		<title>To control the production of wealth is the control of human life itself.</title>
		<description><![CDATA[<p>Think about this, the Constitution was written on four sheets of parchment paper. Counting all 27 Amendments there are 20 typed pages. None of the Amendments make a full page and many are single sentences long. Look at the First Amendment; in 45 words you get freedom of religion, press, assembly, speech, and to be able to petition the government for redress of grievances. The Constitution and the Amendments have been instrumental in guiding this country to greatness. </p>
<p>              Collectivistcare is tens of thousands of words and several thousand pages, it’s not to give you rights and freedoms but take them away from many. The &#8220;social planners&#8221; are subjecting the country to their vices, intemperance, immorality etc.                             These &#8220;reprobates&#8221; are the great sophists of the modern era, when they speak, it&#8217;s probably a lie. Control, control, control that&#8217;s all they seek, it&#8217;s for the betterment of society, we need to save the unwashed masses from the complete depredation of the planet. Purchase this car, this light bulb, buy this food, believe us when we tell you the &#8220;Constitution&#8221; is outdated and the &#8220;General Welfare clause&#8221; gives us complete authoritarian, I meant authority to pursue all our illicit decrees.<br />
  The news is filled with what the government is doing or what they can do for you. How they are saving the country from bankruptcy by raising the debt limit, spending and printing more money, remember these policies are good for the country, we just don&#8217;t know it. Politicians talk about what they have accomplished for us, what they have done and will do for us.<br />
 God, virtue, temperance, morality, justice and of course individualism and creativity is gone from the fabric of American society. Repairing Americas ills starts with “WE&#8217; not &#8216;THEM&#8217;.      </p>

		<title>Thinking outside of article V</title>
		<description><![CDATA[<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-family: Calibri;font-size: small">Why shouldn’t a nationwide call for article of amendment to the Constitution outside Article V be plausible? It took 9 sovereign states to ratify the Constitution! If the States and Congress had a massive national urging from, we the people, calling for the adding of an Article of Amendment to the Constitution and this proposing convention put forth an amendment or two for the ratifying convention? Since this amendment was brought up by a majority of the people, it should be considered supreme law of the land under Article VI.<span> </span>James Wilson said” The people may change the Constitution whenever and however they please. This is a right of which no positive institution can ever deprive them.” I believe enough informed people could accomplish this! I have read our country has never pursued a non- article V amendment process? Popular sovereignty is an inalienable right given to us! We should try it; Most in Congress and the President do not seem interested in what is best for “people”. The few should not be able to destroy the many and what was created by givers, not takers! I know James Madison and James WIlson were on seperate sides of this issue and James Madison&#8217;s Federalist 39 dealt with this issue. Who then will be the best curator of our Constitution, our country ?  Aristotle stated;&#8221; The best legislators are from the middling citizens. Their character makes them govern most wisely and moderatly, at least more so than the very rich or the very poor&#8221;. If we don&#8217;t start steering this ship, nobody with the best interest of this country will, look at us now. We all know what happens when ships hit icbergs! </span></p>

		<title>The People&#8217;s Government</title>
		<description><![CDATA[<p class="MsoNormal" style="line-height: 200%;margin: 0in 0in 0pt"><span style="line-height: 200%;font-size: 14pt"><span style="font-family: Calibri"><span>            </span>The Declaration of Independence starts off talking about the “people’s ability to dissolve political bands, which have connected them with another.” Then it continues with “We hold these truths to be self evident, that all men are created equal.” Once again, the Declaration of Independence depicts “the people’s right to alter or to abolish it,” which would be a destructive policy or individual who optimizes the ability not to uphold and interpret the Constitution and ignores the people. The Articles of Confederation, Article III, states “The said states hereby severally enter into a firm league of friendship with each other, for their common defense, the security of their liberties, and their mutual and general welfare.” Basically, it is the ability of the people to control their government. In the end, “The people chose to abolish the government.”</span></span></p>
<p class="MsoNormal" style="line-height: 200%;margin: 0in 0in 0pt"><span style="line-height: 200%;font-size: 14pt"><span style="font-family: Calibri"><span>            </span>Then we have the inviolable “Constitution,” that begins with, “<a href="http://www.redstate.com/haystack/2010/11/02/we-the-people-of-the-united-states/">We the people of the United States</a>.” Article I section 1 gives the people the ability to choose their representatives among the people of each state. Section 3 tells how senators are selected, what they can do, procedures, thanks to the 17<sup>th</sup> Amendment which allows the people to elect their leader. Article II also gives “the people the ability to vote for president, along with the outdated electoral college.</span></span></p>
