Georgia: Blue Laws. Local control or central authority?


This is the question that some in the Georgia legislature are attempting to put to a vote.  In private, the bill, SB 10, received wide support and it’s passage was considered a swift and certain outcome.

The bill, officially known as SB 10, does not in and of itself make alcohol sales from liquor, convenience and grocery stores legal on Sunday.  It legalizes a process that would allow local governments to determine if they wanted to put before their citizens a vote to determine if local community standards supported expanded alcohol sales.  Supporters have positioned the bill as a vote for local control.  Opponents have fought the bill as an abomination.

As the vote neared though, some of Georgia’s elected representatives got cold feet.  The thought of being put on the record is a scary proposition for some, and this is turning out to be an issue where principle is not as important as image.

Most Senators privately claim that they are for this bill, but they also fear a backlash of social conservative voters, who are believed to be more “single issue” in nature when arriving at the polls.  And thus, Senators this year seemed to devise a plan that would put the burden of passing this legislation on the record crop of freshmen legislators.

Is this the most pressing matter in the nation? Far from it.  But if we can’t convince our politicians to act with backbone and principle on smaller issues, can we expect them to do so on the really tough votes?

This is a seemingly minor, but frequent high-drama issue at the state level. If you’re in Georgia (I’m looking at you Erick), and feel like getting this off the perpetual argument list, call your state senator and let the know that the people are quite capable of deciding this issue for themselves.

Decisions should be made at the lowest level, most local control possible… and this bill permits that.

The process as described is kind of convoluted, but that just means that the areas that will offer booze on Sunday will be the ones that have a will to change. Areas that don’t want to change don’t have to.

As for a “146 county mish-mash” .. so what? There’s already a variety of laws across the counties, from gas taxes to sales taxes to zoning laws… Try – just try – opening a nationwide fast food franchise in Helen, GA, for example. (grin)

Alcohol and other similar issues like prostitution, porm, etc do generally fit into the more local category for me as well and Yes, in general, I too am a Jeffersonian re maximizing happiness pursuits via gatherings of the like-minded, but having 146 geographically small counties also presents fiefdom problems on lots of issues, like police and schools. And especially transportation.

One legal wrinkle is that the Georgia Constitution requires “state” regulation of alcohol that has, heretofore been interpreted as statewide uniformity, but no court decision has made that determination.

All I would say is that local control is not always a panacea on all issues by a long shot, and,as usual, I am averse to snap judgments, and so

Some times its best not to have every issue be allowed to roil communities all the time. Sometimes closure is best for all concerned. Hence the laboratories of democracy. I would say that from my own personal standpoint, of convenience, I like the idea of there being some uniform cultural meaning being attached to a State rather than it being like feudal Europe in the Middle Ages!

What I would like to do is take Fulton, DeKalb, Gwinnett, Cobb, and Clayton counties all together and declare that to be the boundaries of the city of Atlanta. Too many issues end up before ‘regional commissions’ because the state doesn’t want to touch them and there are multi-jurisdictional issues at the local level.

That said, I don’t mind the idea of individual counties being able to decide whether Sunday liquor sales are ok or not. Some will, some won’t, and the ones that will will get a local tax boost.

I was amused at this line: ‘but they also fear a backlash of social conservative voters, who are believed to be more “single issue” in nature when arriving at the polls.’ And here I thought SoCons were more likely to be 3-legged conservatives? Cheap shot, I know, but it was there.

correctly, I would agree that the state should just pass the law that liquor sales are legal on Sundays. No one is insisting that Liquor store owners have to open on Sundays to sell liquor. Likewise, no one is insisting that anyone must purchase liquor on Sundays. It should be a no-brainer. I did catch the diarists comment that the legislators are worried about the single issue social conservative voters. As far as I know, I don’t remember hearing of any candidate that won or lost an election based on the fact that they were for a liquor sale ban or not. Actually, I’m not aware that there can be many or any voters that vote solely on whether someone supports Sunday liquor sales.

