David Hamilton Survives Senate Test; Likely Confirmation


Today the Senate Democrats and 10 RINOs stopped a Senate filibuster against David Hamilton.

Hamilton has been under serious fire for his contentuous rulings and disregard for the law, basing rulings on his leftist ideology.

The vote–70-29–limited debate over the qualifications of U.S. District Judge David Hamilton of Indiana, and assured his elevation to the Chicago-based appeals court. Sixty votes were needed to end the filibuster, but confirmation only requires a simple majority of the 100-member Senate.

Ten Republicans repudiated their own party leaders and voted to limit debate. The Obama administration made a crucial decision from the outset by getting the support of Hamilton’s home-state Republican senator, Richard Lugar.

Hamilton has been criticized for rulings against Christian prayers in the Indiana legislature and against a menorah in the Indiana Municipal Building’s holiday display.

Conservatives were furious that Hamilton struck down part of an Indiana law requiring women to make two trips to a clinic for counseling before they could get an abortion. He said the requirement placed an undue burden on a woman’s constitutional right to choose to end a pregnancy.

Sen. Jeff Sessions, R-Ala., who led the opposition to Hamilton, argued that Hamilton’s record met his definition of extraordinary circumstances.

He not only attacked Hamilton’s judicial record, but criticized his work in the distant past: vice president for litigation and board member of the American Civil Liberties Union in Indiana; and a fundraiser for two months for the Association of Community Organizatons for Reform Now (ACORN).

Republican senators voting to limit debate were: Lugar; Lamar Alexander of Tennessee; Saxby Chambliss of Georgia; Susan Collins and Olympia Snowe of Maine; John Cornyn of Texas; Judd Gregg of New Hampshire; Orrin Hatch of Utah; Lisa Murkowski of Alaska and John Thune of South Dakota.

once upon a time there were members of Congress who were intended to represent the values of their state in the US Senate. Most Texans are offended by a judge who rules from the bench that prayers in Allah’s name are ok, but prayers in Jesus’s name are not allowed. On this vote Cornyn voted with the Ds, and KBH did not vote.

those ‘collegial’ senatorial types who’s been there far too long. He’s marginally better than Bob Bennett in a state that could and would easily elect two Coburns or DeMints.

Hatch has always played the rock-ribbed conservative at home and the ‘why can’t we be friends’ politico back in DC. I’ll never forget receiving a Hatch fund raising letter when I was living in UT right after the whleo Branch Davidian/Elian Gonzalez outrage(s) begging for a donation to his campaign so he could help stop the outrages occuring in the Clinton Justice Dept. I replied with a blistering letter that said that, seeing as he was chairman of the Judiciary Committee, that he could skewer Ms. Reno anytime he wanted simply by holding hearings on the whole sordid mess and since he, apparently, wasn’t smart enough to figure out that he already *had* the power he needed, I wasn’t going to be stupid enough to send him money.

Hatch is the living embodiment of what happens when you’ve been in DC too long and with any luck he’ll go the way of Bob Bennett. Utah ain’t Maine. It’s the Reddest state in the Union. It should have 2 rock-ribbed conservatives and Bennet and Hatch ain’t it.

But…having said that…UT, except for SLC itself, is about as conservative top to bottom and east to west as you’ll find. Both Houses of the Legislature are overhwhelmingly GOP, and, at least while I was there, all the statewide officials and federally elected officials ‘cept Mathheson in CD 2 are Pubs. (and even Mattheson is actually one of those rare ‘moderate’ Dems in actions, not just words).

You, on the other hand, on top of Dallas and Houston city propers, have to deal with the People’s Republic of Austin.

Jon Kyl asked me to donate, claiming to be a conservative faithful to our Party’s values and principles. I sent him money. Then, after getting elected, he joined the “backroom gang” along with McLame and McGrahamnesty, to attempt to sneak through Shamnesty for illegals.

So, I wrote to Kyl’s campaign and DEMANDED my money back. Guess what? I got a check in the mail for the full amount of my donation. I still have the letter and a copy of the check.

Just as an aside, I just heard Rush make the point that all “hot and bothered” McGrahamnesty, who’s asking Eric Holder questions today, VOTED TO CONFIRM THE OBVIOUSLY ETHICALLY CHALLENGED Eric Holder to the position of Attorney General.

A number of Democrats say elections matter, the president deserves a great amount of deference, and vote that way — but only if the the President is a Democrat. If the President is a Republican, they are preserving 233 years of Constitutional precedent by blocking nominees.
