Remember: #ItsTheLaw

Remember when we were told by the Left told us the Affordable Care Act was the law? That they won and we lost? That the law was here to stay? We’ve now gone from “It’s the law” to “It’s a drafting error that shouldn’t be taken into consideration.”

I’m referring to, as you’ve no doubt heard by now, the D.C. Circuit Court of Appeals gutting the ACA’s ability to offer subsidies through the federal exchange. Why? Because the law only states that state exchanges can offer subsidies. And, because it is not in the law, you can’t do it. From National Review:

In a 2-1 decision, the D.C. Circuit vacated the IRS’s regulation on the grounds that the agency was not permitted to give tax subsidies except in states that had an Obamacare exchange “established by the State.” Judges Griffith wrote the majority opinion with Judge Randolph joining and writing a separate concurrence. Judge Edwards dissented.

The case, Halbig v. Burwell, is throwing the Left into fits. The response is overwhelming:


It’s the latest in a string of healthcare defeats for the president’s agenda. Between Hobby Lobby, delays in the mandates to buy coverage, and others that have happened, also with the projected spikes coming up in September that see at least 15 states predicting massive increases.

What it comes down to is this: The Left promised cheaper health insurance, plans we could keep, and a prosperous healthcare system to fix the broken system we had before. Each and every time it fails, however, it’s the Right’s fault for fighting it so hard. Apparently, our spooky language is enough to derail a behemoth of a law that, if read before it was passed Mrs. Pelosi, constantly needs to be tweaked to work. It is a failure of a law and one that we should continue to make the Democrats own.

And, when they complain, remember: It’s the(ir) law.

EDIT: It’s the law, even when the Court points out what’s in the law and what isn’t or isn’t allowed, in which case, the Obama administration says it will do what it wants. In this case, they announced that the subsidies will continue to flow the the rest of Uncle Sam’s breast milk.
