A federal district judge in San Francisco has decided the citizens of a state prohibiting gay marriage violates the constitution. “Gender no longer forms an essential part of marriage,” said the judge, overturning several thousand years of history in one fell swoop. A majority of the citizens of California, the most progressive state in the union, disagree.
In fact, 32 states ban gay marriage by constitution or statute. An additional seven ban it, but have civil-union laws. The judge in San Francisco ruled yesterday that civil unions do not equate with marriage.
In fact, the judge focused on the historic cultural meaning of marriage before destroying the historic cultural meaning of marriage.
39 states have banned gay marriage.
It takes only 38 states to ratify a constitutional amendment.
A majority of the American public and three-quarters of the American states have been overruled by one federal judge in San Francisco. To be fair, the ruling only affects Northern California. It will be appealed. The odds are, for now, that the judge will be overruled.
But again and again the political elites in this country think they know best. From the mosque at Ground Zero to gay marriage to Obamacare, the majority of the people and states are forced to deal with a minority that does not respect them and democratic and legal institutions that oppose them.
If a minority of political elites and liberals can impose their will and values on a majority sufficient enough to amend the constitution, it is time for the majority to respond with constitutional force.
In Thomas Jefferson’s words, “In questions of power then, let no more be heard of confidence in man, but bind him down from mischief by the chains of the constitution.”

If appeals are pursued up to the Supreme Court and the issue is lost, gay marriage will become a naitonally enforced constitutional right. Appealing therefore is a potential trap.
Alternatively, if there is no appeal, it is one decision affecting only California. If Obama is defeated in 2012 and IF the next president replaces Ginsburg with a constitutionalist, a new case could be litigated then.

Later, if the Supreme Court had five constitutionalist votes, you could choose to litigate somewhere else. Alternatively, there would be efforts to litigate to expand gay marriage in other jusrisdictions. When that occurred, you could challenge that case all the way to the Supreme Court and win-which also would overturn the decision by Judge Walker.
Also the idea below that there would be 8 votes to uphold is ludicrous. There are four votes to throw out Roe v. Wade, 37 years later. That’s more than dissented in the original case. Scalia, Thomas, Roberts, and Alito all will vote to overturn such a raw, extraconstitutional abuse of the judicial function. They just don’t have the fifth vote right now.
Ted Olson has laid a trap. There’s no reason to fall into it.

By 2012, and even if argued today, the conservative members are going to see this as inevitable and will be conscientious of their judicial legacy. What view do we have now of past justices who supported positions which are now viewed as absurd, barbaric, or un-American?
There was only sparse coverage of Argentina granting marriage rights to same-sex couples. It was amazingly paltry coverage for such a major time-line event.
Argentina is possibly the most Roman-Catholic of all nations, having mandated only up to a few years back that their President be Catholic. It is the 4th most populous country in the western hemisphere. The legalization didn’t occur through judicial viat, but occurred through the legislative process.
The writing is on the wall. And the libertarian vein in the conservative justices is going to overcome their social prejudices as well. Clarence Thomas possesses no such clarity of thought and thus will indeed be in opposition, but I don’t see more than one of the other conservative justices siding with a dieing cause.

Tenth amendment, anyone? Who pays attention to that li’l ol’ thing? Most ‘citizens’ don’t even know what it says.
Would your proposed amendment only mention human beings, or only marriage between two humans? If so, it would be overcome by the sudden lack of ‘civil rights’ of threesomes or of the person who just can’t live without being married to that very special poodle.
I know we have to fight, and I have great hopes for the November election and will work on behalf of candidates in it, but I have to admit that the last couple of years have been disheartening, not to mention the last century of history.

I have a purse size Declaration of Independence and the Constitution to carry with me. I know I am not alone in this reeducation endeavor. We the People are waking up, and our Constitution has been silently waiting for us to sit down for coffee talk, or a cup of tea if you prefer…after all, we have choices in this country, and elections. There are days when I, too, get discouraged, but more days that I am excited for this awakening.

Anyway, unless a constitutional amendment banning same-sex marriage is passed, I think it’s inevitable that the SCOTUS will rule allowing it.
I think the next 10 years will see several serious attempts to modify the Constitution via amendment. All sides have pretty much wrung out what they can from the current laws, statutes, and interpretations. It’s really the only way to go at this point.

