An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

I’ve been thinking on this much of the day and I’ve got to hand it to the Americans living down on the Texas, New Mexico and Arizona border.  Leftyfornia?  Feh – They made their own bed with idiotic sanctuary laws and absolute loons in government, so they can enjoy the result on the coast.

The way-undermanned US Border Patrol was quite honestly being hamstrung by the previous administration and I don’t even want to think about what’s going on now or what is coming (open borders, etc.) with the current crop of Fascists/Communists/Socialists in charge.  The more I do think about it, the more enraged I become.

I cannot imagine what it must be like living at or very close to the border with a constant stream of illegal aliens all over the place and nothing apparent that even attempts at stopping them.  I know for a fact that the people down there try to do the right thing and not hurt anyone, but the merde shall encounter the ventilateur when the inevitable happens and someone (like our gent being sued in ‘Zona) has that line in the sand crossed ‘for the last time’ and really does open fire on a group of illegals.  I believe it’s just a matter of time, especially in Texas if something isn’t done to stop the flow.

I must be totally honest here: People trespassing on my property over and over and over ?  Law Enforecement knowing about it and not doing anything whatsoever ?  I’d have opened fire long ago and by now would probably be in prison or dead.

I completely agree, Ken. It is only a matter of time until some solid citizen is pushed beyond his limit because no level of government will support him in defense of his property rights. Things have been intolerable under George W. He may have kept us safe from overt terrorist attacks, but the slow and steady “attack” on our society by illegals may end up being more devastating in the long run. Where in the devil do these neer-do-wells get the idea that they somehow have civil rights which anyone can conspire to deny? The frightening thing is that if that question were raised with the current administration they’d certainly provide an answer. I don’t even live near the southern border, but my “castle” is insured by Smith & Wesson

Just watch what happens to the rancher in question. He’s about to lose absolutely everything. And by-and-large, I’d guess Arizona is a more “castle friendly” place than where you live.

Frankly, the problem is “threatening” them. The better route is to get one (or several) in his yard and kill him (them). And then claim “home invasion”. He’d have a better chance of skating on that.

My home is also insured by Sig Sauer. I got the P239 .357 insurance policy. Never leave home without it. Also gotTennessee HCP insurance.

Wouldn’t mind adding an AR-15 policy though.

I don’t know about FL, but I suspect it’s probably similar to AZ. Here in AZ, if you break into my house, turn around and run out I can chase you down the street and shoot you. In the back if I can’t get you to turn around. And I’ll walk – after several weeks/months of having my life being made miserable by police and prosecutors.

Don’t even think of trying that with somebody wandering across your 40 acres. And don’t even think about “arresting” them for trespassing. That, dear friends, is called “kidnapping”. And BTW, the actual applicable definition of “kidnapping” doesn’t look anything like you think it does. It basically works out to holding someone against their will under pretty much any circumstance and can be added to a charge stack by a prosecutor to “enhance” darn near any underlying criminal charge. It’s most frequently used to “enhance” the appearance of a huge maximum, consecutively served sentence if a defendant goes to trial and loses, and it’s almost always given up instantly in plea negotiations.

The problem here, is that the charge can also be used as a big club in a civil trial.

The bottom line for the rancher in question, is that he’s not likely to be a rancher for long. He’s more likely to be a bankrupt homeless guy over this mess, and there’s lots of folks to point fingers at. In addition to GWB for refusing to enforce immigration laws, the county sheriff in Douglas bears a share of the blame because he’s been patting this guy on the back for years telling him not to worry. This rancher is screwed, big time. And, he won’t even get a whole lot of sympathy here in Arizona.

Castle Doctrine seems the same here mbecker, with one notable exception.

This rancher is in trouble. The Southern Poverty Law Center helped orchestrate Casey Nethercott’s imprisonment and loss of property in similar circumstances. It can happen.

That’s not a loser, it’s a non-starter. In the first place, the front lines of the immigration battle are, by-and-large, the territory ruled by the Ninth Circus. Combine that with the fact that LaRaza, etal are probably the best funded legal organizations around, and aided by the ACLU with virtually unlimited funds, and you’ve got a quagmire that you don’t have deep enough pockets to deal with.

The pro-illegal folks (mostly illegals themselves) had signs and shirts that said Si Se Puede (Yes We Can), and were waving, mostly, the Mexican flag.

It got major press coverage about how these people who want to be Americans are presenting themselves as Mexicans.

This brought about the Arizona Employer Sanctions Law and while enforcement has been lackluster, it is having an impact. But the only sure-fire way to curb illegal immigration does not lie in enforcement, but the elimination of the jobs these people come for. Once the jobs dry up, the people will self deport.

So, even if we could eliminate La Raza, MALDEF et al today, it won;t matter, because of the reason the illegals come here; to work.

I’m not advocating anything untoward…. I’m just asking a simple question for a reason.

Friends of mine have a hunting cabin near the Northern border in a State to remain unnamed. One weekend, one of the guys found a camp similar to yours. He did some recon and when nobody was there, left a few newly spent shot shells and other assorted casings laying around.

That camp was gone within 24 hours.
