Pennsylvania Democrat Philip J. Berg, who filed a lawsuit demanding Sen. Barack Obama present proof of his American citizenship, now says that by failing to respond Obama has legally “admitted” to the lawsuit’s accusations, including the charge that the Democratic candidate was born in Mombosa, Kenya.

As WND reported, Berg filed suit in U.S. District Court in August, alleging Obama is not a natural-born citizen and is thus ineligible to serve as president of the United States. Though Obama has posted an image of a Hawaii birth certificate online, Berg demands that the court verify the original document, which the Obama campaign has not provided.

Now Berg cites Rule 36 of the Federal Rules of Civil Procedure, which states that unless the accused party provides written answer or objection to charges within 30 days, the accused legally admits the matter.

Since Obama has only filed motions to dismiss and has not actually answered the charges in the lawsuit, Berg claims, according to Rule 36, Obama has legally admitted he is not a natural-born citizen.

Now Berg is asking the court for a formal declaration of Obama’s admission and asking the Democratic National Committee for another presidential candidate.

In a statement released today, Berg argues that he filed Requests for Admissions on Sept. 15, meaning Obama had until Oct. 15 to answer or face the consequences of Rule 36.

“Obama and the DNC ‘admitted,’ by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit,” Berg’s statement reads. “Obama is ‘not qualified’ to be president and therefore Obama must immediately withdraw his candidacy for president and the DNC shall substitute a qualified candidate.”

Savage had Berg on his show last night and one thing he did say struck a chord. He said BHO travelled to Pakistan on his Indonesian passport in 1981. At the time American citizens were forbidden to travel to Pakistan. So in 1981 he travelled out of country as an Indonesian citizen. Interesting. He needs to produce his BC.

I read the Motion and attachments last night; here’s my take.

Berg filed suit against Obama. Obama refused to answer, instead filing a Rule 12 Motion seeking to dismiss the suit. The filing of that Motion meant that Obama did not have to file an Answer until after his Motion to Dismiss is ruled on.

Additionally, Obama filed a Motion for Protective Order, seeking to move the Court to enter an Order preventing Mr. Berg from being about to conduct discovery, such as requesting documents and the like. The Court has NOT ruled on that Motion, nor has it ruled on Obama’s Motion to Dismiss.

Berg sent Obama a document called “Request for Admissions.” Essentially, this is a request that Obama admit or deny certain statements, such as: “Admit that you were born in Kenya.” Under the Federal Rules of Civil Procedure (“FRCP”), Obama, upon being served the Request through his attorney of record, had 30 days to respond. Obama’s attorneys, relying on their Motion for Protective Order, have refused to engage in discovery at all, and therefore refused to respond to the Request for Admissions.

Under the FRCP, if a party doesn’t answer Request for Admissions within 30 days, then the requests are deemed admitted against the party. In this case, the FRCP holds that Obama has “admitted” that he was born in Kenya, among other things.

That is the basis for Berg’s Motion for Summary Judgment.

If this was a car-wreck suit, Obama would be screwed and would lose.

How then can Obama still win the suit? Or, rather, how is it that Berg can still lose with all those admissions? Two ways:

  1. The Court could still find that Berg lacks standing by granting Obama’s Motion to Dismiss, thereby making the “admissions” moot; or

  2. Obama could respond to the Motion for Summary Judgment by requesting leave of Court to undeem the admissions. I can’t fathom a Court not granting such a request in a case like this, with this sort of political magnitude.

In a nutshell: the Motion has merit, but only George Tenet would call it a slam dunk.

Foolish though, in my opinion, for Obama not to simply deny the Request for Admissions.

This is a useless diversion. Some Hillary supporters thought they could derail Obama with this like six months ago. They havent done it yet and its not going to happen one week before the election. It makes Republicans look desperate. Our country would meltdown into relvolutionary violence if someone tried to yank Obama off the ticket. Best case scenario is that we get Biden as president, whoopeeee.

Lets just focus on winning.

Look, Berg may be an attorney but he’s kinda out there, in the same sense that Jupiter’s four moons are “kinda out there”.

You do realize that this is the same brilliant legal mind that filed a RICO lawsuit against Bush and others for the events of 9/11 and issued a call for world leaders to arrest and try Bush and Cheney for the global crimes of 9/11/01.

Listen to what Berg said in his “evidence” against Bush & Company about 9/11:

Now, it is time for world leaders to take the lesson learned from Iraq and issue a warrant for the arrest of George W. Bush and Richard Cheney; arrest them; take them to a neutral country; try them for the murder of over 2,800 people from more than 80 countries on 9/11/01 and, when found guilty, sentence them appropriately. Jurisdiction would be proper in any of the more than 80 countries whose citizens were murdered on 9/11.

Yeah, just arrest them!

Berg’s a nutbar Bush-hater from way back; in 2001 he asked Supreme Court Justices Thomas, Scalia and O’Connor to voluntarily disbar themselves for their decision in Bush v. Gore. He also sued President Bush in 2004 under a RICO lawsuit on behalf of Willie Rodriguez.

And it is good judgment shown by the repubs for refusing to even omment on this issue. But It is a Democrat running with it. The repubs don’t own this dog in the fight. If it was the repubs, I would agree 100% that they are wasting their time. BHO has provided plenty of ammunition from his own talking points to make the case as to why he shouldn’t be President. What I find appalling and roubling is the complete picture of BHO. This isn’t an isolated instance of a questionable circumstance or judgment. It is a pattern with him. It is his past. It is his present. When added together all the whispers, poor judgments, and shady associations that he has been party to, paint a picture of someone who is either the unluckiest guy the world has ever seen or is exactly what the picture displays- Someone unfit to be President of the U.S.

In my opinion, this is PUMA fodder, and I am perfectly happy to leave them to it. Whether results ultimately make them dopes or heroes, I’d like to see Obama/Biden soundly beaten at the polls rather than disqualified on a technicality. Don’t get me wrong—I would welcome a DQ on a technicality.

BTW, rope-a-dope is putting yourself in jeopardy to exhaust your opponent or to force an overcommitment.

Moe, I think you know I respect you and I respect your judgement. You strike me as a fair guy, I think you know I’m a middle of the roader in my philosophy and I know you are a true conservative. You know I’m not a shill or a troll because I’m up front and I try to be respectful and courteous in my posts.

It’s diaries like this that leave me scratching my head in wonder. Why grasp at straws like “the whitey tapes” and the birth certificate nonsens? Why not take the twenty seconds required and google the guy and see if he’s for real, or if he’s a nutcase.

I think the answer to your question is likely that the Obama campaign doesn’t want to set a precedent of accommodating the requests of crackpots. This request may be small, but its very easy to give in here but when the next more onerous (and even nuttier) request comes in you’ve replied to this request, so why won’t you reply to this one. What have you got to hide? I think you see where this leads.

Legal Questions - Birth Certificate

Ok, but isn’t the birth certificate really not an issue? He was born here, ok, but if his mother had to revoke his citizenship in order to stay in Indonesia or be adopted by Soetoro or even go to school there and he traveled on an Indonesian passport in 1981, isn’t the question whether he actually has an American passport. Also, if he came back here and his mother filed the necessary papers for him to “reclaim” his citizenship, wouldn’t he only be eligible for naturalized citizenship status thereby making it illegal for him to run for President? I’ll bet you the papers were never filed and he is using the Hawaiian birth certificate as his documentation, leaving out the Indonesian thing altogether.
