Yesterday the White House went bonkers when several large corporations announced via their SEC filings that they were taking about $1.5 Billion in losses this quarter because of one provision in the health care takeover bill Obama signed into law last week. The Wall Street Journal estimates Obamacare will cost the Fortune 500 some $14 Billion in this single provision.
They trotted out the hapless Commerce Secretary, Gary Locke, to deny basic laws of economics and according to some reports White House aides were directly calling and berating company executives who were complying with federal law.
Henry Waxman took a brief hiatus from braiding his nose hair to announce that he would hold hearings to determine why these imbeciles had fraudulently declared Obamacare would cost them money when everyone knows it is the key to balancing the budget and retiring the national debt. According to him:
The new law is designed to expand coverage and bring down costs, so your assertions are a matter of concern. They also appear to conflict with independent analyses.
In fact, Waxman asserts that the losses run counter to a report prepared by the Business Roundtable predicting the health care takeover would reduce health insurance costs to businesses by $3,000 per person:
The Business Roundtable, an association of chief executive officers from leading U.S. companies, asserted in November 2009 that health care reform could reduce predicted health insurance cost trends for businesses by more than $3,000 per employee over the next ten years.
As the head of the Business Roundtable helpfully points out, that really isn’t the case.
To set up what happened over the past few days you have to go back to the basic predicate that kept the BRT “at the table” throughout the health care reform debate. Our companies already provide health insurance for 35 million employees, retirees and their families. For us, the economic burden of sky rocketing costs dictated our continuing efforts to get the legislation right so that we could continue to provide coverage and still compete in the international marketplace.
Buried within the legislation is a provision which applied a new tax on companies who provided prescription drug benefits to their retirees as part of the Medicare Part D law. That law gave a tax incentive for companies to provide this benefit in a way much less costly than if the retirees went directly to Medicare. From the beginning, we warned Congress and the Administration that if this tax was imposed one of two bad things would happen: either companies would have to restate their retiree benefit cost reserves (an accounting standard), or they would have to drop this coverage.
No fewer than three objective studies were presented to Congress and Administration negotiators, including one analysis done for us by Hewitt Associates. The general conclusion is that the immediate reduction to earnings reported in 2010 could be $2,800 for every retiree and that the national total could be nearly $14 billion almost immediately—all to raise $2.5 billion starting in 2013.
So what happened? Exactly what we said would. Several companies announced last week they would be taking hundreds of millions, even a billion dollar hit to earnings. The absurdity was that it triggered cries of indignation from Congress that it was a play to undermine the new law. One congressional committee has even scheduled a hearing. Why? To get to the bottom of exactly what we said would happen.
In fact, the report states clearly that the “if properly enacted, the right reforms” could reduce health care outlays. Obamacare fails, definitionally, on both counts.
We are at a stage of the health care debate where the thoroughly stump-trained CBO’s twenty year predictions of an economic Golden Age are meaningless. What matters now is the criminally irresponsible law that our criminally irresponsible president signed.
Regardless of where one stands on the health care takeover the fact remains that most Americans receive health insurance through their employer. One would think, then, that it would be in the best interests of anyone trying to expand health insurance coverage to make the associated expense as low as possible. The only conclusion one can draw from the inclusion of extortionate financial demands being made upon employers by law, rather than by implementing regulation, is that the health care takeover bill is actually designed to make employers reduce their insurance expenses and set up a demand for a complete federal takeover of the health care system.
When following this debate one is struck by a story Ronald Reagan used to tell about the way Democrats treat productive members of our society. Here I’ll close in the voice of P. J. O’Rourke:

I have a single member LLC (I have no employees and I am on my wife’s insurance). There are no changes to my books, which I keep myself. If there were, I’d have to hire an accountant, so I would take the hit twice.
I have no incentive to hire, even if I do get plenty of work. Nice going, Congress.
Faithful accounting still applies, and companies are going to have to demonstrate–to Waxman’s face–in excruciating detail, in public view–just how much of a hit to businesses, large and small, this bill is. Careful what you wish for, vermin.

1) The hearing isn’t to gather information or allow the businesses to explain what they’ve done and why. This is a show trial – the purpose of the hearing is for Dems to get on camera berating the businessmen as greedy, etc. The Dems are not going to play fair with the businessmen.
2) The media won’t play fair either. What you’ll see and hear about are the opening statements of sanctimonious Congressmen; if you hear anything said by the businessmen, it will be snippets taken out of context to put these businesses in a bad light.
Congressional hearings aren’t about finding the truth. That’s not going to change – the whole thing will be rigged.

