I thought RedState made a point of not tolerating birthers.

Not a Birther Issue

Political Fireball (Diary) Friday, January 27th at 7:32PM EST (link)

This has nothing to do with the ‘birther movement’. This is purely evaluating the information Obama has given us and critiquing it. With what he has given us he is not qualified.

“It cannot be emphasized too strongly or too often that this great nation was founded not by religionists, but by Christians; not on religions, but on the gospel of Jesus Christ. For that reason alone, people of other faiths have been afforded freedom of worship here.”

There was no court ruling in Georgia yesterday.

deVere Friday, January 27th at 5:18PM EST (link)

I was just an evidentiary hearing.

The plaintiffs (3 of them) unanimously refused a default judgment against Obama in order to get their evidence against him on the record for the first time(!) in open court. The evidence speaks for itself to anyone with an open and rational mind.

It is certainly understandable to me why websites such as Redstate.com think this is an unproductive subject for discussion. However, it obviously becomes newsworthy if it keeps Barack Obama off the Presidential ballot. Apart from that, it is my opinion that Barack Obama has successfully intimidated almost the entire Republican Party with his “birther” epithet, from Chief Justice John Roberts through redstate.com and below. Mitt Romney is trying to do something similar with his “anti-capitalist” name-calling; it seems to be an effective technique.

Birthers are Fools

lapert Friday, January 27th at 5:28PM EST (link)

You are a fool. You mischaracterize (I assume because you don’t actually understand) what transpired in court. That you think there is any evidence here at all is absurd, that you honestly think it will keep him off the ballot in Georgia (or anywhere) is ignorance.

It really is odd how foolish people can become when chasing tin-foil conspiracies.

The Georgia case is both notable and unlikely to change anything ...

acat (Diary) Friday, January 27th at 5:49PM EST (link)

in time for the 2012 election.

If nothing else, Obama has the defense of saying “I am the duly elected President, and therefore am a citizen”.

The best that we can hope for, IMO, is a finding that will prevent future shenanigans, not a way to get rid of Obama.

(and, consider, we’d then have our candidate running against another relatively blank slate Dem … that does not play to Romney’s strengths)

Except no shenanigans

lapert Friday, January 27th at 7:20PM EST (link)

Except there are no shenanigans except among the Birthers. There are real issues to debate, it isn’t that this is a mere distraction it serves to derail the legitimacy of conservatives to be associated with it and it should not be tolerated.

Please see my above posts, lapert.

acat (Diary) Friday, January 27th at 7:29PM EST (link)

I understand your point. I am neither a birther, nor do I condone the level of stupid required to be one.

That said, there’s no reason to get hot under the collar. The Georgia law requiring proof is a legitimate point of discussion. As it happens, it will make no difference whatsoever in 2012, likely not 2016 either.

Some of this attitude is the same thing we saw when it was Texas, not the U.S. government, that was to try Lee Harvey Oswald. There wasn’t a law on the federal books at the time about murdering government officials, it was just another homicide.

We’re conservatives, we’re routinely smeared as “associated with” far worse than birthers; Ron Paul, David Duke, Stormfront…

This is not something to get hot about. This is something to use to educate those who can learn, and mock those who cannot.

I have a deep, quasi-religious respect for the truth when I can ascertain what it is.

deVere Friday, January 27th at 5:59PM EST (link)

In this current case, as a matter of simple common sense, If Obama had evidence to lay this controversy to rest, he would have presented it in court yesterday, and not invited a default judgment against his candidacy. No number or severity of insults is going to change the truth of this matter, and I am personally certain of what it is beyond a reasonable doubt. You are of course entitled to a differing opinion.

I do hope that Barack Obama is defeated this November, and the legal controversies about his qualifications becomes moot. On the whole that would be the least destructive outcome for the USA. But I can’t blame or ridicule anyone who goes to court truly seeking justice.

But you are so far off the truth in Birtherland

lapert Friday, January 27th at 7:17PM EST (link)

Look, your ‘opinion’ is so far from the truth and all it does is make the conservatives look like daft nut jobs (really no different that the worst of the ron paul supporters).

