I’m repeating myself, but the Left keeps trying to push back on this ad highlighting Wisconsin Democrat (and candidate for Supreme Court Justice) Joanne Kloppenburg’s utter lack of compassion for abuse survivors:

We have enough trouble with legislators being influenced by the money that put them in office, as well as out of state money targeting key races, but to have the same issues in the courts is a nightmare. It’s time for Wisconsin, and the many other states that directly elect their judges, to change the system.

There are plenty of activist judges in the federal system which does not directly have elections. The US Supreme Court is sitting at about the same split as the WI one. Also there are a lot of states where nominees for their supreme court are decided by a panel of so-called experts. Unfortunately these panels are stacked with liberals and lawyers. The bottom line is that there is no perfect system where we can eliminate the politics from the judiciary. As long as it has power there will be people who seek to corrupt it.

Nevertheless, the judicial branch is expected to be impartial, and this is nearly impossible when they are directly elected through a congressional style campaign. There is no perfect system, but there are much better ones than this.

Some states have appointment followed at the end of the appointed term with unopposed election (they really have to screw up to not be re-elected, how many people will vote against with only on person on the ballot?), the next best thing to appointment for life. And finally appointment for a specific term and then re-appointed (or not if the same party isn’t in control), or appointment for life.
What have I missed? By the way, WI judicial elections are supposed to be “non-partisan”, what could be better than that? OK, you can snicker, laugh, or roll on the floor at that.
Frankly, I’d rather the people have the decision than the Governor or Legislature. Politicians are most often lawyers, how you can think they will do a “better” job. Oh, and there are the “merit” appointments – where a committee (of lawyers) recommend potential appointees. Of course we can count on a committee (much less a committee dominated/consisting only of lawyers) to do a great job of impartiality.

It would be wonderful to have elected judges so we could feel as though we had a say in the matter. However, I won’t hold my breath waiting for such in this bluest of blue state!

Whatever judicial appointment system you can come up with will run into that brick wall. The only way to stop this decay is to get a majority of the people (both voters and politicians) to truly understand the role of the judiciary and to care about that role, even (and especially) when it goes against their interest.

The other option is appointment, which is exactly what WA’s newly elected Justice would prefer and is subject to even more politicization. The failing is with an informed electorate, not the electoral system. With an informed population the ad’s and money become irrelevant.
If that was all it took to get my vote I would have cast my ballot for Obama, or our new activist judge here in WA. And because he is an activist judge that runs every step he takes past La Raza et al, liberal King County elected him. Changing that depends on changing mindsets.

NeoKong (Diary) Monday, April 4th at 10:15AM EST (link)The issue before the voters is whether or not the Wisconsin Supreme Court will uphold the law to limit collective bargaining rights for public workers in Wisconsin or will it be overturned by an unqualified activist judge in the pocket of the unions.
The issue is about whether state workers work for the tax payers or do tax payers work for the state workers and the choice of fiscal responsibility or bankruptcy.
It is not about child abuse that may or may not have occurred thirty years ago .
This ad makes me think of the I am not a witch ad.
When I saw it I groaned and thought to myself “We’re in trouble”.

It had nothing to do with the election.
That was why the PEU’s took that direction because they can’t really discuss what the election is all about now can they…?
They changed the subject so they wouldn’t have to run an ad that says
” David Prosser is in the pockets of those cheap tax payers who thinks poor state workers earn too much money.
On April 5th let’s send those cheapskates a message they’ll never forget and secure the benefits for state workers that they really deserve.
Vote Kloppenburg.”
They can’t really say that now can they so they smear Prosser with a distraction and the Republicans took the bait and now tomorrow’s election is about child abuse rather than collective bargaining.

General Elections Are About The Middle

If this election is just about the collective bargaining issues that appeal to conservaitves, he could lose too. That is why the ad is effective. It reminds the average Wisconsin voter that Kloppenberg is an unscrupulous reject, a repeated loser, who will do anything to pander to her base.

It would be a mistake to completely frame the judicial election on just one issue (Scott Walker).
I’ll be honest, I don’t have a great feeling about this election (no resources on our side) but moments like this in campaigns can create upsets. If Prosser pulls it out, I think this ad and moment will be what does the Left in. They went too far (as usual) and they got called on it.
Tomorrow's vote

If Kloppenburg is elected, the voters have heard the union (media) message at the Madison rallies, and are voting to limit the power of their newly elected Republican majority.
We shall see which way the wind blows in Wisconsin. We shall see.

I was born and raised in Wisconsin. This is what it is like to live in Wisconsin:
1. Build a “Bridge to Nowhere” (Hoan Bridge) that is built for a new expressway, but then, Milwaukee Mayor Maier kills the expressway expansion in Milwaukee to make the bridge, truly a bridge to nowhere for over a decade! Also, said bridge was built too low so newer commercial shipping vessels could not navigate under it.
2. In the 1980′s Chicago sues Milwaukee for polluting Lake Michigan with sewage and the always evil water run-off! So Milwaukee builds a 2 BILLION dollar sewage system that was GUARANTEED to handle the 100 year flood. It is so effective that even if the sky looks threatening, the system gives up and spews sewage of millions to billions of gallons into Lake Michigan faster than the French surrender!
In fact so much raw sewage was pumped into Lake Michigan from our 2 BILLION dollar hole in the ground, that in the 90′s the sewage infected the drinking water with Cryptosporidium outbreak that caused at least 104 deaths! And this tid-bit..NOT ONE PERSON WAS FIRED!
3. Lastly, let me remind you about Jeffery Dahmer. The only reason his killing spree (in Milwaukee) lasted as long as it did was because the police chief at the time was a politically correct idiot. He instructed his officers to leave the homosexual community alone. So they did, even when a naked, bleeding young man was found, by police running for his life…and returned the young man to Dahmer!
I pray that Prosser wins. In my view, he is running a poor campaign. If he wins, Wisconsin can start winning in other areas…like jobs and lower taxes. Scott Walker will have a legal backstop to bring the laws that Wisconsin has needed for decades! If he loose, as much as I and thankful for Scott Walker, he will be made as about as effective as our sewage system!
