Divvying Us Up By Race – Native Hawaiian Style


Chief Justice John Roberts once famously quipped, “it’s a sordid business, this divvying us up by race.” He did so in the context of the Supreme Court case LULAC v. Perry, and the application of the Voting Rights Act to carve up Congressional districts in Texas based heavily on racial composition – in which phrases like “majority-minority districts,” and “candidates of choice” are the operative phrases.

Yesterday, the Democrat-led U.S. House of Representatives voted basically along party lines, 245 to 164, to divide Americans up by race even further, and design governments according to individual heritage.

Sound bizarre? It is, but it is indeed what is happening.

The House believes it is a priority for Americans to pass legislation that will create an unconstitutional, separate, race-based government for individuals who are descendants of native Hawaiians. Indeed, the bill defines the group that can qualify thusly: anyone who is “a direct lineal descendant of the aboriginal, native people who – resided in the islands that now comprise the State of Hawaii on or before January 1, 1893.”

There were, however, a few heroes in the debate. Steve King, from Iowa, pointed out the absurdity of looking backward over 100 years to balkanize our nation. He pointed out that the entire thrust of this bill is divisive and that we should be continuing to assimilate, not breaking us up by race. And others joined in the fight as well, such as Congressman Tom McClintock.

Most notably, an amendment was offered by Congressman Hastings that would have simply required that this bill pass through a referendum of the people of Hawaii and it was rejected, again, essentially along the same party lines. Yet, according to Zogby, while only 34% of Hawaiians support the federal bill, 58% of Hawaiians would like a referendum. And more, the Governor of Hawaii, Linda Lingle, has issued a statement in opposition to the bill.

This is not the first time this issue has been raised. I had the privilege of working with a merry band of brothers in a then Republican-led Senate back in 2006 to kill the Senate version of this bill promoted by Senator Akaka. The problems with the bill today are virtually identical as then.

For example, the United States Commission on Civil Rights (USCCR) is opposed to the legislation. In August of 2009, it wrote a letter to Congressional leaders voicing that opposition, and in it, cited to its statement from 2006, in which the Commission wrote:

“The Commission recommends against passage of the Native Hawaiian Government Reorganization Act … or any other legislation that would discriminate on the basis of race or national origin and further subdivide the American People into discrete subgroups accorded varying degrees of privilege.”

And, as Americans, this must be the analysis, no? Can it be any other way? Our nation’s greatness is measured in large part by its commitment to equality – that is, equality under the law, not guaranteed outcome. It is that we strive to see ourselves equally through the eyes of government – and because of that, we are left to rise and fall on our own merit. We have come a long way from a nation that while declaring all men to be created equal, embraced slavery. It has not been an easy road, but surely that road cannot included, in 2010 America, a federal law that would actually reach back to 1893 to carve out a group of people based on their race – their blood – to constitute them separately, and arguably unconstitutionally as a separate people?

As the USCCR noted in its 2009 letter:

In closing we would like to point out that in 1840, the Kingdom of Hawaii adopted a Constitution with a bicameral, multi-racial legislature. The Constitution was signed by two hands—that of Kamehameha’s son King Kamehameha III and that of the holder of the second-highest office in the nation, Keoni Ana, the son of the British-born Hawaiian Minister John Young. Its opening sentence, the substance of which was suggested by an American missionary, was based loosely on a Biblical verse: “Ua hana mai ke Akua i na lahuikanaka a pau i ke koko hookahi, e noho like lakou ma ka honua nei me ke kuikahi, a me ka pomaikai.” Translated, the passage might read: “God has made of one blood all races of people to dwell upon this Earth in unity and blessedness.”

The whole idea of creating a Hawaiian "tribe"

just seems so strange. Especially considering that such a thing has never existed in the past. According to the WSJ, they’re actually going to have public lands set aside as “reservations” for native Hawaiians, I suppose so they can build casinos on them and not pay taxes. I wish my own Fugawi tribe could get this sweet deal.

unless they gave them a bigger island than Niihau(the smallest of the 8 largest islands in the chain). They don’t have airports, so tourism is really hard. State policy when I live there(1985-1988) was that the natives had this island and no non-hawai’ians can set foot on it. These people are Wards of state.

Ni'ihau is a privately owned island

I recently lived on Kaua’i,2004–2009 and had the pleasure of knowing a few of the residents of Ni’ihau.This island,just off of the north coast of Kaua’i is privately owned by the Gaye and Robinson families of the now defunct Gaye Robinson sugar company,they also have major land holdings on the west shore of Kaua’i where it is mostly planted in coffee and experimental corn fields from Kalaheo to Polihale.The Island of Ni’ihau is populated only by native Hawaiians and the descendants of the original Gaye Robinson settlers.You can go ashore on Ni’ihau by invitation only.The people on this Island are not plagued by the problems that are present on the rest of the Islands,drugs,crime etc.and live a truly rural lifestyle.By default they are already self governing and separate from the rest of the Islanders.

