Gibbs admits “the list”; Burton admits “why purge?” [updated]

In my eight years as a converted conservative Republican, op-ed newspaper columnist and blogger, I have been continually frustrated with my political allies’ seeming blindness to or reluctance to acknowledge the fact of, obvious admissions by our liberal Democrat opponents on matters that we deem crucially important to our case against them.

During the recent Presidential campaign I was frequently beside myself as I witnessed, especially Republican elected officials, but also some TV and Radio talk show hosts and even fellow bloggers that would play audio and video of Barack Obama and Jeremiah Wright that left no ambiguity as to their venality or stands on issues, and yet end the conversation by saying that said conclusive proof merely “raised more questions”.

I was reminded of this more recently by some timid Republican senators concerning Sotomayor’s public statements. It is as if all they want to accomplish is for Obama or Sotomayor to tell them a clever lie that somehow erases the obvious previous statements from their minds.

Now comes the exchange between Megan Kelly of Fox News in which White House spokesman Bill Burton initially refuses to answer Kelly’s question as to whether the White House is purging emails they solicited via a website that identify opponents of ObamaDems health care reform plan. Finally, Burton states: “Why would we purge them?”

This is known in the law as an admission! Yet, most stories claim that the White House has not answered the question and that Burton’s responses merely raise more questions. No it does not. We now know that they don’t purge the emails.

Can we please stop being the stupid party?

During a lengthy exchange with a reporter in the White House Briefing Room in response to a recounting of communications received by said reporter from citizens claiming to have received unsolicited emails touting health care reform legislation from The White House, Obama’s Press Secretary Robert Gibbs stated the following:

MR. GIBBS: I’d be interested to see who you got that e-mail from and whether or not they’re on the list. I don’t –

This admission of the existence of “the list” was not adequately followed up on, as can be seen from the full transcript.

This is what trial lawyers call admissions against interest.

These are the types of statements that get blown up on posters for displays to the jury during closing argument. These are the types of statements that are followed up on with the witness on cross-examination while the cross-examiner looks the jurors in the eye with raised eyebrows.

In short, these are the types of statements that win cases.

What kind of menacing force do we have occupying the position of the Nation’s Chief Magistrate and Law Enforcement officer? This appears to be at least as ominous as Nixon’s enemies list and Clinton’s FBI and IRS files.

Nixon covered up a break in of his political opponent in the 1972 presidential election. Bill Clinton kept his greatest offenses justifying impeachment kept locked up in the Senate cloakroom.

A White House criminal acting against other politicians is bad enough. But what about mobster-like intimidation from the most powerful man on Earth against lesser beings at banks, hospitals, etc…

President Obama has already told the CEO’s of Banks to shut up since only he stands between them and the “pitchforks.” He fired GM’s CEO. He demonizes insurance companies while he suggests that non-terminal 100-year olds be denied pacemakers and suggests pediatricians get kickbacks from surgeons performing unneeded tonsillectomies and that surgeons amputate limbs from diabetics to get government reimbursements.

Yet, he dropped voter intimidation charges against New Black Panthers on video obviously breaking the law. Their names weren’t on the list? They must favor health care reform and so, are eligible for a Piece of da’ Boss’ Action.

A serious question: Does a Howard “what did the president know and when did he know it” Baker exist among today’s elected Democrats in Washington that answer to Harry Reid or Nancy Pelosi?

And if not, then how do We the People get “the list”?

I’m not a lawyer like you, but this seems huge to me. A bunch of clown bloggers in Alaska have made Sarah Palin’s life hell by using the FOIA (or AK equivalents). Why can’t any one of us make a request and then publicize the hell out of it?

We’ve got a number of attorneys here including yourself, and connections with Rush, Hannity et al to get it out in the open.

Am I missing something (other than the fact that there are certainly ZERO Dems who would play Howard Baker today)???

it’ll give you a warm feeling and nobody will notice. You can stonewall a FOIA request forever and only if the media or Congress gets interested will anybody know or care. Since we know that the media and Congress will support Comrade Obama, a FOIA will go nowhere and get nothing except mumbles from Cde. Obama and his minions.

If Palin hadn’t made herself the paragon of “openess and transparency” and invited the People to look into what she’d done and had just let the bureaucracy stonewall the requests, she wouldn’t have had most of her troubles. Alaska’s Public Records Act is far friendlier to the public than the federal FOIA, and even under Alaska law it is easy to stonewall – if you know how and can keep your mouth shut.

Clearly there is enough smoke to justify an investigation of the fishy email website. But I am asking those more informed than I about the propriety of even a seemingly more innocuous list of allies for use like a political action committee from the white house.

It only takes one CongressCritter to have the courage to start raising heck from the floor of Congress on this issue to get the battle lines drawn.

