Yesterday, Obama called for a speedy confirmation of his SCOTUS nominee, Sonia Sotomayor. Any opposition, he claimed, was built along purely partisan lines, and not on drawing “old battle lines and playing the usual political games, pulling a few comments out of context to paint a distorted picture of Judge Sotomayor’s record.”
Obama seems to be missing the point, but fair enough; enough Republican pundits and pols have played the race card with Sotomayor’s comments that he can perhaps be forgiven for being confused on the issue. So, in the spirit of fairness, let’s look at Sotomayor’s comments, and then the Administration’s interpretation of those comments, so that we can look at them in Obama’s “proper context.”
Sotomayor, of course, made the now-infamous remark that “I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.”
For those painting the comments as “racist,” the sticking point here would appear to be the “better conclusion” remark. And they have a point. But there is a context here which lends itself to the Administration’s interpretation. The argument can be made, and should be made, I think, that what she’s really saying is simply that her life experiences give her a perspective into the lives of the people involved in the individual cases, and better inform her judgements.
Okay? Fair enough? So let’s diffuse this racist thing and boil down what she’s “really” saying. She’s not saying “Latina women are smarter than white men.” No, what she’s saying is that because of her experiences, she has the ability to render judgements on individual cases, not according to the law and constitution, but based on subjective standards based on her subjective life experiences. As Obama said, hers will be decisions based on empathy and understanding.
One problem with that, of course: any subjective coloring of her decisions based on her life experiences is a clear violation of her oath of office.

Without respect to persons. Equal right to the poor and rich. Faithfully and impartially. This is the point Obama seems to be missing. This is the point hidden by the “race” controversy. A Justice should not be swayed by subjective experience. At all. The job of a Supreme Court Justice is to judge, not based on her idea of “fair,” not based on what she personally thinks would be best for one party or the other. But on the law of the land and on the Constitution.
No wonder Obama wants a quick confirmation. Perhaps he fears that, given enough time, the racial undertones of Sotomayor’s comments will give way to the reality of her views on the position of the courts as unelected activist legislators.
There is a reason for the courts being set up the way they are. Put simply, the Highest Court exists as a safeguard against (often well-intentioned) idealism or ambition turning into tyranny against the citizens of the United States. To be sure that the laws of the land apply equally to all, and not differently depending on your race, income or social status.
And even if you take Sotomayor’s comments in the context the Administration suggests, that’s really what it comes down to. She — and Obama — believe that her experiences give her the insight into how to apply the law in the way that best fits their subjective version of “fairness,” as applied to each individual. Which is precisely the opposite of what the Supreme Court oath demands.
Hopefully, Republican leaders can learn from the recent past and understand that when this administration calls for a quick decision, it’s often because there’s something to hide.

I would prefer to contrast the oath to be taken by an Associate Justice with what Obama recently said at a Hollywood fundraiser.
The implication to the ‘starting to provide some justice’ line is that justice is not currently provided.

And I think that, as long as that point continues to be obscured, Obama is happy. He LOVES that Republicans are making a big deal on the race thing, because it hides the real problem: that what Sotomayor represents is bench tyranny.
I’m not suggesting that we ignore the racial implications of what was said, only that her bastardization of the Justice system be given more attention.

We don’t lose the other error she makes that most all liberals share by highlighting the race remark, especially from a political standpoint because most liberals don’t appreciate racism of this kind at all, esp when one couples it with the Ricci case.
The left knows this statement is toxic, hence the Gibbs and then Obama walk back FRIDAY interview on network TV.
If her statement isn’t blatant racism, of the classic superiority kind, then it would be hard to construct one other than to sat: “I think latinas are superior to white men.” and even then, they could holler context.

I am pleased that Lindsey managed to get out that Soto’s statement was the classic definition of racism, i.e. superiority claims, even if he didn’t affirm that 2+2=4 and that Sessions would not refute Rush and Newt’s claims.
I am working on a column that fully explains my position on the word “racism” vs the statements and behaviors that may define it. What matters most is the statements and acts themselves, not semantics and too bad for Soto and Obama that Soto’s statement is so succinct and vile. It hurts her every time its repeated, no matter if it is in the context of “news” on Rush/Newt and debate about them rather than her.
What people hear is her vile statement and even libs cringe when they hear it. Libs don’t like to get passed over based on race either!
I don’t consider calling a racist statement what it is. I do usually hesitate to call a person racist except in extreme cases, which I think this one is, so I don’t have a problem with Rush and Newt and I don’t have a problem with Graham and Sessions refraining from that using that word.

Like white men have an easier life because they are white and there is no way their struggles can compare to hers.
That was one benefit I had from growing up in a church, I never learned that type of “he/she has it easy cause she is rich or he/she gets everything free cause they are poor” becuase I knew people as people with their heartaches and struggles and income is not discussed.
The really sad thing about this whole thing is that we need women and men with real experiences to be in positions where they do understand what it’s like to be discriminated against or not have resources to follow the usual path and what extra it takes but she is putting is putting it to the wrong job here! Apart from the whites have it better attitude, imagine how much good she would with children that grew up in the system that have gone to college that need guidiance on things like transitioning from college student to graduation/professional work or as the head of financial aid or something.
I don’t understand why she is painted as being so poor? Her mother was a nurse that is job that requires a college education and pays well. She may not have old family money but nurses are not poor. I really wondered how did they even qualify to live in projects. It made me wonder if they did some kind of fraud to qualify like not reporting income.
There is absolutely both racism and class envy in her speech.

I usually simply characterize actions of words as having that effect. I have made exceptions for Farrakhan, Rev Wright and now Sotomayor due to their blatant nature. Obama’s two autobiographies also smack of this as well.
But I have also argued here that what matters most is what people do. I know many people that use the n word for example but that hire blacks and latinos and have many such friends. Yet, I know many people that would think the n-word was the worst thing in the world that have never hired blacks or had black friends of any depth and who really look upon minorities as inferior.
One thing I came to loathe about the dem party before I left it was its race based policies, no matter the motive.
That said, Obama and Sotomayor have ACTED on their racism. Obama with the Justice Dept dropping of the election intimidation case and Soto on Ricci.

I agree with you m2oneson, I think it is often an element of class envy behind race issues. What people don’t understand is that never in any society are all people equal. No matter how many strata you have or the numbers in each group. For whatever reason, groups always differentiate within themselves, as well as without.
Unique to our country has been the concept of equal opportunity vs. equal outcome. And yes there has not always been equal opportunity, but that is what the laws are about. If someone like Sotomayor makes decisions not on the law, she actually harms all parties. If a law is not right, then we have a system in place to change the law, but liberal activism is going around our modern day process. In our current climate, the only ideas that seem acceptable are those from liberal whites and minorities. That is unlawful discrimination toward minorities and whites who are of a different political persuasion. Unfortunately, that is what is occurring with activist judges. She is an activist first and a judge second.
