My Final Word on Joe Wilson and the President

Congressman Joe Wilson, R-S.C., should not have called the president of the United States a liar during the middle of a joint session of Congress. There are boundaries for decorum that should not be crossed, and Wilson crossed those boundaries. He was quick to apologize. He should have.

Wilson called the president a liar after 30 minutes of … well … a series of distortions, half-truths and lies. He should not have done it there, but I cannot really blame him.

Wilson’s outburst came right after the president said the Democrats’ health-care legislation does not cover illegal aliens. The legislation, in fact, specifically excludes illegal aliens from coverage. But the Democrats killed a Republican amendment that would have required doctors to inquire about citizenship. It is like telling a kid that it is against the law to drink, but then specifically not enforcing the law, nor providing any money or manpower to enforce the law.

President Obama’s canard on illegal aliens came moments after saying “no federal dollars will be used to fund abortions.” The Democrats have, however, already given away the game.

Republicans on the House Energy and Commerce Committee were able, by one vote, to include specific language in H.R. 3200, the Democrats’ health-care legislation, prohibiting funding of abortions. Henry Waxman, chairman of the committee, recessed the committee, then, upon reconvening, held the vote again, and the amendment died by one vote.

The Democrats now hide behind the Hyde Amendment, which prohibits government funding of abortions specifically funded through the Department of Health and Human Services. What the Democrats fail to mention is they have structured H.R. 3200 so that any funds for their health-care plan will not come through the Department of Health and Human Services’ appropriations process. Therefore, the Hyde Amendment would not apply, and abortions can be funded.

It is no wonder Joe Wilson lost his cool.

Then there is the matter of the deficit and taxes.

for the life of me on Sec. 246 of HR 3200 and INA of 1952

DONTREADONME (Diary) Friday, September 11th at 2:03PM EST (link)

I can not figure out how to enforce sec. 246 of HR 3200 using the information in INA of 1952. BTW sec. 246 only applies specifically to Subtitle C of Title II.

Therefore, I am making a point to bolster what you said in 3rd para.

Republican Amendment

wedreaminsound Friday, September 11th at 2:13PM EST (link)

My concern is that requiring doctors to run point on screening patients citizenship status is unrealistic, inefficient, and ultimately inconsequential. Unrealistic because most front desk staff will not be sufficiently trained or skilled enough to make that assessment, (I should mention that I manage a three doctor pediatric practice in Brooklyn, NY). Inefficient because I would think it would be much easier to make that determination at the point of purchase of their actual coverage, whether they be buying private or public insurance. And finally inconsequential because most MD’s will see a patient regardless of their citizenship status, certainly for critical care, but in my experience for routine or preventive care as well.

I agree that enforcement of illegal immigration has been made via token gestures at best, and that the onus continues to be handed off again and again, from employers to other civil service institution, etc., but I don’t believe health care professionals are a viable alternative for the reasons I stated above.

I want to be fair...

I was just talking to a neuroscientist MD about this yesterday. He did a rotation at the local gunshot factory here in Atlanta, Grady hospital. He said that they see everybody who comes in the door, who is on the steps, whatever.

When I asked if there was legislation, or rules of the AMA, or something in the hospital charter, that required this, he said that he had absolutely no idea, but that it was in the Hippocratic oath.

Do you then not see them if they fail to produce one? Do you train your staff to recognize fraudulent documents? Our software has a feature where it will pop up with an alert if a duplicate social security number is entered for multiple families, but I’ve never heard feedback for that being particularly useful. Just one approach I guess. As an administrator, I’m a little nervous about having so much personal demographic data in general. Securing it and prioritizing its viewing continues to be a software problem without much consensus.

I manage a three doctor pediatric private practice in Brooklyn, NY. I am responsible for the integrity and security of our data and other IT concerns. I also do mostly front-end billing, vaccine management etc. In addition, I work for the software company that we use and have had the opportunity to go to some industry EHR trade shows where some of these issues have been discussed. I didn’t mean to suggest I was a healthcare provider.

