As Erick has been repeatedly noting, there is an effort afoot to bring the public’s attention to the plight of three U.S. Navy SEALs (Julio Huertas, Jonathan Keefe and Matthew McCabe) who, as part of SEAL Team 10, have been brought up on charges that one of the most-wanted terrorists in Iraq, Ahmed Hashim Abed, received a boo-boo during a raid in September.
In early December the trio plead not guilty to charges of dereliction of duty and making false official statements. One would expect the government, having already brought charges, to be prepared to move forward to trial, originally set for two of them a fortnight from now.
Well, if you thought that, you’d be wrong.
Documents were submitted Dec. 30 to the trial judge, Capt. Moira Modzelewski, requesting the government continue the special court-martial of Special Operator 1st Class (SEAL) Julio Antonio Huertas, scheduled to begin Jan. 11, and that of SO2 (SEAL) Matthew Vernon McCabe, scheduled for Jan. 19.
Seems that there are some problems with the government’s case.
Both Lombardi [Huertas’ attorney] and Puckett [McCabe's attorney] say much of the government’s case so far is based on the statements of a third class master-at-arms who claims to have witnessed the alleged assault.
Both lawyers say the five separate statements given by that sailor appear to conflict with each other. Neither lawyer could discuss the exact details of the statements.
“I have read five different statements by this person, and all appear to be different,” Lombardi said.
The purported lack of evidence from the government has been identified as an issue since the arraignments started Dec. 7 and was the main reason that Keefe’s lawyer, Greg McCormack, asked for a continuance at Keefe’s Dec. 20 arraignment.
Seize onto this situation while the iron is hot. Go sign the petition asking that Secretary of Defense Robert Gates, under the Uniform Code of Military Justice, intervene to dismiss the charges against the three SEALs and direct that they be restored to duty.
These are American Heroes. They deserve better than this.

Personally, I could care less HOW they do it, as long as they do it well.
I met a quite a few SEALs while I was in the Navy…. No finer group of Professionals. And all of them had one of two things in common:
1) They mentally had a “special something” that no one else possessed, or
2) They were mentally missing “something” that everyone else possessed. But that’s okay! Whatever works!

Thank you for contacting me with your concerns about Navy SEALs who will face a court-martial. I agree that our servicemembers are heroes and must always be treated with fairness and respect.
I contacted the Navy about these charges and was informed that they resulted from a full investigation by officials at U.S. Special Operations Command Central and the Naval Criminal Investigative Service.
On December 7, 2009, three Navy SEALs were arraigned on charges that they made false official statements and had committed dereliction of duty. One SEAL was charged with assaulting a detainee.
The SEALs have asked for a military judge and jury to listen to the facts and issue a fair decision. I have great faith in our military justice system and am confident that this will occur. While military laws and discipline must be enforced, I do not want other servicemembers to feel that they have to look over their shoulders when they execute their duties.
The trial is tentatively scheduled for mid-January 2010. I will monitor its progress closely. If you have any additional concerns, please do not hesitate to contact me.

However, there were others who were not.
Those few, when identified, were subject to the UCMJ not only for what they did but for the shame and dishonor that they brought on the country, their branch of service and fellow service members.
If the initial reports are true, and so far I have not seen any real challenge to their accuracy, the SEAL who assaulted the prisoner committed a criminal act that is punishable under the UCMJ. The other two SEALs made false official statements about the incident and, according to at least one report, attempted to suborn a third witness.
If they have behaved in the manner as charged, they are not heroes being unfairly punished for an act of heroism but persons who have brought discrace to their uniform. I will stand up for an Alvin York but not for Danny Dever.

It is well past time to stop persecuting, slandering, and libeling the brave men and women who are doing the tough job of defending our country.

However, I have not seen any reasoned comment concerning the evidence in the SEALs matter.
The fact that some Justice Department prosecutors deserve to be censured by a Federal Judge in the Blackwater matter for their misuse of their office does not cast a cloak of innocence over the actions of the three SEALs.
Give me some valid evidence that discounts the information already available, including the statements made by the three SEALs, and I will reconsider.
I did not support Calley based upon the evidence and I wil not support these SEALs without evidence. I would settle for “reasonable doubt.”
So far, I have not seen any real attempt to refute the reported facts and charges.
What I have seen is a knee-jerk reaction by commentators who should know better imitating ACORN.

