… just maybe… his delay in keeping the donation promise is related to his indecision regarding tax deductions for charitable contributions…?

This is actually an impeachable offense. You can’t accept outside income as President of the United States. You work for the people and no one else.

The Nobel Committee just wrote back to me. The letter says nothing, but I take it that Obama’s prize money has been cashed:

Rep. Ginny Brown-Waite, Rep. Cliff Stearns, and Rep. Ron Paul say “no,” and have sent a letter to the President asking him to request congressional consent, which they expect would be speedily given. They point to the example of President Theodore Roosevelt, who created a committee, including the Chief Justice, to hold Roosevelt’s Nobel Peace Prize money in trust until he left office. After leaving office, Roosevelt asked for congressional consent to disburse the money to particular charities.

Article I, § 9, clause 8, of the Constitution states that “no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.”

When Roosevelt won the Peace Prize, there was apparently no controlling statute. Today there is: 5 USC § 7342 (titled “Receipt and disposition of foreign gifts and decorations”) sets out the conditions under which foreign gifts can be accepted without a separate action of Congress. The statute applies to an “employee,” which includes “the President and the Vice President.

MY (POPIK) OPINION:
The President of the United States simply can’t accept a million dollars, even to give it away to his favorite charities. This needs approval of Congress. Ron Paul wrote to Obama and told him what the law is. What makes this stink even further is that Norway is also a major contributor to the Clinton Foundation, a nonprofit led by the husband of the current Secretary of State. Never before in American history has a president and his staff accepted millions from foreigh governments so easily. We should know an answer by April 15th, when tax returns are due (Did he get a charitable deduction?), but again, accepting the money is against the law.

The law is pretty clear that the money should go to the US Treasury. If he gives the money to a charity, that is fine, but he still needs to transfer that amount to the US Treasury.

The reasons abound, the law notwithstanding.

What if I set up a foundation called “The Doghouse Peace Prize” and I gave the winner 10 Million dollars. I could use that as a campaign donation hiding mechanism, and surprise! The winner is Barack Obama! He donates it to his favorite charity, the NAACP, or ACORN, or ??? Now that the money has been laundered, it can go anywhere, without any vetting or audit.

I suppose that is one reason the law was made, but the law is the law. And he is a law professor, even though he never passed the bar. Ignorance is no excuse.

It doesn’t matter if we do or do not like his choice of charity – that is why he remains free to donate as he sees fit. And he can use any of his funds he wants to for a donation. But the prize money must go to the US Treasury, or he is in violation. Might be a high crime; might be a misdemeanor.

Is there a privileged class emerging in these United States? Many laws have a clause that exempt elected officials and their czars from the laws that the rest of us have to follow. Think about it.