It seems that to some it’s the purity test again. If each individual does not get a say, than it is those evil government people getting in our faces again. Look at what is going on in WI, as to the union situation. Suppose a bankrupt state, say Calif. for example, that is heavily unionized, put a question on the state ballot for the voters to vote on, asking if the unions pension and benefits should be adjusted back, in order to not fall into the Pacific ocean. How do you think each individual voter will vote. They would vote to put the state into the ocean, because it’s all about about me first. What about Egypt? They got rid of Mubarak who did not kill apostates or adulterers. In a recent poll an overwhelming majority of the people want apostates and adulterers killed. They want sharia law to be a part of the new government. So, each individual gets their say, but, it doesn’t mean that the outcome is desirable or that is is a sign of “liberty.”

Been to most corners of the country, tried to learn what makes people tick instead of being the “ugly american” in cut-off jeans, a bad hawaiian shirt, and birkenstocks… for some reason, most folks like to talk about themselves and what they do, once you get beyond the initial mistrust.

I haven’t met any perfect people yet, so I’m sure I’ve also gotten stuff wrong. So what? I’m sure you’ll correct me if I make a major faux-pas like putting Baton Rouge in Mississippi, or confusing good Alabama barbecue with what they serve in Texas. (Texas BBQ – grill a steak, rub with brown sugar and chili powder, slice thin…)

I’m not a “numbers” geek. I don’t dig through poll internals. That’d be Neil, and it’s a valuable thing… but it’s not what I do. What I do is to listen .. and ask questions to make sure I’m hearing correctly .. and draw my own conclusions. You can assert they’re wrong all you like, that’s your perogative, counselor. If you’re doubting me, that’s good – maybe you’ll post some counter-facts (instead of going down rabbit trails) and we can get somewhere.

As to your non-sequitor – how do I know that this Mike DeVine is the same as that Mike DeVine? On the internet, nobody can tell you’re not a blind dog, eh?

as being one issue (Life and marriage, but oh, thats two) neanderthals that supposedly are part of the Big Guv moderate crowd of ruling class elites. When the fact is and the numbers prove that so-cons are the most three-legged conservatives one will find.

I consider that dribble to be bigoted but am usually restrained in my reaction to such crap that I find to be offensive to me and all Southerners and Christians. So I thought that I would get in a pre-emeptive strike for a change. I have often spoken of my and other Southerners ‘superiority complex given our years of history of having to learn not to stereotype others, even after 4 states voted for Catholic JFK in 1960.

This was probably inspired by my week of excruciating pain from a physical malady, so, as usual, I will be the big man and apologize since I know better and will revert back to regular southern hospitality mode and indulge the certain future anti-Southern and anti-Christian bigotry here that no one ever apologizes for because either because they are ignorant of that what they conclude about us from anecdotes is bigoted or they are venal.

I am now satisfied. I have posted counter-facts ad nauseum but a certain crowd here never listens and learns, so wise they are from “travels”.

Voting loyalty be damned. Some have just decided that so-con Repubs are the reason Dems hold power.

Now, maybe some here know I feel.

Back to being nice. Venting helps sometimes. Me anyway. Not a perfect person here, but I am one that waved goodbye to so-cons in the 70s and 80s from my then Dem Party mainly due to fiscal and nat security issues. And that the GOP has never lost an election due to social issues or due to lack of turnout by so-cons even when the candidates are McCains or 41s or Doles.

That is my point. If you don’t get it, I’m sorry.

If I could take the heat, I’d live in the South. (yes, just what you need, another d*mn yankee neighbor…) I agree that southerners get a bad rap – there’s a lot more to the South than most of us yankees ever see, mostly hard working people who take care of their own, in my admittedly limited experience. I am not one of you.

As to a mother and daughter cooking together, I fail, at this time, to see any deep meaning, beyond that recipes aren’t the only things that get passed down through generations .. they’re just one of the things we can observe.

To your point on voting, I’ve seen no polls from you indicating SoCons are “the most reliable” .. and I have seen polling from Bill S. indicating SoCons did stay home at one point. My issue with SoCons isn’t on voting day, it’s the lack of apparent involvement in getting the best candidates, and in re-evaluating incumbents. As the majority of the party, especially in the South, this is of critical importance and .. it just doesn’t seem to have been happening.

Explain to me how it makes sense for a State that has that many SoCons, and great barbecue, can keep returning Sen. Shelby. I’ll grant he’s a blue-dog-turned Republican – and a good example of both – but .. he’s been in the Senate since 1987 and has done .. what? .. to advance the cause of social conservatism?

The people of Utah – also social conservatives, but with a more fusionist attitude – voted out their RINO, why does Shelby get a pass?