It’s beyond absurd to do a bill of this length and then pass it without knowing what’s in it or giving any thought to the repercussions of what will happen to American business because of it. At rare random intervals, some Legislator will remember his oath of office, and make an attempt to perform an honorable act. The mixing of totally unrelated purposes – Health Care and Student Loans – in the recent legislative disaster is typical of Congressional misdirection. And we will probably not get the Hyde amendment passed this year because the problem is resolved by an Executive Order. Not. I expect the Senate to propose and pass a bill superseding the EO addressing abortion funding, so Stupak’s mess of pottage (what is that anyway?) will be whatever Obama has promised in earmarks.
I hoipe 100% of earmarks are published by someone over the internet. That way the lying cheaters in Congress (both houses) will be known to all of us. And I mean their requests, not just whatever gets approved.

phxg (Diary) Tuesday, March 30th at 1:12PM EST (link)The company I was last involved with, Non-Medical In-Home Care has 78 current employees. This company will be forced to adhere to the #HCR rules. As such, the company will take a 9-14% hit initially to earning costing ~$90K yearly.
The owner has developed a strategy which will convert current employees into contractors making the individual liable for all insurance, health care costs etc. Ultimately, the employees wages will rise ~$1-4/hr as a result. However, in doing so the caregiver will not be covered under an extensive (and costly) insurance policy because as we have seen, independent contractors do not typically take such regular protections a business would.
This will save the company money, but place the customer in a position of having an uninsured contractor in their home. All because the owner is not ABLE to take a $90,000 hit to his earnings.
Obamacare, affecting us in ways never considered.

I’d like to see the strategy, but I am a bit skeptical.
My contractors failed to maintain Workman’s compensation and general liability insurance.
At the end of the first year I was stuck with $13,000.00 in Workman’s compensation (Due immediately upon completion of audit, in full.) I had to pay, and then there was a small accident which cost my general liability $7,500.00 ( Less my $1,500.00 deductible..) It just didn’t work out. Too bad too, because I was handing out jobs by percentage…the guys were making considerably more. It looked like a great option, but I have dropped it as all the responsibility still fell to me in the end.
Personal responsibility of these contractors was a part of the problem as they all had an ” Employee attitude ” Ok, I am not being derogatory, just they had never been in business and don’t take it seriously. Great guys, friends too, but that is a hard one to get over to them.
The prime contractor is personally responsible to ascertain compliance, in this case, me.
If this business converts employees to contractors, strict policing will be necessary to avoid the pitfalls I encountered, and if the contractors do not fulfill certain levels of independence, they can be judged as being employees anyway, so one might find himself liable for all standard payroll deductions over whatever term might be called into question when audited.
It can be done, but it has to be done with great care and attention to detail.

I will say this though; the guy who owns this company is hyper-involved and exceptionally detail oriented. If it can be pulled off, he’s the one who can. However, this same problem will be faced by all Non-Medical In-Home care companies and there’s the problem, not so much for the company but the consumer. And the current state of affairs is that the consumers of this product are generally screwed daily as it is, this unintended consequence will exacerbate that problem.

Good or bad I’m pleased to be out of it (not by choice, thank you recession) however, the fact is this industry, like most, will be forced to adapt in some way to Obamacare. And it is, as best I can tell so far, going to be hard to adapt as people will soon believe these services will/should be free as a quasi-health care product.
My other work, as a paramedic however I am dreading. In MA the utilization of EMS has been substantial for primary care as it’s now “included”. I expect nosebleeds and stubbed toes will become frequent calls (even more than they already are).

teridavisnewman (Diary) Wednesday, March 31st at 7:42AM EST (link)Independent contractors are used extensively in the taxi/limo industry and any other industry or company that doesn’t want to pay taxes or give benefits by calling their workers “employees”. It has nothing to do with the building trade. I see a lot of businesses reclassifying their workers as independent contractors which not only removes the requirement to provide insurance, it also removes the requirement to pay part of the payroll taxes and shifts the cost to the worker. The IRS rules defining IC designation are stupid simple and as long as you follow them, you are off the hook. The government will also lose a ton of cash flow as the employers will no longer be sending in quarterly tax payments, it’s up to the contractor to “estimate” their liability and send it in. Most of them are going to estimate it at zero and not send in a penny until April 15 IF they owe any. Being an independent contractor gives you lots and lots of deductions–another reason smart people like it and employers use it. Just another example of the Obamasiah being totally incompetent and short-sighted.

They may look simple but the question is not what you call your contractors but whether what you call them can survive an audit. And having a number of contractors is an audit flag for companies.
Take the taxi/limo drivers. They could be independent contractors but if you set rules for how the drivers must dress, treat passengers, etc., presto change-o they are now your employees.
Strip bars have historically considered the dancers to be independent contractors. They are now losing the fight in court case after court case and having to pay retroactive wages and benefits because they did things like require the dancers to work specific shifts or dress a certain way.
Don’t believe this glib bit of nonsense above. Classifying people in your company as contractors is a very technical matter and you need to talk to a very good accountant or lawyer before embarking in that direction.