If the anger sweeping this country is not proving anything, it’s that people are worried about what the Federal Government is up to, and a clarion call from the floor of the House for an investigation into the “Fishy” program would resonate with the American people. Somehow I think it will.

The trick will be to not overplay the hand. The facts of the “Fishy” program are out there, the question is “Is it legal, is the Obama White House breaking the law”? An investigation by Congress is in order, and calling for that investigation into the “Fishy” program is called for, nothing more, nothing less. Heck I might even write my CongressCritter who is a R and ask him why he’s not calling for an investigation.

I think everyone should write their CongressCritter and ask for a Congressional investigation of the “Fishy” program.

A simple request for a simple investigation of the legality of the “Fishy” program under the Presidential Records act. There’s another statute enacted back during the Nixon term about collecting information on protesters, but I can’t find it right now. The two statutes are in play with the “Fishy” program.

Under some state laws, attempting to influence the passage of legislation comes under campaign disclosure and limits laws, but I don’t think it is restricted at the federal level. A court would have to decide if what Comrade Obama is doing constitutes partisan political activity using government resouces, something which is prohibited.

Gov. Palin faced similar charges for speaking out against a ballot initiative, though she was careful to say it was spoken as a personal opinion, not in her capacity as governor. The P-Board found that she didn’t violate the Ethics Act but no court has reviewed it.

It will take some time for the Obama White House to get a spanking in court even if you could get someone who has standing.

As a matter of political capital, this as an issue is something that Republican CongressCritters need to jump all over. The real court here is not in Black Robes, nope the real judge of Hope and Change and breaking the law to achieve moving this country and the health care system to a socialist model gets decided during the mid term elections and in the Presidential elections of 2012.

US Privacy Act

I dd some quick research and think the “Fishy” program is trouble because of the prohibitions of the US Privicy act of 1974 and the Presidential records act.

If personal information is being collected by sending information to the Obama White House under the “Fishy” program, it must be preserved as a communication with the President, but if that communication contains information that falls under the Privacy act, it must not be retained or given to other agencies without the senders permission.

Sounds like a very good conflict for Congress to get into the middle of and help sort out.

Having served for 30 years in our Military and enjoying every minute of it (except for Carter’s sellout), I hate to admit that I am truly afraid of our government for the first time in my life. I spent over 20 years on the German/East German/Czech border, My Wife’s parents were originally Czech and I have spent hours discussing their experiences with Socialism during and after WW2. My wife’s Grandfather was re-educated by the brown shirts because he didn’t go along with their plans. Her father spoke about it till the day he died. Anyway, me and my wife both feel strongly that the present rulers of this great country are taking us swiftly there. With my background I know that I am on their lists. Ask yourself if you are and be afraid!

I suspect that the reason so much damning evidence against Bill Clinton was kept secret by senate republicans and why so many pols in DC never outed Clinton was due to leverage he obtained thru access to FBI/IRS files.

It is vital that we elect only presidents with character.

Fear has been the order of the day since eve bit the apple and will be until Jesus returns, but there is less fear in the US due to our Constitution and judeo-christian values so long as we keep them.

The problem with answering your questions more fully is that the possibilities are infinite and enemies can be harmed without ever knowing they were a victim and we are all harmed by what actions are not taken by the timid due to fear.

Somewhere, I remember reading (having to do with military battles), it is “okay to be afraid before going into battle, in fact foolish not to” because that fear can sharpen your instincts and fighting skills…

We can just make sure our fear does not make us timid. Our Founding Fathers must have had fear, but it did not deter them from the battle or the war. We can have healthy concern, even fear, but we can also have courage. The left for too long, has used fear as a way to make us cower and suppress our voices.

Fear can be a good thing. Courage is the effective response.

We did not have even one so-called conservative senator with the courage to take a stand and prevent the $2 B expansion of the unconstitutional “Cash for Clunkers” program. Any one of them could have stopped the vote on the bill before the recess. A bunch of them were quoted in a newspaper article (sorry, I don’t have the link handy) about how bad the bill was, and how they thought it should not pass, yet not one of these so-called “leaders” stood up to take stand to fight for the American people. In a few sentences they could have explained on Senate floor to the American people the virtues of stopping this idiotic program, but, no, they slinked away to the recess. And another $2 B went down a rat hole, added to the national debt that our children and grandchildren will be saddled with. Why? Because they had nothing to fear. With a relatively weak number of conservatives in the Party ranks nationwide, why would they be fearful of any kind consequence for their lack of courage?

Pathetic. But understandable under the circumstances.

Now many here are suggesting we should all “pressure” our congressmen and senators and urge them to be courageous and call for a full investigation of “Axelrod e-mail-gate.”

