Tyranny’s Friend


The greatest enemy that exists to freedom is tyranny. Tyranny is above the law, ignores the law, makes up its own rules, steals power from others elected to govern, and defends the actions of lawless men. President Obama has increasingly shown himself to be a lawless man, whether its failing to enforce laws he doesn’t approve of (see DOMA, immigration) or making up his own rules. We are either a nation of laws or a nation of men. We can’t be both.

The president’s recent appointment of unvetted candidates to head bureaucratic agencies with broad regulatory authority without the advice and consent of the U.S. Senate is just the latest example that he is turning us from a nation of laws into a nation of men. This skirting of the Constitution is not only unprecedented in our history, but it fits the very type of executive fiat that is almost exclusive to banana republics.

Liberals, leftists, and apologists for the Democratic Party have tried to downplay the concern by confusing the issue and slyly spinning the president’s non-recess “recess appointments” as some ambiguous legal matter open to broad interpretation. It’s not. The arguments they have mounted are weak and ill-advised. They are made not out of a desire to defend America’s Constitution or the Republic for which it stands, but to defend one single ruler with which they sympathize. President Obama’s actions and their successful defense of them could be the downfall of our representative democracy, bringing an end to the checks and balances that keep our government from abusing power.

The left’s first inclination is to compare anything President Obama does to George W. Bush, because of course Barack Obama ran on four more years of governing exactly like Bush. But any comparison to President Bush’s appointments falls flat. President Bush never made a recess appointment during a pro forma session. In fact, the pro forma sessions were started by Harry Reid to prevent President Bush from making recess appointments. Even Harry Reid won’t dispute this.

The left has also attempted to justify Obama’s actions by blaming Republicans. This argument goes something like, “well, he tried to do it the right way, but Republicans are too much of obstructionists, so he had to bend the law.” Okay, first off, either you have principles or you don’t. You don’t just have principles when its convenient. Secondly, Democrats used the same tactics to bottle up President Bush’s appointments, and yet the conservative leader most vilified and despised by the left in the last 30 years, called everything from “illegitimate” to “Hitler”, never felt compelled to make such an overreach.

More importantly, two of the appointments President Obama made to the NLRB were new names that have not had a chance to be interviewed by the U.S. Senate. In other words, their appointments hadn’t stalled anywhere.

While recess appointments have been ruled constitutional, that doesn’t mean they aren’t ripe for abuse. It’s true that both President Clinton and Bush made over 100 of them, but none occurred while the U.S. Senate was actually in session (pro forma or not).  Further, it has been generally agreed by legal advisors to the last three presidents, including Obama’s own Justice Department, that a recess must last longer than three days for a president to enact his recess appointment authority.

Frighteningly, President Obama has thrown all the rules out the window and challenged the Senate’s power to approve any presidential appointment at all. Based on this new logic, he could make an appointment while the Senate adjourns to lunch. Not needing any votes of confirmation, one supposes he could even appoint whomever his leftist heart desires to the Supreme Court. Sure, it all sounds like fun and games to clowns like Jon Stewart, but some of us take this kind of fundamental shift in power seriously.

The left has never been a big fan of the Constitution, seeing it as an obstacle to all the Big Government they are sure we must desire, but let’s take a look at it anyways. Article 1, Section 2 is very clear:

“He (the President) shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law.”

Since the nation’s founding, the U.S. Senate has had the power to reject poorly vetted presidential appointees. Even the great George Washington’s nominees faced scrutiny, proving no one is above reproach.

By skirting the U.S. Senate, President Obama has challenged the very core of our system of government, and it was not by accident. If he had acted just one day sooner, the president could have tempered this crisis by at least making an intersession appointment. While still shorter than the usually agreed-upon three day recess, he would have at least had Teddy Roosevelt’s precedent from 1908 to stand on, albeit under completely different circumstances. Instead, the president waited to make an intrasession appointment during the shortest of short recesses. There’s only one logical reason for this, and that’s to permanently seize power from a legislative branch that has repeatedly been a roadblock to much of his socialist-progressive agenda.