She’s always been afraid of losing the company health care that followed her into retirement. Guess who bought “Ma Bell?” AT&T, the company saying they’ll need to take the $1 billion loss, and the company saying it will need to reconsider carrying retirees on health care.
My aunt is 80 years old. She doesn’t need this kind of uncertainty and fear right now. I wouldn’t be surprised if the worry takes years off her life. Which might be the plan, of course.

Think back to any Dem announcing anything about the health care reform bill. They never answered any significant question. Always mouthing the party-line about savings and medical services to millions of new recipients as a response to questions like “How much will it cost?” or “Why is the Student Loan change part of this bill?”
Reps are almost as bad, as they almost always repeated statements about “Incredible costs to our grandchildren” and “Who has read the bill?”
Why didn’t Senators like Hatch and McCain at least organize a study of the bill at hand, during the several weeks something was available?

This along with the fact that the economic recovery has not yet started to even trickle to a start in the building industry shows that we are in for the long haul. We have all heard for 15 months Dem vs. Rep on the health care garbage. The media has been very nice at making stuff work out. The media take was and is to highlight the battle of Dem vs. Rep not the battle of lost civil rights. Let’s talk about paying for this. Who will oversee this debacle? Guess the IRS just got another stimulus bill. Now we have a real dilemma here we do not have enough people to make up the premium. We have too many that will not have to pay because their income is not enough. Now a good deal of these folks do have a lot of kids and they are in the obesity dilemma. So where is the extra money coming from? The best guess is a flat % FEDERAL TAX at the retail level. Part of the perfect storm the person than turns to Jumbo Jack for a burger and is taxed on prepared food. So we are getting the lions share from the poor through tax ok as long as we keep them smoking and drinking, right Nancy. This minutiae will continue to grow out of control.

This is on top of increases year after year. We have downsized our coverages twice in the last 3 years. And you can bet that if we stay with B/C B/S, there will be another increase next year. Where does Obama get this crap about rates going down now that his pet bill has passed?
Cost containment and tort reform will be the road to reducing premiums. You know how much of the latter was in this bill. Nada.

Prepare to see Waxman et al displaying the glazed eyed appearance of a deer in headlights, as the semi approaches, they have no more concept of economics than a gerbil, none of them have ever so much as run a koolade stand, and I have serious doubts that any could even balance and reconcile their own checkbooks, let alone understand the nuances of negotiating the minefield of IRS and SEC regulations forced upon publicly traded companies.
Also their complete inability to grasp the concept of an entity being beholding to their stockholders to return to them a profit on their investment, as they daily exhibit this fact by piffling away billions of our (investors) dollars for naught.
This little debacle will be interesting to watch, if they refuse to allow CSpan to broadcast it, we need some folks in the hearings with cell phone video or at least audio. I don’t know if they can legally prohibit public viewing, as this law has been passed and hence is now public law, and since it is not a national security issue or a criminal proceeding, I don’t see as they have a choice.

PS The rules for scoring legislation, both CBO and Tax Committee need to be changed to take into account the predicted effect of changes on behavior in the market. An example of how congress is DISHONEST and needs to be replaced.

1. A good many of those who work for government agencies are unemployable elsewhere. While many highly specialized positions are filled with qualified people, many are not and their failed attitudes and abilities pervade they system. This effect will only become more significant as this administration continues its jaunt through the heart of our democracy and has to fill the jobs in an ever growing bureaucracy.
2. What will happen to healthcare costs of the hospitals? Many hospitals currently avoid having to pay health benefits to their employees by calling them “part time” or “temporary reserve” while working them 40+ hours a week. Is this still gonna fly???
3. The tanning salon tax is racist! It singles out white or light skinned people.
We conservatives must coalesce, stay the course and not let this administration and their radical ways ruin our very hopes and dreams. Let’s face it, Obama is a classic narcissist and he is now set for life. He does not care about anyone but himself and how he appears to others. Many of us in Illinois never heard of him until the Senate race fiascoes of the past. His ascension is frightening and parallels many other leaders who have led their nations into some of the darkest of times.

No non-government business would survive with such poor service. In a day and age when I can pay my bills online, shop on line, communicate online at the speed of light, why do I have to wait three hours in a line at one of these offices and then wait up to two weeks for my replacement SSN card to be mailed to me by the multi billion dollar losing Post Office? Any private enterprise that attempted to conduct business in such a fashion would be out of business in a matter of weeks.
Certainly there are excellent, dedicated, hard working people holding gov’t jobs. Unfortunately there are dozens of unnecessary gov’t jobs for each one of those people.