However, with “10%” unemployment, a multi trillion dollar deficit, a 100 trillion dollars in unfunded liabilities and an economic model starting to resemble Cuba I’d think these guys would have something more important to worry about and address than gays getting married. Just really not a priority for our country right now.

The 14th was a direct result of the Union victory over the south and was pushed through when Republicans still had control of the country.
The 19th was the result of decades of women’s suffrage activism by Republican women like Elizabeth Cady Stanton. You really should learn a little history before you start believing the progressive non-sense that you’re been fed.

If you’ve read my posts, which apparently you have not, you will see that I have not used the words “Republican” or “Democrat” once. I’ve only used terms like “conservative”. To the untrained and uneducated man, the democrat/republican argument always works because people who don’t know history don’t know that the political leanings of both parties has changed significantly over time. In the 1930′s the vast majority of African Americans were Republican because of Lincoln. Moreover, during Reconstruction (14th) and 1919 (19th), the Democrats were clearly the more conservative party, mostly controlled by the South albeit there was a special relationship with a small contingent of New England Dems. Strum Thurmond was a Democrat for years and years for Christ’s sake. It was CONSERVATIVES who wanted to block the advancement of rights to people, I don’t care what their party affiliation was at the time.
I said all that to say, your little dem/rep trick will only work on someone who has no concept of American History… Good try though.

But as the ‘Republicans’ became the default political power after the Conservative ‘Democrats’ launched a holy war to maintain their peculiar institution and lost, the moneyed interests infected the Republican Party, and as they lost support up North, they wooed disaffected social Conservatives of the South into their fold to arm them with the political power to continue their fiscal rape of the country. And thus we are where we are today.
Everyone, but the uneducated, know this, so you are either displaying your ignorance or you are a part of the plan to continue to recruit the gullible to your political cause.

Have you ever had to counsel a young gay male not to end his life because his older lover had thrown the young man out of the only home he had? I have.
My home was a safe haven for my daughter’s friends (of any sexual persuasion ) in their early teens through early 20′s. They knew I would listen. They knew there was a hot meal and a safe place to sleep if it was needed.
One prevailing topic that ran through the talks was wanting someone to love them. How they felt used when a relationship ended. I counseled to practice safe sex if they were going to be active and if they weren’t safe, to get tested for STDs. One young man swore off sexual encounters after coming up positive for the clap. And some of the young ladies were treated for a few issues also.
Stability in any relationship is difficult at best. It is more so when it is built on haste to belong and be loved.
So, the playing field will be more equitable (if the ruling stands) instead of an uneven distribution in the relationship’s balance of power. No walking away .

Or with a husband who is impotent? And what about elderly couples? Can they not marry because they can’t reproduce? What if the couple can reproduce when they get married, but something happens to take away that ability – should their marriage become invalid?
I don’t believe the reproduction aspect is enough to argue the case. Remember, only through an argument without easily identifiable exceptions will stump a liberal – they usually argue exceptions, after all.

Even with these votes, people like Boxer in CA will be re-elected. Where are the voters in FL, OH, or PA who strongly support traditional marriage and the AZ immigration law? Why are the Democrats (and scum sucking independents like Crist) even close in those states?

The Michigan governors race almost defies belief. I’m not excited about the concept, but gay marriage looks like it is here to stay, much like abortion. The camel’s nose got in the tent.
Since our side of the debate is now distracted by other issues, such as the destruction of our economy and our fight for survival, the gay agenda has managed to slip this one in. By the time anyone is able to make headway on a legal challenge or a constitutional amendment, there will be plenty of long term gay married couples who will have standing to fight to keep their legal status.

So, this judge moved everything that ought to have been in the findings of law, and put it in the findings of fact section. Then, the final decision as written was basically: because it is true that gay marriage is a universal right, and because it is true that the constitution protects gay marriage as a universal right, I find that this amendment violates the constitution.
E.g. he deliberately structured his opinion to become THE classic example of “begging the question” — assuming your conclusion is true, and using that assumption as “proof” of your argument.
I think that will backfire on him, because the “customary rules of appellate review” are just that: customary. They aren’t binding. And when a rational appellate court (e.g. not the Ninth) takes a hard look at this judge’s sophistry, they are going to see right through his slight of hand — and suspend those “customary rules”. At that point, Katie bar the door; the justices will look at EVERYTHING in the trial record, plus all the various appellate briefs.
And Kennedy has already expressed reservation about his earlier logic being used in some case about gay marriage; I think he is uncomfortable as a legal matter extending the logic of some of the decisions he has written, to stretch that far. Unlike this judge. So it looks like a 5-4 against the judge, once it gets to SCOTUS.
One of the Volokh guys said that the judge’s opinion included and independently relies on EVERY one of the justifications put forward by the plantiffs. Some think that this means the opinion is stronger; I think it makes the opinion weaker — because if any justice objects to any one of those rationales, then the opinion is void, because the judge structured his decision as all-or-nothing. Either he is upheld and all of the rationales are also held to be black letter law, OR a single one of the rationales is upended, and so is the decision.