For what it’s worth I got the impression you were running an office from what you said, not that you were a doctor, heh.

Was wondering though if it was a small place like you’re at, or some larger operation, because obviously the staffing concerns are different for each.

A small office like yours loses out on economies of scale in training.

I completely agree with you which is why we choose to hire a very capable, albeit streamlined staff, and pay them significantly above market rates. However, in my experience through the medical software company, most MD’s, even technically advanced ones, don’t have the same philosophy.

Joe Wilson is Dead Wrong

JoeTheRealist Friday, September 11th at 2:14PM EST (link)

Besides the staggering immaturity, Wilson was absolutely not right. Here is a link to the Library of Congress, text of HR 3200, section 246:

h ttp://thomas.loc.gov/cgi-bin/query/F?c111:1:./temp/~c111tmLfyQ:e176188:

Note the title of the section: NO FEDERAL PAYMENT FOR UNDOCUMENTED ALIENS

How much more wrong could he be? Those on the right see this section and ignore the patently obvious, that illegals will not be covered, by changing the subject to enforcement. Wilson wasn’t yelling like a 5th grder who was told he can’t have another ice cream because of enforcement and you all know it.

By the way, today is the day that President Obama has officially kept us safe for longer than the Bush administration did, suck on that repub… And cheers to our great President, Obama.

The CBO’s evaluation of that law says clearly and unambiguously that illegal aliens will be covered.

Not True

ejsohio Friday, September 11th at 2:22PM EST (link)

However, if you actually read the section in its entirety you will see that the framers of this document have provided no means to ensure that illegals are documented. And since no investigation into each and every illegal supplicant will be possible, services will be provided for one and all with no discrimination between a legal citizen or resident and an illegal.

But hey, in the progressive way of thinking, that doesn’t matter because this isn’t about health care, but about the acquisition of power!

Did you even read the article?

Rich Tandler (Diary) Friday, September 11th at 2:25PM EST (link)

Or did you see “Joe Wilson” and start foaming at the mouth and pounding your keyboard.

Yes, there is a provision to prohibit payment to illegals. The problem is that there is no enforcement provision to make sure that it doesn’t happen. The prohibition does no good without enforcement.

It’s kind of like when Obama was doing coke and other drugs back in the day. Sure, they were illegal but the laws weren’t very well enforced so Barak could snort away.

The tree of liberty must be refreshed with the tears of defeated politicians of BOTH parties and at ALL levels over the next few election cycles.

Worse than that actually. Even if the enforcement

The_Gadfly (Diary) Friday, September 11th at 5:06PM EST (link)

were written into the law, based on two US District Court rulings, including the one on California’s Proposition 187, it is likely that SCOTUS would deem clauses which exclude coverage for illegal aliens as unconstitutional. It is the act of seeking universal coverage which causes this. And since universal coverage is non-negotiable for The Big 0, Pelosi, and Reid illegals are automatically covered regardless of WHAT other provisions are written into the law.

Joe Wilson

ejsohio Friday, September 11th at 2:14PM EST (link)

Conservatives are criticizing Rep. Wilson for calling the president a liar and thereby violating the decorum of congress. The fact is, the president is lying about nearly everything he truly stands for and Rep. Wilson was simply stating the truth. Now, as for decorum, Democrats long-ago destroyed what decorum existed in congressional settings. And while it is true that we don’t want to stoop to their level, so long as we are honest and act with integrity, the fierce harshness of truth must be shouted from the house tops – otherwise, the enemy of freedom will think we don’t care or don’t have the spine to resist him.

Would you have preferred the President just read the bill verbatim to Congress? He lied by omission, fine… now what? The heart of Mr. Erickson’s argument is that if you’re going to deny illegal immigrants coverage, what is the best way to enforce that exclusion? He suggests doctors should be required to make inquiries, others suggest the SAVE program for example. This is how we should be “dealing with it,” which was the point of the President’s speech.