Why not direct stereotypes and assimptions at those less conservative than Shelby (and there are many) that hail from non-Southern abodes?

That is my point for today. I haven’t the time nor inclination for another endless changing of the subject based on false assumptions.

Am I happy with Shelby? No, especially when compared to Sessions. But I am sure you will find that Shelby’s voting record contains many great conservative votes on fiscal, social (see especially judges) and national security matters that would favorably compare with most other Republicans and conservatives.

I too am seriously interested in how, despite the fact of polls showing most Americans are conservative or center-right, that we don’t get enough rock-solid small govt, pro-life and marriage, strong on defense, non-appropriators from all parts of the country.

I suspect the answer is decidedly non-Southern and non-Christian and the fault lies much less with those in the coalition that are social conservatives. You will find many more republicans that are ONLY fiscal cons and not strong on the other two legs than vice-versa.

Hence my resentment of your whole, unsubstantiated premise.

Getting my point yet enough to concede or do you have another easy question along the lines of why Rome fell?

Yes, I do argue from anecdote. As I said, I’m not a numbers person. I can do numbers, it’s a choice since numbers are merely – as you say – laborious work; arguing from anecdote is something I’ve not done well in the past.

Where you go awry, though, is in assuming that because I’m not a southern social conservative, that I am somehow in opposition to southerners and/or social conservatives. This is inaccurate.

What I see is you asserting – again, without digging up the proofs – that you’ve got the best voters. I have not disputed this. Involvement goes beyond the voting booth, though – and my sidestep to Sessions v. Shelby points this out.

between conservative people and those that are elected and what they become in DC and how the incumbents stay there. You admit you have no basis for your claims. Thanks. I consider the whole attack on so-cons on this matter and on others at Redstate, mainly of the libertarian variety but also by the lazy one-issue fiscal-cons that have not done their homework on exactly how they would fix the deficits and debt as entirely without merit. The spectacle we see now in DC is that even those that emphasize fiscal issues above all else seem to lack the courage of their convictions or are simply not very smart.

I consider the whole attack on social conservatives as wholly illegitimate and a waste of time and tinged with bigotry. I vented today on my own motion.

Now, I will move on to actual pressing issues like the battle with liberals over the debt and deficits and ObamaCare in DC and the states.

i hope that debate will not waste anymore bandwidth so that we can focus on getting the elites, appropriators and others in the ruling class, a club that is singularly closed to pro-lifers that dare raise their voices above a whisper.

Our chief counsel, Jordan Lorence, got this editorial onto the Daily News opinion page a year ago: Give Churches Space in Vacant City Schools.

There seems to be whole lot more evangelical Christians up here in dark blue Yankee-land these days–more than I’ve seen in decades–and many have their eyes on this, especially in real-estate-starved NYC, where a church plant can’t just buy a couple acres out on the edge of town; it looks like 60+ churches are now meeting in schools due to this case.

The lowest level of decision making is at the individual level. Let the establishment owners decide what day they do or don’t want to sell booze on and then let the citizens decide whether they want to buy on any particular day.

If a critical mass of people in any given community don’t want to buy booze on Sunday then it wont be any different than if one county bans it and its people drive 10 minutes to the store in the adjoining county.

Get the State out of Blue Laws entirely. It’s an otherwise legal product and a ban on Sunday has nothing whatsoever to do with justice.

Not sure what this has to do with the State letting business owners decide whether to sell booze on Sunday or not.

But I’m open minded on the time zone thing. The early goal of Daylight Savings Time was energy conservation but I don’t see a preponderance of evidence to suggest we gain anything positive from it now whether energy, economically, or otherwise. Anything you give the government a chance to fiddle with, they probably will, resulting in necessary changes to, for example, computer date/time software and configurations and the expenses that go along with.

Having said that and being willing to hear alternatives to the “PST/MST/CST/EST regime”, I’ll note that right now the State isn’t putting anyone in Georgia who defiantly claims it’s 1:00pm in the middle of the night into jail.

But I could be convinced to accord misdemeanor status to comments with a signature block twice as large as the content…

Whatever they do about the blue laws I think they should pass a law that Chick Fil A be open on Sundays! But Truett just won’t allow it and his kids will probably uphold the tradition after he is gone, well, for awhile.