As such, any attempt to restrict anyone from marrying who they wish is a violation of the equal protection clause of the 14th Amendment.
Obviously, I am not a legal scholar. As such, I am unfamiliar with case law that enshrines marriage as a “fundamental right.” Perhaps someone could discuss this in more detail.
However, I fail to see anywhere in the Constitution that establishes marriage as a fundamental right, just as I see nothing in the Constitution that establishes the fundamental right of a mother to kill her unborn baby simply because she chooses to do so.
If marriage is not considered a fundamental right, it is then subject to the jurisdiction of the various states, as I understand the Constitution. Hence, marriage licenses are issued by local authorities, and not the federal government. And, therefore, the states should be within their legal rights to regulate and restrict the ability of their various citizens to marry as proscribed within the confines of their various constitutions and laws.
Now, I am hopeful someone more educated than I on these matters can respond and correct me, if my reasoning is flawed.

It is up to the courts to define what are “the privileges or immunities of citizens” that the states have no power to limit. For example, integrated education is not explicitly mentioned anywhere in the Constitution, but segregated schools are clearly in violation regardless.

Jim Thursday, August 5th at 1:01PM EST (link)Does this ruling (and the likelihood of more to come in the future) point to the possibility that defenders of traditional marriage are barking up the wrong tree? What I mean by that is, is it really in our interest to have the state (either California or the Federal government) endorse, certify, define, and license marriage in the first place?
Speaking as a Catholic, my marriage is a sacrament under the doctrine of my church. If the state in which I live never certified, licensed, or acknowledged my marriage I would still be married to my wife. Essentially, I don’t care what the state says about what a marriage is or is not because they are not the ones who define it. And in terms of the “perks” I get for being married (i.e. tax breaks and whatnot), I would rather fight the income tax itself rather than carve out tax-breaks for being married or not married.
I guess the question I have is should we be trying to fight this battle on the left’s natural turf (in the big-government leaning courts, with the progressive legislators, etc) or just try and get the state out of the marriage business altogether?

You'll never get 2/3rds of Congress to approve an Amendment banning gay marriage

Which leaves only the Constitutional “nuclear option” – a Constitutional convention, which only requires 2/3rds of the states to convene, though any amendments thus proposed would still need the same 3/4ths of the states to ratify.
This would be completely uncharted waters, and should represent the last peaceful resort to save us as constitutional republic – an effort that could well fail because by that point too many states (and citizens) may “know not Joseph”.
We’re not yet there yet, but a runaway judiciary is bringing that day ever closer.
Meanwhile, we will need to rely on the frail reed of the U.S. Supreme Court, where this case is headed. Better hope for continued good health of our 4 conservative judges, because you know the Obama and the Democrats in nominating a replacement will receiprocate none of the “deference” that several benighted Republican senator continue to show to the Democrats, stuck in denial of the Revolution that is knocking their doors.

I did express great skepticism about a constitutional amendment because it’s not going to pass congress nor are we about to convene a constitutional convention over it. So that’s really a dead letter in the forseeable future as I see it.
My issue deals with judicial overreach – gay marriage is a matter that should be handled at the legislative level, not the court level. Indeed, I think that shifting sentiments in California would probably led to a vote in favor of a pro-gay marriage initiative in the last election had the California Supreme Court not thrown out a previous initiative on state constitutional grounds, which Prop 8 overrode. But once the courts intervened, then they became the prime problem, which shifted the vote.
Again, my issue is with the courts stepping in. I don’t find any federal constitutional right regarding marriage without turning the Constitution into putty molded to the prejudices of the age. Let the people or their elected representatives decide.
