New reasons emerge almost daily as to why Obamacare can and must be defeated.
1. The American people oppose Obamacare by almost 2 to 1 in the latest CNN poll. Other polls show lopsided opposition to passing either the Senate or House health-care bill.
Public opinion is against the bill because of its obscene costs in higher taxes, burdensome debt, anti-freedom mandates, rationing, and reduced care for seniors. The American people have awakened to the fact that Obamacare is transformational legislation that will drag us against popular will into European-style Socialism.

It sure would be nice if people would help the campaign. Kenedy’s seat is not an automatic D. A lot of Ds have moved up north to new hampshire. I guess they couldn’t stand the stench of what they did down here.
If he does win, that would help kill obamacare if it goes back to the senate.

Reason #8 addresses the most chilling aspect of ObamaCare

(1) the Congress (and President) strips the Court of review power over executive branch actions – which if successful breaks the third leg of great U.S. “Balance of Powers” which brings down the whole structure;
(2) the government employing Mafiosa tactics in taking over the practice of medicine by making doctors offers they can’t refuse. Again, if this is successful, there’s no limit on what they can make doctors do.
And if you argue thatthey can’t stop doctors from quitting – what’s to stop them from conscripting medical professionals into practice if the numbers get too low – especially if the courts are prohibited from intervening, see point (1).

If ObamaCare is worth going to the mattresses over, what will ObamaGreenCard (immigration) be? That’s the next thing up on the agenda, and if ObamaCare squeaks by, then the next shoe to drop will be the legalisation of 20 Million illegal aliens.
Win or loose, a recall effort aimed at Nelson sends the message that people are mad as hell and we’re not going to take it anymore.

I found a white paper on Lugar’s site that outlined the issue, and I think you’re right, or at least the issue would end up with the Supreme Court. Still, as an act of citizen revolt, it might well be worth the money, effort and time as a shot across the bow of Nelson and others who are so out of touch with what the vast number of American people want.

The land of the “free” is closing in fast to socialism, and being “free” is why they are here illegally.
I think the actual number of illegals that will opt in for citizienship is way smaller than people realize. The Dems are fooling themselves.

Frozen_Man (Diary) Wednesday, December 30th at 2:16PM EST (link)As I read through the article it seemed much more an article about why the public (and Sentaors / Members of the House if they would actually do their job) should oppose the bill but not much about how any of that may stop the bill. With the exception of numbers 1, 3, and 4 none of the rest of the reasons actually have any ability to kill the bill. Really all the other reasons just add fuel to why the public is so against the legislation which is outlined in #1.
Of the three that might have any ability to hinder, strip away or stop the legislation:
#1 – public opinion – has not been able to prevent the bill from chugging along, I do think it has been able to weaken the bill a fair bit, but not kill it. I don’t think the poll numbers will go too much lower, maybe a few points (or even 3-5 points) but there is a minority of people in the country who actually want all this stuff and they aren’t likely to change their minds. If the House and Senate have been so unresponsive to public opinion thus far I find it unlikely that they will care as the process moves along.
#3 I think that the unconstitutionality of this legislation (especially as espoused by number 3 is the best way to kill a portion of this legislation. I think that the Court as it is currently constructed would likely find the requirement to purchase health insurance to be a citizen in good standing unconstitutional. This will not however, render the entire bill unconstitutional and may in fact make it easier for the Dems to push universal health care as they can claim that it is what has to be done to lower costs since we can’t force people to have insurance but cannot turn away the sick and dying either.
#4 I am not sure that the Court would find this a violation of the takings clause. I don’t think after litigated there will be a due process claim to be made and doubt very much that it will be seen as a takings issue. To me this was the weakest of the arguments (it will likely have the impact of forcing many companies out of business but so do multitudes of other legislation and the Court is unlikely to rule that regulations in this context equal a taking).
While I enjoyed the article and it once again helped to reinforce why the legislation should fail not much in it gave me hope that it would fail. Details as to the hurdles still required to become law and how to make the hurdles harder to jump over would have been more realistic as to why it might rather than should fail.

the fact Louise Slaughter has publicly stated that she will not vote for the Senate Bill,
that in Burt Stupak’s last interview, he sounded more combative than ever,
that Ben Nelson would lose by 31 points in a new poll,
that Scott Brown has an outside shot of picking off a Senate seat,
that Governor Patterson and Arnold of both hostile towards the Senate Bill
that the Dem leadership has pushed the vote off until February, …
There are tea leaves to read, we have to hit the right pressure points.