<p class="MsoNormal" style="line-height: 200%;margin: 0in 0in 0pt"><span style="line-height: 200%;font-size: 14pt"><span style="font-family: Calibri"><span>            </span>It would seem that this country was formed by the people, for the people. Article IV Section 2 gives “the people” privileges and immunities of citizens in several states. We are guaranteed in every state a Republican form of government, Article IV Section 4. With the Constitution, Bill of Rights, the people of this “republic” have copious ways to control the federal Government or bureaucrats who try to create their own personal utopia. One such method is preexisting state common law writ that Article I Section 9 protected against undue suspension, thus confirming state governments through their courts could and should prevent malodorous federal laws. Publius or Alexander Hamilton remarked, “If the federal government invaded the people’s rights, Americans could turn to states as instruments of redress. Any state judge issuing a habeas writ against a lawless president would not be defying but rather enforcing the Constitutions Supremacy Clause, which made the Constitution the supreme law, predominant over contrary presidential decree.” A president would most likely challenge the assertions in federal court and claim, acting under the scope of the Constitution. </span></span></p>
<p class="MsoNormal" style="line-height: 200%;margin: 0in 0in 0pt"><span style="line-height: 200%;font-size: 14pt"><span style="font-family: Calibri"><span>            </span>The Supremacy Clause, Necessary and Proper Clause, and the Commerce Clause are just are just some tools in the tool box called “The Constitution,” written and approved by the people, for the procurement of our freedoms and liberties. These same tools used to benefit the people are being used to control the people. Forcing the people into commerce so that they will be forced to buy healthcare through the Commerce Clause, forget competition, let’s control the people’s ability choose. Let’s control speech, thoughts, and the people who voice their concerns about government, even though the people who want to control say the most egregious comments. This country was founded on the premise of “We the People,” as I briefly stated, the axiom of this country was for the people to control the government, not the other way around. Let us not completely lose “We the People,” for a thralldom country and an oligarchy government. “We the People” started this country so “We the People” can keep this country.</span></span></p>

		<title>Who will decide?</title>
		<description><![CDATA[<p class="MsoNormal" style="margin: 0in 0in 10pt"><span style="line-height: 115%;font-family: &#34;Times New Roman&#34;,&#34;serif&#34;font-size: 14pt">There always seems to be a rush to control people lives when one, disturbed, Anglo person, such as the Tucson person commits a heinous crime. Lets control speech and how or what is said, but who is going to control such speech? What words are going to be the “trigger words,” “you’re a bad politician”, “your policies are bad”, “You’re destroying this country because you spend too much”, and “I am a conservative?” One can only imagine what will transpire from this nonsense. The Alien Sedition Act of 1798 was disgraceful at its best. It was finally removed when Jefferson took office in 1801. John Adams and his party tried to control political opposition and Matthew Lyons, a Congressman, was put in prison for openly rejecting President Adams and his party’s policies. Fast forward to today, will this type of control happen?<span>  </span>You know it will! This policy, along with the “fairness doctrine”…Would it really be fair to listen to people who openly dislike this country? Who think abortion is good, this country is bad, or taking a person’s earned wealth and giving it to people they have entrapped by their policies? Or listening to them tell you that listening to them is good, patriotic, and moral? Will not listening to them equal a crime? I would seriously worry about anybody who tries to control this much of your life. Also, by them trying to control your thought, speech among other aspects of your life, would be like stopping a freight train by lying on the tracks.</span></p>

		<title>Our fathers who are in Washigton D.C</title>

Or will it be convenient to say there is nothing we can do?</span></span></p>
<p class="MsoListParagraphCxSpMiddle" style="margin: 0in 0in 0pt 0.5in"><span><span><span style="font-family: Calibri;font-size: small">2.</span><span style="font: 7pt &#34;Times New Roman&#038;quot">       </span></span></span><span style="font-family: Calibri;font-size: small">Will there be a real effort to stop out of control spending and cut the deficit, before we<span>   </span>go bankrupt?</span></p>
<p class="MsoListParagraphCxSpLast" style="margin: 0in 0in 10pt 0.5in"><span><span><span style="font-family: Calibri;font-size: small">3.</span><span style="font: 7pt &#34;Times New Roman&#038;quot">       </span></span></span><span style="font-family: Calibri;font-size: small">How about a 28<sup>th</sup> amendment to the Constitution, prohibiting the government from not balancing the budget or simply a balanced budget amendment? This was a very pivotal election; hopefully the newly elected people will be optimates, and not have the normal Jeckell and Hyde candidates.