Because I live in America and I work in health care and I know this needs to happen. I am concerned that a few hot button issues could prevent meaningful reform, especially when I can see a million and one ways to avoid these pitfalls and still pass a good bill.

I would like to see a plan, that allows for interstate competition. I wouldl like to see plan that states that insurance companies cannot outright deny a person for a preexisting condition, but can charge 20% above their prime candiate rate for someone with a history of having health insurance, and up to 40% to those who do not have a history of paying for insurance, (Figure the company needs to get something for the fact that they are going to be paying for the preexisting condition, a hell of better deal than a car insurer would give someone, if they wrapped their car around a tree, and then called Geico). I would like to see a plan that includes tort reform so scumbags like John Edwards can’t get multi million dollar awards for fooling 12 people who wouldn’t know a spleen from an eyelash, and I would like to be able to have HSA’s that I can save from year to year, that gain interest and can be transferred to next of kin if I shuffle off the mortal coil.

From: “John McCain”
To: (JLenardDetroit) My Friend,

Health Care Reform Petition

Government-run health care is something we simply cannot afford.
(Sign the Petition Today)

Last night, during his speech to a joint session of Congress and the nation, President Obama outlined his new proposal for health care reform. While I respect the President’s point of view, and hope for an eventual compromise, I believe his proposal amounts to an egregiously expensive and expansive form of government-run health care.

After a month of hosting and attending town hall meetings with my constituents in Arizona and around the country, I know that Americans want health care reform. But what is so very clear to me is that Americans want to reform health care in the right way. I am more convinced than ever that we must fix what is wrong with our health care system while doing no harm to the parts that work well.

This means we need to have malpractice reform, we must emphasize wellness and fitness, give people the option to get the health insurance of their choice and bring the cost of health care under control.

If you agree, that we need to reform health care reform the right way, then I ask you to sign my health care reform petition today by following this link.

I am very troubled by the potential cost of the President’s outlined plans. I know that you are very concerned with the national debt and a projected $9 trillion deficit. The prospective cost of the President’s plan could reach $2 trillion, and frankly, our country simply cannot afford this price tag.

I will not support heath care reform that adds to the out-of-control spending spree the Democrats in Congress have gone on this year. And I ask you to join me in rejecting the addition of $2 trillion of debt by signing this petition right away.

Government-run health care is something we simply cannot afford, and I know that the majority of Americans agree with me that it is not the quality of health care that needs reforming, but the cost. But, I need to know you stand with me. Will you follow this link to sign my petition?

As you know, the Democrats in Washington are doing everything in their power to push through their proposed reform full of political gimmicks. Your action today will send a clear message to them; we don’t want government-run health care. Thank you, my friend, for your support and involvement on this very important national issue.

Thank you,

John McCain

P.S. The Democrats have pledged to “move forward” with their $2 trillion plan regardless of Republican support. But, it is up to us to do everything in our power to put a stop to the wasteful spending and enact health care reform in the right way. Please sign this petition today and if you are able to, make a generous contribution to my reelection effort. Thank you.

I sure you are all aiding his Primary opponent as I am (Conservative Candidates (the Diary)) and continue to let McCain know more sell-outs are NOT acceptable.

Re: YOU LIE....(chanelling my inner Joe Wilson)

wedreaminsound Friday, September 11th at 5:06PM EST (link)

This is pointless. I said it was a stretch, you disagreed, I conceded that it was possible to look at it that way. What? Are you upset I didn’t qualify my opinion as an opinion? Let me put it another way. In my opinion, the President was not trying to deliberately mislead anyone. He was simply framing his argument, as well all do. However, I see how you could view that as a “lie”. I just don’t see where you plan on going from there. A politician lied? BFD. This hysteria gets us nowhere.

I admit, I did not come here to discuss the merits of H.C. reform in general. I brought up SAVE as an alternative to the specific proposal mentioned by Mr. Erickson, knowing that it was struck down by Dems, yes. That makes me a liar? I would support that, rather than forcing doctors to check. Truth be told, I’m not convinced that denying healthcare to illegal immigrants is the right choice, and I certainly find it difficult to deny them the right to purchase it over an exchange from private insurers. However, I am willing to look at these issues with intellectual honesty and entertain policies I’m not necessarily sold on. That’s not obfuscating. That just thinking. I was just trying to stay focused on the subject of this thread. It seems to me that focus is something very much needed in this debate.