Here are just a ew shortcoming in your quest for truth. Take the quote above from U.S. vs Wong Kim Ark. Ignoring for a second that the date in the post is off by 50 years, the quote provided is part of a citation from a different supreme court case which explicitly did not determine the meaning of natural born citizen. In the Wonk Kim Ark case they determined that the common law understanding of natural born citizen at the time of the constitution did include those born within the country whether of citizens or not (with exceptions for ambassadors and enemies). In fact that was the common understanding in most of Europe in the 18th century, France explicitly moved to an inherited citizenship in ~1809 under Napoleon. Justice Gray actually concludes “Every person born in the United States, and subject to the jurisdiction thereof, becomes at once a citizen of the United States, and needs no naturalization.”

In other words, the actual historical record runs very much against the notion that he wouldn’t qualify, the case brought in Georgia is such a poor brief that engaging in it at all makes everybody involved dumber.

So if you truly are on a quest for truth, and not Truth, stop the ignorance that is Birthers.

It is against the expressed wishes of the editors for me to attempt to discuss this controversy at length and in detail.

deVere Friday, January 27th at 8:41PM EST (link)

So I will not do so. I am a guest here, not the proprietor of this website.

I would offer to discuss it offline, but your obvious lack of courtesy makes that option unappealing.

So all I can say is that you are entitled to your own opinion. Please enjoy it in good health.

Obama is in contempt of court.

snowshooze (Diary) Friday, January 27th at 7:26PM EST (link)

Oh… the birther thing… who knows if we will ever be certain of any of that. But I am beyond worrying over it.
But there is Fast and Furious, Green energy, and a host of other issues and Holder, Obama and others just ignore the Court.
I don’t know if I would ever try to do that.
I suppose Georgia could extradite. LOL

Do most birfers know how long it takes a case to get to the Supremes?

acat (Diary) Friday, January 27th at 7:31PM EST (link)

Hint: we *might* get a ruling about this before 2016. I wouldn’t bet on it, though.

jakeofalltrades (Diary) Friday, January 27th at 7:34PM EST (link)

I'm not a lawyer but I don't think failing to show up in a civil suit normally leads to a contempt citation.

deVere Friday, January 27th at 7:51PM EST (link)

Just a default judgment for the opposition.

Of course there was the infamous 7 years in jail for civil contempt that was served by Martin Armstrong. For every rule there is an exception.

And so you are correct.. I do not recall a sobphoena being issued either.

snowshooze (Diary) Friday, January 27th at 7:55PM EST (link)

But so far as Holder and Co. the contempt is obvious.
I don’t know what Issa is to do. If he doesn’t do something… he will be a laughing stock. Along with the Courts,.

Yes, a subpoena was issued to Barack Obama by Judge Malihi.

deVere Friday, January 27th at 8:35PM EST (link)

through his counsel. The counsel challenged the validity of the service, and was overruled by the judge. He moved to quash the subpoena and was denied by the judge. Then he sent his letter to the Georgia Secretary of State withdrawing himself and his client from the proceedings.

If you take the time to read the sworn testimony in Georgia

deVere Saturday, January 28th at 4:18PM EST (link)

Perhaps you will cease presenting an obviously document as evidence.

The passionate desire of Republicans to defend Barack Obama is bizarre. John McCain did it memorably during the 2008 campaign. Perhaps Obama is the svengali of our times? I never have been hypnotizable.

Anyway, from a tactical standpoint it’s probably best now to let Obama run for relection. If he is knocked off the ballot Hillary Clinton may prove to be unbeatable.

And pink unicorns shall fly

lapert Saturday, January 28th at 6:11PM EST (link)

Did you know they faked the moon landing too – plenty of sworn testimony to support it. Weird that they would do that given the leg up the aliens have on us which was well known due to all those documented abductions. But what can you do, I mean the media spends no time reporting on the big foot sightings right in our own backyard.

Yep, there is something bizarre here all right.

The Court decides who is in contempt, and no one can challenge it.

jakeofalltrades (Diary) Friday, January 27th at 8:12PM EST (link)

There is no appeal. So no – he’s not in contempt.

Then they were wise for being stupid.

Thomas Crown (Diary) Friday, January 27th at 9:31PM EST (link)

Default judgments are the easiest kind to set aside under O.C.G.A. 9-11-60, and the easiest to get reversed on appeal, because of roughly 1.573 x 10^23 cases explaining the importance of trying cases on the merits.

So they saved themselves some time and money, and now get to lose for really good reasons.
