Reading the Healthcare Bill…


After hearing of Ben Nelson’s gutless selling of his soul to the Devil (see Perrin’s post below and numerous news accounts)… I decided I should tune in C-Span 2 to watch the destruction of the Republic as we know it first hand. As I sit and watch the clerk reading the Reid amendment to the healthcare bill on the floor of the United States Senate – I thought I would share some of the tidbits, besides the obvious use of the word “shall” over and over and over again…

The clerk can barely read the bill it is so complicated. After reading through a bunch of highly technical language about asbestos-related diseases, he read the definition what a “frontier county” means. And he then said that the clause shall not apply where a state received a “non-labor-related share adjustment under paragraph 5h.” A few sentences later, he said:

the area wage adjustment factor applicable under the payment system established under this subsection to any hospital outpatient department which is located in a frontier state as defined in section 1886d3e32 may not be less than 1.00. The preceding sentence shall not be applied in a budget neutral manner. B. Limitation. This paragraph shall not apply to any hospital outpatient department located in a state that receives a non-labor-related share adjustment under section 1886d5h.

Now, in a new section (and with a new clerk – it get tiring reading this stuff, you know), we get to the juicy stuff where the “Secretary” (read: HHS bureaucrats, regardless of whether the Secretary is Republican or Democrat) gets to define things:

Section 10329: Developing Methodology to Assess Health Plan Value

A: Development. The Secretary of Health and Human Services, referred to in this section as “the Secretary,” in consultation with relevant stakeholders, including health insurers, healthcare consumers, employers, healthcare providers and other entities determined appropriate by the Secretary shall develop a methodology to measure health plan value. Such methodologies shall take into consideration, where applicable, 1. the overall cost enrollees under the plan, 2. the quality of the care provided for under the plan, 3. the efficiency of the plan in providing care, 4. the relative risk of the plan’s enrollees as compared to other plans, 5. the actuarial value or other comparative measure of the benefits covered under the plan, and 6. other factors determined relevant by the Secretary.

of the civil society, and its underpinnings which protected our liberty. Thanks for posting, because I took an oath after the House debate, I would watch no further deliberations of our congress until such time as they are controlled by representatives who are governed by our constitution. It is just too painful to watch it unravelling to the thunderous applause of evil demons.

Just venting, but I have had just about all I can stand of this. It’s over, all over, our kids better get busy and secure some kind of future for their children. I am just about all fought out…..

For as much as I want to, I cannot tolerate the watching of CSPAN this morning.
For, as you note, personally observing the death of the Republic is, quite simply put, more then my mind can stand.
On a separate-but related note….
This language, with only every tenth word or so being one that a normal citizen can understand, is a lot of what is so very wrong with this country.
The “laws” are so wordy, so convoluted and mind numbingly complicated, that it is entirely possible to be in violation of them by reading them aloud!!
OK, not really, I think, but the deliberate act of making these things so that none but the very few have any hope of understanding them, well it’s grossly unfair, at the least.
And then for all the words, all the seeming coverage of just about any eventuality that one could think of, a “typo” means a hundred thousand dollars in an earmark goes ‘astray’. Given to someplace that doesn’t even have whatever the earmark was supposed to ‘improve’.
And here we have a Bill that, with Amendments, is what, three thousand pages? And serves in many parts as only an outline, that the “Secretary” is to flesh out and issue Regulations on?
I have long believed that if a random group of eighth grade graduates can’t read and understand a Law, then it shouldn’t be a Law.
There is something sinister and inherently evil in being ruled by Laws that we cannot begin to understand.
Much less obey.

I interpret those passages to mean that
STABelious…. (IE Obama/Jarrett/SOROS) have FULL dictatorship control over ….everything…..without boundaries….. over this Obamination.

AND

All UNION (SEIU/ACORN) hospitals will receive no “free market tax penalties” while all free market tax and penalties will be exponentially expanded until communism is fully in place.

I probably don’t understand it though.

what is wrong with 59 Senators allowing Nelson to require that all the other states pay his state’s medical bills? Thry are all betraying their constituents with this socialist takeover bill that no one has read. Maybe some of the women senators will take up the mantel and vote against this bill. I actually believe the one from Arkansas could do this.

I noticed the same as you when I turned on cspan for about 30 seconds while the disaster was read, the clerk could hardly read it. Most of the language is ambiguous references to other paragraphs, sections, bills, law. Specifically written to glaze your eyes over like it did me. Shock and awe is sure in effect. The only “surge” Obama knows is the surge of horrible bills for America to frustrate the opposition, American Citizens.