You knew that no enforcement provisions existed in this bill...so did Obama...you both lied.

Hey pal….I’m not sure how to break this to you but when you make a comment like “this bill will not cover abortion” when Henry Waxman’s committee defeated an ammendment which would have explicitly denied abortion coverage, and you know that attempts to explicitly deny coverage to illegal aliens have been defeated by your own party…it can mean one of only two things:

You’re lying…..or you’re so stupid you don’t even know what’s going on in the Party that you’re leading.

here is your problem, "I know this needs to happen"...

DONTREADONME (Diary) Friday, September 11th at 3:43PM EST (link)

this is when you make a fundamental error. You know this needs to happen, why? how? and why Government? These are the questions you need to ask yourself. I do not care that you work in the Health Industry, from the perspective of law, government and regulation you need to work in the Government atmosphere. Then you should ask yourself, what the heck does this 1000+ page document tied to hundreds of other references actually accomplish and what are the CONSEQUENCES? To me it seems, you are left wanting, rather than actually considering.

Re: here is your problem, "I know this needs to happen"...

wedreaminsound Friday, September 11th at 4:13PM EST (link)

You may be presuming too much about me. I understand very well that there will be significant consequences to any major changes mandated by the government, and I also understand that many of those consequences will be difficult to predict.

Why? Because I believe as a leading nation in this world we have an obligation to help our citizens mitigate the risk of catastrophic illness and medical expense, (I understand this is debatable). I also see rising costs for companies and individuals to be unsustainable. I’m skeptical of private insurance companies’ ability to control costs, just as I’m skeptical of a public plan being able to do the same.

How? Opportunity cost and real honest risk assessment. I am a wonk. I don’t care about the politics. Problems and solutions. Meat and potatoes. Illegal immigrants could be covered? Desirable or not? No? How do we prevent that from happening? Make MD’s responsible? If so, A, B, and C may result. Okay, what then? And ad infinitum as deep as our mortal reps can possibly go.

Real time, one, five, ten years out, reassess over and over until you get it right, (and you never will).

And a constant tinkerer to boot.

The tinkering concept is what has brought us to this point. From Teddy’s proclamation of HC being a job of the Gov’t to the Great Society to the myriad of little changes made by the Kennedy’s and other DC establishment. All the while health care costs rose.

Maybe instead of doing more tinkering we should say full stop. Start repealing stuff…you know take out variables in order to have a predictable result, rather than increasing variables and having no credible chance of predicting results.

Multiple things...

DONTREADONME (Diary) Friday, September 11th at 4:39PM EST (link)

first, the Federal Government is risk adverse to the point of paralysis, even building a weapon system for the purpose of killing has gotten to the point of impossible because of all of the bureacratic nightmare that I have to go through.

second, you’re right the point is debatable, the federal government has no obligation to pay for catastrophic illness and medical illness. One of those little costs of liberty, it is a crying shame that disease and accidents happen but the price should not be forced on the whole populace. I think people are missing one huge thing that doesn’t exist catastrophic health insurance with a high deductable and no medical maintenance coverage. You pay for your preventative medicine. No need to go into this since this will never happen in the new U.S.S.A mindset.

third, you should be skeptical of GOVERNMENTS ability to control costs, period for private and public. Through regulation both state and federal drives cost of private insurance.

fourth, why can’t this be tried at the state level rather than the federal. If it doesn’t work at the State forget the Federal.

fifth, I agree that Dr’s can not be expected to enforce immigration law, that’s the point, how will Government control costs if it has no way to control access.

sixth, one, five and ten years out is too late because the fence will have been built and the mass has become dependent, look at the UK do they ever argue about eliminating the NHS?