</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt"><span style="font-family: Calibri;font-size: small">We have now entered into an exigency period in our country. It would seem that Congress and the president have malignity towards the majority of Americans. I believe, as well as many Americans, Democrats and some Republicans have become injudicious in what bills they support and pass. Congress has created execration among the people by calling them xenophobes, bigots by simply expressing their opinions and utilizing, “the rights of the people peaceably to assemble, and to petition the Government for redress of grievances.” The sophists in Congress have disdain for their languid constituents, who in return have lost faith in the local and federal governments. In the end, government has obliged itself to rule, not govern; the meritocracy has decided to rule through corruption, force, and fear, rather than through mutual confidence.</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt"><span style="font-family: Calibri;font-size: small">James Madison said, Federalist no. 51, “One of the main problems of Republican government, was to protect citizens generally from government officials pursuing their self-interested agendas at the expense of their constituents.” Chief Justice Marshall warned in McCulloch vs. Maryland, “Congress could not under the pretext of executing its power, pass laws for the accomplishments of objects not entrusted to the government.”</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt"><span style="font-family: Calibri;font-size: small">Polybius, “So when they become fond of office, and find themselves unable to obtain it by their own unassisted efforts and their own merits, they ruin their estates, while enticing and corrupting the common people in every possible way. The founders of this great country, George Washington, James Madison, Thomas Jefferson, Patrick Henry, George Mason, Elbridge Gerry, Edmond Randolph, Henry Knox, etc. are among the many who worked assiduously to start and form this country. They were willing to sacrifice their wealth, lives and families to create a one of a kind country, in which we enjoy today. Despite the many different views at the Constitutional Convention, they were able to compromise and give birth to our form of government, much sought after but never duplicated.</span></p>
<p class="MsoNormal" style="margin: 0in 0in 10pt"><span style="font-family: Calibri;font-size: small">Now to the opposite of what I briefly wrote about, we have a Congress that is not willing to sacrifice anything. When they lose their election bid, they are willing to siphon votes from a legitimate candidate. This only gives the pernicious Democrats a chance to win an election. Voting along with Democrats on their bills and changing their principles, even if the bill will be deleterious to the country. </span></p>
<p><span style="line-height: 115%;font-family: &#34;Calibri&#34;,&#34;sans-serif&#34;font-size: 11pt">With great urgency, we need to meliorate our economy and our country; Keynesian economics is simply bad for America. 		<title>Constitutional facts and Constitution</title>

<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>Take this bill that just passed the House of Representatives, 1200 plus pages and tens of thousands of words, it’s not to give you rights and freedoms but take them away from many. Just a quick side note, the Constitution is approximately 4500 words, that with the Bill of Rights empowering <span> </span>people, you can see 4500 words and the Bill of Rights are far more powerful than 1200 plus pages and tens of thousands of words. </span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>The Democratic Party would have you believe the “General Welfare” provision in Article I, Section 8 and the “Commerce Clause” and “Necessary and Proper Clause or Elastic Clause if you will, to pass health care, Cap and trade or any of these bills they deem necessary to decapitate the economy. Here is the “General Welfare” section, The Congress shall have power to lay and collect taxes, duties imposts and excises, to pay the debt and provide for the Common defense and general welfare of the United States; but all duties imposts and excises shall be uniform throughout the United States. James Madison, in Federalist 41, made it clear “General Welfare” was not written to help others by taking from others. The Democrats meaning of “General Welfare” is way off the mark, Madison notes that the phrase “General Welfare” is found in Articles of Confederation, Article III and has an obvious meaning. Article III <span> </span>states, hereby severally enter into a firm league of friendship with each other, for their common defense, the security of their liberties, and their mutual and general welfare, binding themselves to assist each other, against all force offered to or attacks made upon them, or any of them, on account of religion, sovereignty, trade, or any pretense whatever.</span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>James Madison, as you can see, meant what applies to everyone generally, taxes collected to defend our nation, serves the nation generally. The aforementioned meaning is remarkably different then the modern concept of “General Welfare” given to us by Obama, Pelosi, Reid, and a majority of the Democratic Party. They would have us believe the penumbra area of the Constitution is where their power lies, such as healthcare, Cap and Trade, abortion, and the taxing of individuals who obtain wealth by the sweat of their brow and simply not by being a Congressional member. Their meaning is called “Particular Welfare” and it’s not in the Constitution, hence their battle cry “General Welfare” is erroneous, the Constitutional meaning is welfare that serves the nation more or less equally. </span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>During the Virginia ratifying convention, Patrick Henry made many speeches about what the Constitution needed, Dangerous Ambiguities, Legitimate government, Amendments needed, Bill of Rights among many other. During this