Um - There Doesn't Need to be Evidence to Refute...
JX12 (Diary) Thursday, January 7th at 6:06PM EST (link)…just a LACK of evidence to convict – even under the UCMJ. I’m sure that is probably what you meant, but it didn’t come across that way (at least not to me).
Having said that, I don’t see the criminal act here. So they gave a terrorist monster a boo boo. GOOD. What really galls me is, they could have killed him while trying to apprehend him, and would probably have been in considerably less trouble for it than they are for this.
The accounts I read say this incident occurred in 2004 (during Bush’s first term). I find it interesting that no charges were filed until over five years later – when Obama is in office (big surprise). If they had sufficient evidence to convict (assuming I were to even agree with the premise that this was wrong in the first place), then why not strike while the iron is hot?
This does not even come close to passing the smell test. It is a disgrace and an outrage – plain and simple. If you can’t support the SEALs in this, then I find it difficult to take you seriously. Sorry.

In the actual capture against a resisting opponent, anything goes. The object is to take the enemy personel quickly and to transport the prisoner quickly to a rear area. Anything short of actually killing the resisting opponent is permissible. The only objection to killing the resisting prisoner is that a dead man is not a good intelligence source.
If the SEAL had inflicted major physical damage to a resisting opponent in the process of capturing him, he would not be in trouble. Howwever, when in a secure rear area and dealing with a non-resisting prisoner, the SEAL must obey the rules. As a NCO in an elite unit, the SEAL is not being held to a higher
standard but to the same standard as the rawest recruit.
If you don’t agree that this was improper conduct, I am glad that we never served together. No one in authority wanted to punish the SEALs. In fact, the offer of the Admiral’s Mast was an attempt to close out the incident with minimum publicity and harm to the United States, the Navy , the SEAL teams and the individuals involved.
Not only did these three SEALs engage in wrongful condict, they compounded their original mistakes by opting for the publicity of a Court-Martial and the resulting damage to the reputations of the United States, the Navy, their fellow SEALs and themselves.
I wonder, would you have gone against General Patton when he had the National Guard office,r who shot Italian POW’s in Sicily, Court-Martialed? Or would you have supported Calley’s actions at My Lai? You can’t take me seriously? Thank you for the unintended complement.

What gives you the idea that the prisoner was non-resisting? He’s the one throwing out the accusations, and you seem to want to give the TERRORIST the benefit of the doubt that he’s actually telling the truth, rather than the Navy SEALs.
I frankly don’t care what your military background is. If your inclination is to give the benefit of the doubt to the terrorist levying the accusations, rather than the SEALs (especially when charges aren’t filed until FIVE YEARS after the alleged incident under a decidedly anti-war government), then what I’m I supposed to think of that?

Specklefoot is not a “Liberal” but, in a sense, he is in agreement with the “Liberal’ position concerning the American military when he attemps to defend the Navy SEALs. His basic arguement is that, since the other side has committed atrocities, our troops should be allowed to do the same.
In my nine years of service, I was never engaged in a “shooting war.” However, neither was the closest I got to combat was target practice in boot camp.
I, as an American soldier, was held by my superiors and held myself to the highest standards of military conduct. The military that I served in and, I believe, still exists was and is not composed of war criminals and other sub-human types. It is composed of honorable men and women who understand their obligations and are true to their oaths.
To excuse the SEALs conduct based on having low expectations of military conduct and honor is to dishonor the troops that stand in harm’s way.

The very fact that this has taken over five years to bring about, reveals there is more to this than assault charges. Lets face it, if they were guilty of a crime, even Bush would have prosecuted them.
Methinks we have a personality conflict going on here. Methinks we have one guy upset w/ another or a group of others & he decided to ‘get-em’, by asserting they acted inappropriately. If this was clear cut, why five different statements?
Our government does not have the time or money to investigate union fraud & corruption, will not investigate thugs w/ billy clubs standing outside a polling place in 2008, & will not investigate ACORN & its affiliated cabal of federal money sapping money laundering wing nuts. But we will go after three Navy SEALS for tagging a terrorist?
These charges appear to be an over-reaction w/ more than a tinge of political motivation, greased on by personality conflicts between one sailor versus others & may even be, dare I say it, envy over the respected status of Navy SEALS versus swabbies.
