The content of the healthcare bill, by the above definition, fails that test. As Ace pointed out , this healthcare bill is unlike SS and Medicare because it majorly screws the 80-odd % people with insurance to cover the other 20% (not to defend Medicare and SS, as they have their own issues).

He thought that since the Constitution constituted a limited government with enumerated powers, or a list of the only things the Federal govt can do, a Bill of Rights that added things it couldn’t do would only confuse the intended meaning and leave a sort of shade of gray about what it can or can’t do. Of course political realities meant they had to add the Bill of Rights, and so Madison included both the 9th and10th amendments to in an attemt to avoid that confusion. That is probably why in the first paragraph of the Jefferson quote I posted he states that he considers the foundation of the Constitution to be the 10th Amendment.

The closest thing I could find, if one wanted to stretch its meaning, is Commerce Clause. But I’ve never understood how could Congress force a person doing nothing to purchase a good, then turning around and using that basis as grounds for regulating the private sector. On its surface, it seems to be a logical fallacy.
Please correct me if I am wrong, was commerce ever understood as a voluntary act in a legal sense? To engage in commerce implies one has a choice in what sort of commercial activity he desires to participate in. If one refuses or is not required to participate in a certain commercial activity, then how can that be federally mandated as to make that person engage in an involuntary act?

As far as I know, and I don’t claim to be a Constitutional attorney, though I’m leaning more towards going into that, with the amount of falsehoods about the Constitution being thrown around, there has never been an individual mandate like this before. They had some female scholar of some type (and I classify it that way, because she was the first female I had seen talking on the Constitution, and might help people i’d who I’m referring to) talking with Chrissy Matthews on MSNBC. She was trying to make the case that the Supreme Court, for over a century, had allowed this type of legislation through the Commerce clause, and that decisions in the last couple of decades had ‘turned that on it’s ear’ I believe was what she said. My AG, and a friend from college, was on the same program,, and was VERY clear with Chrissy that this was the first time that an individual could be penalized for simply deciding NOT to purchase something. You could decide NOT to buy, and be criminally fined for not participating. That AG is Nebraska’s Jon Bruning.
I either think the Administration and the so-called leaders in Congress are underestimating the potential of this, or are running scared that this will have legs. The AGs are right, of course, and the Supreme Court will bring that out. And don’t forget… this is a Supreme Court with something to prove. You can tell that John Roberts and Sam Alito are pretty cranky about this. Not that they’d do it for spite, but it’ll feel even better to have the law on their side, AND be able to blindside Barry.

The estimates being given (and for a fast track case, it sounds about right) were 12-18 months for the Supreme Court. Now whether that was to hear it, to be granted certiorari (have the Supreme Court agree to hear it), or to get a decision, wasn’t really clear. I’m more toward leaning for them to hear arguments, but not necessarily have the decision. Now that being said, even the Supreme Court knows when a decision needs to be timely. Nothing showed that better than the decision in Bush v. Gore.
I’ll see if I can do a little digging. It would make sense for them to file for an injunction preventing the Federal government from implementing the law until a decision had been reached, but I’m not sure how likely a Court would be to grant that. But let me see what I can find.

After watching “The Tunnel” I can’t help wondering when we can expect State Security to clamp down on “illegal healthcare emigration.”

I love this idea and think it would be a great way for the doctor’s to begin to stick it to ObamaCare. If they outlaw it, the Docs will move and so will the other talent that likes their services.
Also, a GOP controlled House and Senate could make it legal. Since I believe we have a good chance at winning back the House and Senate by 2012, as well as the White House – IF McConnell and the leadership buck up and show some spine before turning off the voters – this could be a great solution.

However, I do see a benefit in doing both just from a manpower point of view. Then companies could get health insurance through international organizations setup in the Caribbean and their employees could make use of them for drastic care needs.

Much as the Berlin Wall was built to prevent people taking their toys and going home, conceivably the US could lean on Caribbean nations to keep Americans from getting healthcare without some sort of fine. But in international waters that card gets taken away to some degree.
In terms of cost, however, I wouldn’t be surprised if it’s cheaper and quicker for many to fly commercial to Costa Rica than to take a boat 12 miles off-shore.