countries ratifying process for the Constitution, many people contributed to the Constitution and the Bill of Rights to ensure limited power of government and the rights of states and people were not impeded upon. This healthcare bill is a far cry from the Constitutions real meaning and what many people fought and died for. There are many reasons to file suit on this bill if it passes the Senate. The First Amendment, Free Exercise Clause, since many people do not believe in abortion and it’s their religious beliefs, they will be forced to pay for abortions regardless if<span>  </span>they like it or not. Free Exercise Clause states; guarantees one rights to practice one religious beliefs or lack thereof, without interference from the government. Establishment Clause, Separation of Church and State, now the government is going to tell faith based hospital, to commit abortion or be fined or lose their license or even the Doctors and nurses with religious convictions. </span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>Fourth Amendment, seeing nobody will secure in their persons, houses, papers, and effects, against unreasonable searches and seizure. The government will look into your bank accounts, taxes, and get forced information from employers. Fifth Amendment, by not paying for this healthcare bill, or purchasing it, we will be admitting to a violation of an unconstitutional law, witnessing against ones ‘self. We will be deprived of life, liberty, and property, without due process of legitimate law, life ,because you’re medical will be rationed when this bill runs out of money and your Doctor can’t see you for months, liberty, because when you are in jail and you will not have liberty or property. This reverts back to jail, you will not be working, I guess this means another housing crisis, credit crisis etc. </span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>Sixth Amendment, well if everybody is in jail or in the process, you can’t have a speedy trial or trial by jury; too many people will be missing from the jury pool. We can’t have witnesses against us, since the procurators of this type of government Stalin, Marks, and Alinsky are all deceased, but Hollywood could make up good look alikes. Eighth Amendment, because the fines and jail time for this unconstitutional law are too excessive, and the Ninth Amendment, the enumerations in the Constitution will be construed to deny or disparage the citizens of the United States. The Tenth Amendment defines the limited authority of the Federal government, to hold it within the strict boundaries of delegated powers, the reserved rights of the states and the people will be violated, I guess they will not be reserved.</span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>Fourteenth Amendment, Economic Due process will be violated, government will interfere with free market and cause business to pay more taxes for healthcare and subsequently causing them to go out of business and layoff hundreds of thousands or even millions of workers. This would cause workers not to be able to pay their bills and participate in a free society. I see another housing, credit crisis on the horizon. Substantive Due Process states government cannot interfere with certain matters, no matter the circumstances, Government will interfere everywhere with their antiquated ideas, and Equal protection of the law will not happen, the people being persecuted and prosecuted for not paying willing will be treated unequally as the people who actually receive healthcare free will enjoy the fruits of other peoples labor without persecution from the government.</span></span></p>
<p class="MsoNormal" style="margin: 0in 0in 0pt"><span style="font-size: small"><span style="font-family: Calibri"><span>                </span>When the 2010 election happens and the Congressional power swings back from this “ Oligarchy “to center right and Obama and his crews policies are refuted, why can’t this healthcare bill be overturned or parts of it struck down as unconstitutional. This is not an Amendment; there are no two-thirds of the states involved and three quarters of the states approval. With the entire antithesis towards the healthcare bill, why can’t it be overturned, it seems there should be a great deal of effort put forth by Republican Congressional members to live up to their<span>  </span>new found conservative ideas . The ideas that were brought forth after 2008 debacle of an election should be followed. This country is not a socialistic country, and with all the patriotic Americans coming forward after the Democrats stated and acted on their swallowing without chewing style of governance, there is not a chance the American people want to be lied to again and would expect the new congress that will be voted in, too hold up to their conservative platform ideas they ran on to get elected. The Supreme Court in the 1930s struck down plenty of FDRs laws, the Supreme Court made it clear the legislation passed was undemocratic.<span>   </span>This was criterion for this period of time, not until 1937 when President Roosevelt’s tried to stack the court did this change. I would hope anything and everything can be done to disrupt this bill in the Senate, we as a country can’t afford these types of policies and the blind and deaf people in charge. Let’s make a bill that is sensible, there only needs to be repairs made to problems not a creation of many seen and unforeseen problems. We can have certitude knowing that real conservative ideas will be fought for on this idea, if this bill does pass, it would be prudent that the new conductors of this economy and the country, after the 2010 election, guide the country away from the iceberg.</span></span></p>
