The U.S. Court of Appeals for the Ninth Circuit announced a unanimous verdict to uphold the restraining order against Trump’s travel ban, on Thursday.

It looks as if Trump will push the issue to the Supreme Court, as he has previously alluded to.

In fact, his tweet following the announcement of the decision seems to be saying as much.

Senator Ted Cruz (R-Tex.) seems to believe it will go to the Supreme Court, and if it does, he feels things will roll back in favor of Trump’s order.

“The case will almost certainly be appealed to the U.S. Supreme Court,” he said during an interview on “The Michael Berry Show” in Texas. “If the Supreme Court follows the law, federal statues are straightforward, the president has this authority.”

He added the “Supreme Court is likely to conclude exactly that when the case is before it.”

Cruz pointed out that Ninth Circuit court has proven to be a notoriously liberal court of appeals.

“If you look at what the president’s order did, the heart of the order was a four month pause in allowing refugees to come to this country so we can improve the vetting of refugees,” he said. “That in my judgment is explicitly legal.”

As was to be expected, Democrats are taking a victory lap.

Senate Minority Leader Chuck Schumer (D-N.Y.) issued a statement, saying Trump should see that the executive order was unconstitutional and that he should just drop it, then come to work on a bipartisan effort to keep the nation safe.

Schumer’s remarks were quickly echoed by fellow Democrat Senators Dick Durbin (Ill.), Chris Murphy (Conn.), Jack Reid (R.I.), and Bob Casey (Pa.).

On the Republican side, the response has been more reserved. Other than Senator Cruz, Senator Tom Cotton (R-Ark.) has expressed his disappointment, referring to the Ninth Circuit as “notoriously left-wing.”
