NY 23 News: Owens Only Ahead by 3,026 votes now w/o Absentees?

http://www.syracuse.com/news/index.ssf/2009/11/its_not_over_recanvassing_shows_ny23_race.html

A recanvassing in the 11-county district shows that Owens’ lead has narrowed to 3,026 votes over Hoffman, 66,698 to 63,672, according to the latest unofficial results from the state Board of Elections.

The new vote totals mean the race will be decided by absentee ballots, of which about 10,200 were distributed, said John Conklin, communications director for the state Board of Elections.

Under a new law in New York that extended deadlines, military and overseas ballots received by this coming Monday (and postmarked by Nov. 2) will be counted. Standard absentee ballots had to be returned by this past Monday.

Did Hoffman concede too early?  He is still down 3,026 but with 10,020 votes out there or more ( and most of this done when the race was 3 person race) one has to wonder what final vote tally will be here?

( sorry for the link perhaps someone can fix it)

So what would happen if Hoffman actually ends up with the lead

Does his concession override that actual vote total? And if so, wouldn’t that disenfranchise voters?

The greatest evil…is conceived and ordered (moved, seconded, carried, and minuted) in clean, carpeted, warmed, and well-lighted offices, by quiet men with white collars and cut fingernails and smooth-shaven cheeks who do not need to raise their voice. Hence, naturally enough, my symbol for Hell is something like the bureaucracy of a police state or the offices of a thoroughly nasty business concern. -C.S. Lewis

Seems highly unlikely...

… but I don’t see how a concession would override the vote. Remember that Al Gore conceded early in 2000 (until our pals in Palm Beach County assured him they could steal it for him).

Hoffman would have to resign, not concede, if he actually won the vote.

The concession doesn't matter now -- it just mattered Friday (and Saturday)

If Hoffman wins the final count, Owens will be removed from office and Hoffman sworn in.

Its too bad

proudgop (Diary) Thursday, November 12th at 10:34AM EST (link)

as Hoffman’s campaign spokesman says had they known these number they would have not conceded and if that had not conceded Owens probably would not be sworn in yet

which mean we would of been at 219 for health bill and perhasp Cao would of not voted way he did and then u are at 218 and who knows what Dem might of switched

That's a good point...

mschmitt (Diary) Thursday, November 12th at 10:45AM EST (link)

If they had fought it in the courts, no way Owens is sworn in already.

But it probably didn’t change the healthcare takeover vote — they would’ve been able to flip another blue dog (committee chairmanship, lobbying credits for the ones who are probably losing anyway, etc.). Heck, there were probably half a dozen holding out for better spoils when Owens came along. At least this way, you have a guaranteed L for Owens next year. If it had dragged out too long, they would’ve had the vote without him and NY-23 might be stuck with him for another term.

There was so much confusion

Hooah_Mac (Diary) Thursday, November 12th at 11:06AM EST (link)

The results coming back didn’t make any sense. When Oswego numbers showed so poorly for Doug, the campaign didn’t see any way that they could end up winning. Now we find out why the numbers didn’t make any sense.

False info showed Hoffman losing Jefferson County...

Jeffrey Malbis (malbis) (Diary) Thursday, November 12th at 12:52PM EST (link)

…by 300 votes on election night. Four of the districts within Jefferson County, which is the home of Fort Drum and the Army’s 10th Mountain Division, reported vote totals of “0″ for Hoffman.

Hoffman now leads Owens in Jefferson County by over 400 votes now that they’ve corrected those mistakes–and about 2,000 absentee ballots from the Fort won’t be counted until next week.

Hoffman could quite seriously pull this one out.

At this point, I think this would be too much for San Fran Nan

The only thing the democrats could be anything less than devastated about was NY-23. If it ultimately went to Hoffman…I hope Nancy Pelosi is up to date on her heart medication.

Does anyone know somebody in the campaign who has more info? Is this really something serious? I don’t want to get my hope up but if it gets any tighter it will be clear that the “voter irregularities” put owens over the top. Where is the NRCC or RNC?