If Obama’s actions are allowed to stand, it opens the door for him or any future president (should we be so lucky) to appoint whomever he wants to any bureaucratic or judicial position without the consent of any other elected representatives. Congress, the closest government body we have to the voice of the people, will be weakened to a whisper, and the president will be more empowered to act like a monarch or despot. The decisions of 1 man will be greater than the voices of 535 members of Congress, greater than the voices of 50 states, and yes, greater than the people. Tyranny has a friend in the Oval Office and his name is Barack Obama.


Quash the Ethanol Beast in Honor of Iowa Caucuses

As the clock struck 12 am January 1, one of the most anti free market government interventions expired without renewal and without fanfare.  In honor of the Iowa Caucuses, we can now declare that the ethanol subsidies and tariffs are finally dead.  However, before we celebrate this rare piece of good news, we must remember that in order to deracinate the ethanol beast from our midst, we must destroy its third leg; the 10% blenders mandate.

Over the past decade, ethanol has been the poster child for the worst aspects of big-government crony capitalism.  The ethanol industry has used the fist of government to mandate that fuel blenders use their product, to subsidize their production with refundable tax credits, and to impose tariffs on more efficient sugar-based ethanol from Brazil.

This onerous mega-intervention on the part of government has had a devastating effect on the price of food and gas and it has forced consumers to purchase inefficient and often damaging fuel.  Yet worst of all, it has enriched an industry that would have otherwise faltered in the natural order of the free-market.  Ethanol production has increased 719% during the past decade, as almost half of all corn grown in the country is diverted for this unnatural and odious use of a product that was traditionally grown for livestock feed.  Government-backed venture socialism is indeed a powerful force.

Ethanol blenders have benefited from the 45-cent per gallon Volumetric Ethanol Excise Tax Credit (VEETC), which may be refundable for those companies that lack any excise tax liability.  The ethanol industry has pocketed over $45 billion in subsidies since 1980, with a $6 billion annual price tag in recent years.  Additionally, all foreign ethanol imports incurred a 54-cent-per-gallon import tariff, which coupled with a mandatory 2.5% ad valorem tax, adds up to an increased cost of about $0.60 per gallon.

These two policies are unlikely to be renewed; however, the most egregious part of the three-legged ethanol beast –the mandate – is still intact.  Industry leaders are employing a rope-a-dope strategy vis-à-vis the subsidies, while launching a counterattack to double down on the mandates.  They must be stopped.

Tea Party and Occupy have some common concerns


Prior to the infiltration of nationwide Occupy demonstrations by many radical groups, there were some legitimate concerns being expressed, though some will criticize the methods they employ. Certainly there are some concerns they share with the Tea Party, and it may be time for the two groups to come together.

Congress has for many decades passed laws demonstrating good intent, frequently creating unintended consequences.  In the early 20th century personal income of corporate executives were taxed at very high levels, creating a need for alternative ways to compensate.  Thus stock options and pensions became part of overall compensation.  Name the law, and we can find unintended consequences.  Individuals and corporations alike have learned to use laws passed by Congress to their benefit, finding mostly legal ways to avoid further taxation or to gain an advantage.

It is these laws and their loopholes which should be targeted, along with Congress and the President who passes them, not the corporations which create most jobs in America.  Laws forcing banks to provide mortgages to those without the means to repay them, for instance, led to banks figuring out legal ways to avoid taking large losses when those mortgages fell through.  Laws allowing executives of taxpayer bailed-out companies to continue receiving large bonuses before the company repays American taxpayers should not have passed.  Those who break the law in gaining advantages should be, but often are not, prosecuted. Shutting down these businesses by Occupy crowds, however, hurts all employees from blue collar to white, not just executives.

Only 12% of Americans approve the job our Congress is doing. Crony capitalism is condemned because those with close ties to government receive “favors” including permits, government grants, earmarks, and special tax breaks.  We condemn bailouts of failing companies. Our Federal Reserve, which has never been audited, secretly bailed out banks around the world with dollars far greater than domestic banks received.  Baseline budgeting, without any vote in Congress, automatically raises the budget for government programs by 8% per year, even during times of budget deficit and no inflation.  Lowering the increase is decried as a cut, even though the programs receive even more money.

