By triggering the criminal complaint as is stated, LLF is wanting the court to recognize that to wait, would be to give the NON-bill, the color of being an ACTUAL bill. The trigger is passage of the NON-bill. Plus, we know The One (termer) will sign it within a nanosecond of smelling the penumbra of anything with the words “health” and “care” in it.
Second, the deemed bill is the original Senate-passed bill. If it is deemed passed, the President just signs the “reconciliation” bill. That is why LLF is suing. The President would be signing a NON-bill that never passed the House.

Until Obama signs, nothing has actually happened beyond the usual, talk in Congress.
Major Garrett just stated on Fox that he firmly did not believe they’d use the deem-and-pass route, primarily because of the public black eye they’d be giving themselves.

He is dealing with dozens of members who refuse to commit to a firm position in hopes their silence will force the leadership to pull the bill and move on to other issues. “Just say nothing,” is how one Democratic staffer explained the strategy being taken by many members. “Maybe it will just go away, and we can avoid a tough vote this close to the election.”

He also warned Pelosi not to use the Slaughter rule or he’ll sue for that as well. It’s the first of many lawsuits coming from the various states–should this thing pass.

If I could only tell you about some of the “Catholics” (priests, parishioners, etc.) I know who are pro-choice and socially liberal it would probably be 50/50. Although just to set the record straight most of the priests and parishes that I know of are conservative, pro-life and pro-family From my experience the Bishops backing this bill would have been worse, the nuns don’t mean as much, but it is a shame that they claim to represent conservative Catholics like me and others that I know because they are not following Church doctrine.
Oh and don’t be so down, I know it’s hard, but we need you in this fight soldier. Larry do yourself a favor turn off cable news, talk radio, and stop looking at the web for today. Give yourself a day off friend, I did this yesterday and you know what? The abortion component is obvious-it OUGHT to be a no brainer to even the Easter and Christmas only crowd.
But, even deeper, I argue that MY healthcare is a covenant between God and me-not between the state and me. It isn’t up to the state to choose whether I live or die.
I’ve walked those DC ‘hallowed halls’ and trust me, they don’t even put their pants on one leg atta time (it’s usually head first). I don’t want those idiots making large scaled decisions about populations of Americans.

I would assume the Congressional attorneys would file a motion for expedited proceedings. Whatever we can do to delay it until 2012 and its REPEAL. I read that this is one of the rare situtations where federal standing t sue is not a problem.

Ironically, Nancy Pelosi and Henry Waxman sued over the same issue several years ago when the Republicans were in charge, and they lost the case as the court ruled it had no jurisdiction over the Legislative Branch’s rules. I don’t see that changing just because conservatives file suit.

He said the Dems are “…attemptingt to institutionalize through a rule a procedure that violates the constitution and presumably to use that procedure if it is upheld over and over again.” I’m no legal scholar, but this does not sound to me like the same thing the Dems sued over some years ago.
Levin said that the court is right in giving deference to Congress, but the Dems are purposely trying to run around the obvious provisions in the constituion and it has to be challenged. Levin is the one to do it as he is a fantastic consitutional scholar. If Levin loses, the country loses because then there will be no limit to the abuses of power that will be possible on future terrible legislation, like cap and tax, amnesty for illegals, etc.
I will be praying for Mark Levin. You should as well.