As reprehensible as it sounds when described as it is in this diary, what the Hawiians want, some of them anyway, is to undo their assimilation and establish themselves like the “treaty tribes” in the Continental US and Alaska.

Those of you in the East have little dealings with Indians qua Indians except for seeing a few Cherokee dressed like Souix at Smokey Mts. NP or going to an Indian casino – on “Indian Land” in places where there hasn’t been an Indian in 200 years. In the West, the Indian reservations are considered dependent sovereigns and in large measure self-govern and enforce their own laws using tribal police. There are constant struggles between tribal governments and state and local governments, sometimes even with the federal government. And if you think the Inner Cities are cesspools of corruption and dependency, you ought to try an Indian Reservation.

If the Hawiians get the same sort of tribal rights the Indians in the rest of the Country have, the next thing will be identifying all “native” Hawiians and having the “tribe” or some other agency, the BIA does it for Indians, issue a Certificate of Degree of Hawiian Birth. That will be the ticket to the lottery that will come when the “tribe(s)” sue for compensation for the harms done them by the US and the State of Hawii and then make their land claims.

I was talking to the tour bus driver when I visited Pearl Harbor a few years ago; she looked and acted more like an Anglo than I do – the Hawiians call us Honky Dogs Howlis – but was ranting on about how she had rediscovered her Native heritage and how great Hawaii was going to be when the “natives” get their land back. She had the whole rap of the “indian sovereignty” types down! And it is a heady mix of racism and left wing politics.

Here in Alaska we had gone far out of our way to at least legally treat Alaska’s native Indians, Eskimos, and Aleuts the same as everyone else. The Territory of Alaska passed a comprehensive civil rights law in 1945. There were no treaty tribes in Alaska but a New Deal program called the Indian Reorganization Act had set up – and funded – some IRA “Tribal Governments” though most had languished once the ink was dry and there was no money – until oil. Then the land claims came. People who other than those in Southeast Alaska had always been nomadic or seasonally nomadic anyway suddenly discovered that they had deep ties of heritage and culture to the land – especially the land that might have oil under it. People who had for generations been white or Asian, mostly Filipino or Chinese, suddenly discovered that at least one of their grandparents was a full-blood Indian, Eskimo, or Aleut; that’s what it takes to be a “real” Alaska Native and get your Certificate of Degree of Indian Birth. Nobody much checked and we found suddenly that we had a lot more Alaska Natives than we thought we did.

We tried to avoid the Bureau of Indian Affairs cesspool of reservations and Indian Agencies with the Native Corporations established with the Alaska Native Claims Settlement Act in 1972. It took a billion dollars, back when that was real money, and 103 million acres of land to “satisfy” the Native lands claims and clear the right of way for the TransAlaska Pipeline. Most Alaskans thought that settled it, but the BIA simply would not go away and became the benefactor of the tribal sovereignty advocates here. The Corporations established non-profit alter egos that contract with the State and federal governments to keep the cargo cult benefits coming in.

The BIA and BIA supported tribal governments live in a world of Indian preference hiring and contracting in which no Honkies need apply. Since the tribal governments don’t have a land base, they cannot exercise the sovereignty over territory that, say, the Souix or Navaho can, but we’ve had lots of trouble enforcing State law in the more radicalized villages.

Anyway, you’d think that the Hawaiians would look at the mess that the BIA has made elsewhere and also note that the Alaskan version is only somewhat more successful and want no part of it but I think the siren song of reparations and land claims beckons them. Since the Japanese own a LOT of Hawaii, you’d think they might be interested in this. Far as I’m concerned they can give the State of Hawaii back to the Native Hawiaiians and we can become a nation of 49 states; Pearl Harbor isn’t that important anymore.

Sovereignty and whatnot. Even with the Tribes here in Texas, the ones that aren’t recognized by the Feds want to be. It strange, why would anyone want to be a ward of Federal Government? In Hawai’i they don’t have oil or any good money makers for the Tribe, so I’m sure that they will be Wards of the Feds in everyway. Even the Kickapoo want everything the Feds have for the Natives but it seems that the Kickapoo government is corrupt(funny, that seems to be common with the tribes here in the US). Art you and Sam Houston would agree on the problem.

Indian preference hiring (with little or no regard for qualifications). I worked for BIA for almost three years. They suspended their Indian preference rules so they could hire me and another Honky Dog to go find $58 Million in grant and contract funds that they’d “misplaced.”

You haven’t lived until you’ve found yourself trudging towards the Tribal Council office in the Sovereign Nation of Akiachak, 300 miles west of Anchorage, watching the plane fly away and preparing to walk in and say, “Hi, I’m from the US Government and we were kinda wondering what you did with the money.”