We should rethink spending on government programs.  Trillions of tax dollars have been spent on education, on the war against drugs, and the “war on poverty”, resulting in less able graduates, more drop-outs, more illegal drugs and more poverty.

Chaos, demonstrations and threats can and do bring a problem to the attention of America, as they have throughout our history. Working together, however, we can improve America without destroying the free market capitalism which has enriched the lives of Americans, whereby those who work hard and take advantage of their opportunities have an amazing chance to improve their lots in life, an extraordinary opportunity not afforded to those living in countries run by tyrants and dictators.  Socialist, Marxist and Communist leaders have never provided the freedom and upward mobility that is abundant in America.  People long to come to America and are willing to die to get here – it is the land of opportunity!  President Obama recently dared to defy history by declaring that capitalism has never worked.  He is factually impaired, as capitalism DOES work, and we need to reestablish the best opportunities of that capitalism.

 

So what is it that we can all do to make a change?  Tea Party and Occupy groups could begin to meet in order to find common causes.  We should peacefully petition Congress in large numbers with letters, emails and office visits, and attend Townhall meetings to have our voices heard.  We should demonstrate, without trespassing or keeping others from getting to their jobs.  We should be writing Letters to the Editor.  We could run for election as Precinct Delegates, the smallest political unit in the country to have a vote. Several hours per day on the phone could be more productive and far more comfortable than spending 3 months in a tent. We should take positive actions to effect change in America instead of trying to bring America to its knees.  Investigate those running for office, study their positions, and volunteer for those whose beliefs match your desires.  It’s the American way!

Debbie Wasserman Schultz Touts “Common Ground” With Some Republican Candidates on Corporate Welfare For Wind Energy


The chairwoman of the Democratic National Committee, Debbie Wasserman Schultz, made a surprise appearance at the Iowa Straw Poll earlier August 13th.  During a short interview, she claimed “common ground” with several Republican presidential candidates on renewable energy subsidies.  Much to the chagrin of economic conservatives, her claim appears substantiated.

Parked horizontally on the grounds of the Iowa Straw Poll throughout the weekend was a blade from a wind turbine.  Prominently displayed on the turbine blade were the corporate logos of GE and TPI Composites. These two companies partner together to develop subsidized wind farms throughout Iowa.  Representatives of this partnership provided magic markers to straw poll attendees and to politicians.  People could then indicate support of the projects by signing the turbine blade.  In addition, politicians were provided a speaking area to verbally express their support of renewable energy subsidies in front of the blade.

Both Mitt Romney and Debbie Wasserman Schultz (D-FL), amongst other politicians, attached their signatures to the declaration of support for wind energy subsidies.  Considering Mitt Romney’s portrayal of himself as a businessperson with an economic vision starkly opposed to President Obama’s, his apparent support for renewable energy subsidies for TPI Composites may give conservatives pause.  Unbeknownst to most Republican primary voters, several other prominent Democrats strongly support corporate welfare for TPI Composites.  In fact, President Obama mentioned stimulus funds provided to TPI Composites in a speech last year.   Another Massachusetts politician,  stalwart Leftist Barney Frank, recently proudly announced the placement of a TPI plant in Fall River, MA—a plant supported with a $250,000 grant from the government.

The apparent endorsement by several Republican presidential candidates of this particular corporate welfare recipient will likely raise questions with conservative primary voters.   After all, TPI Composites has also received accolades from Barney Frank, Debbie Wasserman Schultz, and President Obama.  Iowa companies have received more than $160 million in Department of Energy stimulus grants.  How unfortunate that some Republican contenders chose to endorse more of the same instead of taking the opportunity to explain the senselessness of such a system.  One would think that the Iowa Straw Poll would have been the optimal event to explain the free market perspective rather than acquiesce to the demands for more corporate welfare.