It's not quite like that

Hooah_Mac (Diary) Thursday, November 12th at 11:04AM EST (link)

The votes are being counted, correctly by all reports. The problem is that the totals called in on election night were bogus. I was sitting in the building with Hoffman HQ, and his campaign staff couldn’t figure out what was going on. The numbers were so out of whack with the polling and models.

Two things to take away from this. 1. Doug Hoffman conceded early due to bogus information given to him by election officials. 2. The final results are no longer certain.

Doug will more than likely gain more votes out of the absentee ballots than Owens will, the question is if it will be enough to put him in the lead, or get close enough to trigger a recount.

In the case of a recount

Hooah_Mac (Diary) Thursday, November 12th at 11:09AM EST (link)

Many of the the machines used to vote are paper ballots read on a machine. If the vote totals end up within 500, a recount is really called for.

Based on what you know do you think there is a real chance this can be overturned? I don’t see the conservative websites talking about this. Is Erick aware of the situation? I don’t even see Robert Stacy McCain bloging about this.

This is new information coming out today

Hooah_Mac (Diary) Thursday, November 12th at 11:21AM EST (link)

WIth 3000 votes separating them and 10000 absentee ballots, it is indeed possible for Hoffman to win, although not likely.

I’d guess a 10-20% chance.

More importantly, if the vote narrows to less than 500, it would be irresponsible not to do a manual recount of the ballots. Especially considering the 11 machine malfunctions they had in the district.

Military Votes

proudgop (Diary) Thursday, November 12th at 11:23AM EST (link)

I’d be curious if anyone can find out how many military votes have come in so far?

I’d assume Hoffman gets 75% of those and Fort Drum in the area their may be at least 1.000 of them?

all conjecture of course

About 2,000 absentee ballots went out to Fort Drum personnel

Jeffrey Malbis (malbis) (Diary) Thursday, November 12th at 12:57PM EST (link)

And over 1,000 of them have been received so far. The deadline for receiving them, postmarked by Nov. 2, is this coming Monday. Absentee ballots will begin being counted then.

About 10,200 absentee ballots were distributed according to election officials, all of them before Scozzafava withdrew, so they are expected to favor Hoffman.

From the 1940 feature film Ghost Breakers, starring the late, great, Bob Hope and Paulette Goddard:

Scientist: “It’s worse than horrible, because a Zombie has no will of his own. You see them some times, walking around blindly with dead eyes, following orders, not knowing what they do, not caring.”

With over 10,000 absentee ballots,

Steph C (Diary) Thursday, November 12th at 11:13AM EST (link)

it may be a stretch but not impossible. Pray!

Pelosi, et al, spent a lot of political capital to get that health care monstrosity pushed through the House and a Hoffman upset will damage them greatly.

It's possible...

mschmitt (Diary) Thursday, November 12th at 11:19AM EST (link)

A 60-40% split (or better) on the military ballots doesn’t seem too unrealistic, and the elderly and infirm are pretty fired up about the Democrats’ health-care legislation (not that Owens told them the truth about his positions, but, nonetheless)…

Update

proudgop (Diary) Thursday, November 12th at 1:02PM EST (link)

Not the best news

http://www.watertowndailytimes.com/article/20091112/BLOGS09/911129996/BLOGS09

Waterdown daily has reported they have counted half of the absentee ballots and Owens has gone up 150 votes

5,4000 plus military votes need to be counted

If Dede had dropped out earlier

bk (Diary) Thursday, November 12th at 1:08PM EST (link)

one can only wonder how many of the absentee ballots (esp from military) or other early votes would have been marked for Hoffman instead.

Perhaps Dede really did cost him the election.

If Owens had not been seated...

bk (Diary) Thursday, November 12th at 1:18PM EST (link)

Then it still takes 218 votes since a tie is a loss. Without Owens and not counting Cao it’s 218-215 so it still passes if all else stays the same. But it’s fun to speculate – Without Cao, that makes each and every Democrat “the one” who caused it to pass. All cover is lost.