Let’s see, the Constitution and their oaths did not motivate our so-called conservative senators to fight for the American people on Cash for Clunkers. Or Sotomayor’s nomination. And on, and on, and on.

Will a bunch of letters and faxes motivate them to investigate “Axelrod e-mail-gate?” Maybe. I send faxes, and make telephone calls, to these “leaders” all the time and urge others to do so, too, because I cling to my perhaps naïve notion that maybe, just maybe, a faxed letter or phone call might help motivate them to do the right thing, especially when many others are doing the same thing on a particular issue. (I also put these hard questions to them face-to-face whenever I get the chance.) Such fax and phone campaigns stopped the Harriet Miers nomination and the backroom “Shamnesty for Illegals” bill. Maybe we can motivate these “leaders” to actually lead for a change through a similar deluge of faxes and phone calls.

I watched a great video out of Texas today. Good people who were protesting socialized medicine. The videographer interviewed about fifty of the folks. Over and over I heard “this is the first time I’ve gotten involved in the political process.” Ahem. I am so glad they are at least participating in a protest and holding a sign, but they aren’t really “involved in the political process.” At least not in that part of it that determines the direction and leadership of a political party. That only really happens one way.

Okay, if you’ve read this far, you probably know where I’m going. If you don’t want to hear it, stop reading. If you are already a precinct committeeman, you don’t have to read any farther. You get it.

I submit that the single best way we could make these spineless “leaders” gain some courage is through fear. Faxes and phone calls don’t cause fear. I know one thing that would cause fear. And that would be a tidal wave of applications NOW by conservatives in every local GOP headquarters asking to be appointed a precinct committeeman and asking how one goes about becoming an elected precinct committeeman so they can vote in the next round of leadership elections and next round of Party endorsements for primary candidates in the 2010 election cycle.

If conservatives do THAT, we will get the attention of the status quo-ers. Because then their buddies in the Party leadership hierarchy could all be new faces after 2010. And maybe those new faces wouldn’t be so friendly. Maybe they’d be real conservatives. And maybe the “boots on the ground” precinct committeeman in their legislative district will have changed drastically, demanding more conservatism from the primary candidates.

Nationwide, about 50 per cent of the PC slots are empty. Fifty per cent! The Party is there for a conservative takeover. If we take it.

Will you help take it? I pray that you will.

The people the right is hiring to show up are provided a script which tells them to say that this is the first time they’ve gotten involved in politics. How else could you explain that “coincidence” huh?

Finally, the people see the policies and are no longer charmed by this charlatan. I would be surprised at the amount of overreach here, but it was foreshadowed in his campaign rhetoric. I’m only glad it is coming out when there is still time for the voters to take appropriate action against this usurpation of our liberty.

Whether “the list” is a friends list or not is not as interesting as the existence of such a list, and that Gibbs inadvertently confessed to its existence.

Just had a thought. Would be ironic if the surely existent friends list got somehow merged with the perhaps existent enemies list. Voila. The mob has one more cause for protest, as if we needed any more.

As for the friends list, I vehemently protest against the whitehouse resources being used for community organizing against the peoples’ will. But we already knew this administration has no shame.

From what I see, I would rule that this is illegal partisan activity. Since Dems have supermajorities in both houses right now, they can pass any bill they want. They just don’t want to pay the political price in 2010 — thus the attacks on American voters. For Obama, the voters are the problem, not the currently toothless minority party, because voters have the right to vote.

This is how Republicans are blocking his bill — by placing their names on ballots in an unAmerican conspiracy to take away his majority.

via the link to freerepublic you provided in your update, where burton whines the white house is getting “entangled” in questions about how the white house is gathering information about dissent on the health care bill. It is priceless.

My comment to burton whining about the white house’s “Entanglement” is,

“Oh what a Tangled web [you] weave

when first [you] practice to deceive.”

Certainly, burton is cognizant of the fact that the white house, by law, can not purge or delete the email information. What burton and the white house do not want to talk about is the fact that the information is kept, and in the future may be released to the public.

BTW GC, Megyn spells her name this way. She once told the story of why her mother gave this spelling to her name. I think she is an excellent journalist. She does not let them get off the hook and she is especially good with holding Burton’s feet to the fire.

We may be frustrated with the current disposition of Mr. Obama and Democrats, but the movie hasn’t ended.

No man is an island unto himself and this group, currently drunk with the vestiges of power will soon learn our patience is not limitless- exercised promptly with each electoral cycle.

Democrats and Obama truly believe that voters will forget the disastrous path upon which they have led us by 2010 and 2012. Hoping against reality that our economy will somehow have meaningfully recovered and be on a meaningful growth path.

I suggest they get good lawyers and prepare for life outside politics- perhaps in prison pajamas