You should have seen the Indians come unglued when they discovered a Clovis point buried with Kennewick Man here in Washington. The bone scientists placed him as either Polynesian or Inui Japanese.
These issues gets real confusing when you read that the Eskimo’s came across the ice during a extended cold period during the 4th century, to slaughter the Irish who had settled in Iceland. ‘Cept the Emerald isle was called Scotia at this time, so they would more properly be called Scottish ‘Cept there was no nation called Scotland, just a bunch of Kings of Eyre who couldn’t get along for any extended period.
The entire British Isles were one long story of peoples raiding, then invading, then a settlement worked out to give land to the invaders to get them to stop stealing their stuff. In the end, it just came down to overpopulation in one place, and a band of people looking for a little square of land to settle in and farm. Not very different from our story here, except we usually paid for the hunting ground, and deeded back a hunting and fishing right to the natives, which is all they wanted anyway.
I don’t have a problem with Indians having a large piece of land, and trying to maintain their culture. I do have issues when they call themselves a Sovereign Nation, then turn around and stick their hand out to the Federal government. You can’t be independant and dependant at the same time. If they wan’t to control their own destiny, stop setting up Whitey as an impediment to achieving their goals.
An excellent example of a tribe being independant is the Colville’s. Very successful Capitalists, pro-American, and take care of their community well. Lot’s of healthy smiling children.

In the mid 1900′s on the pristine sands of Ala Moana my relations gathered for barbecues. Not native Hawaiians, they were immigrants settling on the territorial islands before it became another star on the U.S. flag. Still my elders became proud working Americans.
Nowadays the beach is home to an exploding homeless class the state of Hawaii tries but fails to hide. Hawaii’s beaches and parks are peppered with homeless squatters. There is no more room in thestate run shelters or housing. According to 2009 Honolulu statistics, Hawaiians make up the largest ethnicity of the homeless population.Now left-leaning federal legislators want to parcel this decimated paradise to its ancestral tribe.
Perhaps we should yield to the historic natives more than what they demand: sovereignty of the islands, total. Say a bittersweet “Aloha” as we lower the Stars and Stripes to embroider blue over one white star.

I’m no legal eagle, but it seems to me that one descendant of a former missionary could wreck the whole thing.

All one would have to do is show that the islands themselves were not originaly inhabited at all, much like a large percentage of all of the worlds islands. (otherwise the left would have to use the “God put them there at the begining” argument, which is not one that the left ever seems to use)

Then use the fact that all inhabitants are in fact immigrants to ensure that either all descendants of those born on the islands are included or no one can be included, as there are no true native peoples.

So all of the respective descendants of missionaries who had children while on the islands will be elligible no matter what their ancestry.

Before you all begin to tear this up with technical trivialities and deride it’s simplistic nature, think about it. This argument is desgned to obstruct, not repair. It would cause no end of head ache to those that would like to see a smooth transition of their “kill whitey” philosophy.

Without being more informed, I would tend to agree. I suspect that the folks on the Island would not however. They would be deeply impoverished without the security backing of the U.S. Otherwise, tourism would tank, and demand prices would match tourist rates in the crime ridden Caribbean. That is no way to run an island-nation.

Other than that – this vote appalls me. It is divisive and inflammatory. It is also probably unconstitutional. I know we have at least one wise latina on the Supreme Court, and I am sure she will she this bill for this non-sense that it is and vote to overturn it when it is challenged in court.

Racism is a Darwinian belief that there is a genetic superiority based on race. The racist we need to oppose are in the government at all levels. Those, by the power of the government, their position and power, reward or punish citizens based on race. This is the kind of legislation we should be concerned about in practice. Racism existed LOOOOOONG before Charles Darwin was born. I’m pretty sure it came into existence the moment one group of humans saw another group that didn’t look the same.

Darwinian Evolutionary Theory can be used to explain the differences in groups of the same species that live in different regions though.

Superiority can only be determined after one group is extinct. Using this we can extrapolate that each racial category is superior to all others in its place of origin.

I could give numerous examples as to why “blacks” are superior to “whites” in equatorial savannah regions.

In promoting the in perpetual support of the Democrat party. Dividing a group out makes them feel isolated and vulnerable, most likely to blame others for their lacks. The Progressives then get them as another loyal voting block with nothing more than “words”, no substance.

This raises again an issue that got completely buried in campaign rhetoric and Obama’s need to hide just about anything and everything about his background.

OK how does Hawaii and this bill fit? First, realize that $Billions in land is involved and China and the “natives” are entangled to benefit.

China’s involvement goes back to the Clinton campaign and a scandal involving Chinese funds getting into the campaign and Chicago/Daley was part of this. Some of the same people from then has shown up as part of this Hawaiian native based land grab.

Some of these same people were players in the Obama presidential campaign. The question was raised to the effect the Hawaii government’s refusal to expose Obama’s real birth certificate was a quid quo pro for his backing of this legislation when he became president.

This president has more nefarious debts with some really “dark side” characters could produce in years.

Just something to think about. Obama really stinks when you get too close.
