

Solicitor Kagan’s office in the initial hearing argued that it would be OK to ban books,” Senator McConnell said. “And then when there was a rehearing Solicitor Kagan herself in her first Supreme Court argument suggested that it might be OK to ban pamphlets.” (HT: GCN)

The Federalist Papers were pamphlets. So was Thomas Paine’s Common Sense. That guy Thomas Paine just had a perpetual chip on his shoulder. He was the Mark Levin of Colonial North America. Clearly, Joe Biden would have told him not to be such a smart-ass.

Now Joe Biden can tell Mr. Levin anything he wants, and then Mark Levin can get behind his microphone and bloviate right back. The consequences of either are no more significant than the typical point source of CO2 pollution. But, we’ve elected a group of people who just don’t see things that way.

The quips about liberals seeking desperately to ban common sense write themselves. They aren’t quite as funny when we’ve elected a group of wannabe tyrants seeking to consolidate their Oligarchic Collectivism. Elections have consequences. “Justice” Elena Kagan could well be one of them. While we still are allowed to write pamphlets, we must rise up and destroy the electoral viability of “Progressive” beliefs and philosophies. (I spoke carefully there, Joe Biden could put me on his list of iniquitous smart-asses.)
