That said, I do have some sympathy with the argument that California passed its criminal laws and sentencing procedures without being willing to pay the costs of said incarceration.
Not quite sure how to resolve this conundrum: I don’t likeFederal judges overriding state laws, but not sure how else to force the state to pay the costs of its laws. At some point, prison overcrowding does run afoul of the 8th Amendment.
Ordering the state to build more facilities (which another court receiver is trying to do) would appear to violate separation of powers by taking on the role of legislature and executive, Early release at least doesn’t create that kind of constitutional crisis, but does come closer to “natural consequences” parenting.
Of course, the real third rail here that no one wants to touch is the undue power of the prison guards union.