Seventh, Opportunity cost, the Government is one big opportunity cost, the Government consumes it does not create capital.

Therefore, I see way too many problems with this, once executed there is no turning back, we’re finished as an free society. How, because once government pays, it will demand controlling your choices to keep costs lower, that includes the food you eat and the lifestyle you lead.

Excellent! nt

that authorize Congress to tax me to pay for someone else’s “health care,” I thought it might helpful to provides some quotes and observations from our American heritage about Liberty and Necessity that one might deem relevant to the debate over the “necessity” of “health care reform.”

“‘Necessity’ is the plea for every infringement of human liberty; it is the argument of tyrants; it is the creed of slaves.” William Pitt

“Experience should teach us to me most on our guard to protect Liberty when the government’s purposes are beneficent. Men born to freedom are naturally alert to repel invasion of their liberty by evil minded rulers. The greatest dangers to liberty lurk in insidious encroachment by men of zeal — well-meaning but without understanding.” – Justice Louis Brandeis, dissenting, Olmstead v. U.S., 277 U.S. 438 (1928)

Liberty exists in proportion to wholesome restraint; the more restraint on others to keep off from us, the more liberty we have. — Daniel Webster, Speech, Charleston, S.C., May 10, 1847.

Liberty and good government do not exclude each other; and there are excellent reasons why they should go together. Liberty is not a means to a higher end. It is itself the highest political end. — Lord Acton, The History of Freedom in Antiquity (1877).

“Extremism in the defense of Liberty is no vice. And let me remind you that moderation in the pursuit of Justice is no virtue. — Senator Barry Goldwater, July 14, 1964.

We have a Statue of Liberty, not a Statue of Necessity.

We have a Liberty Bell, not a Necessity Bell.

2>What is the magnitude?
3>What are the big problem areas(i.e. the areas where maximum benefits can be realized)?
4>Define goals (short term – easy ones, medium term – , long term)..

This was my first comment… not sure where the insult is. I assure you, it was not my intention.

“My concern is that requiring doctors to run point on screening patients citizenship status is unrealistic, inefficient, and ultimately inconsequential.

I agree that enforcement of illegal immigration has been made via token gestures at best, and that the onus continues to be handed off again and again, from employers to other civil service institution, etc., but I don’t believe health care professionals are a viable alternative for the reasons I stated above.”

Yeah...that has nothing to do with what I replied to...

Why are you coming here today pushing so hard to attack the Republican who spoke the truth, and defend the lying, weasly Democrat?

Personally, i commend Rep Wilson for what he did. You see. I happen to believe that Obama and his speechwriters and advisors knew exactly what they were doing. I believe they knew full well what the expectations were for the congressmen sitting in the seats. I believe that they wanted to used the expected civility to try to push an agenda with a speech filled with lies. And if a president can get up and blatently lie to congressmen and not get a negative response, how will the people watching at home take that non action? Imagine if the town halls were nothing but people clapping when they agreed and sitting there when they disagreed? Unfortunatly, the President believed he could exploit the situation to throw out blatant lies without a negative response. Knowing full well that the majority of the people in the crowd would clap and give the appearance that what he was saying was actually the truth. I believe that we had a president attempt to mislead the public on the greatest stage available to him. His only problem. Rep Joe Wilson snapped. Much like the people in the townhalls.

Illegals are NOT fully excluded in HR3200

JLenardDetroit (Diary) Friday, September 11th at 4:21PM EST (link)

you stated

The legislation, in fact, specifically excludes illegal aliens from coverage.

which is only partly the case:

that is exactly the SubSection Dem’s hang their lie on
JLenardDetroit Thursday, September 10th at 1:58PM EDT (LINK)

from: HC Townhall: Like Hollywood, Democrats used new Actors to replay the same Script.. They tie their lie to some “limited” provision within HR3200 to give it a “grain of truth” anchor to tell the biggest whoppers.

Pulbic Option to Cover Illegal Aliens

Following Obamas 9/9/9 (666 upside down) speech, Rush Limbaugh and others have to keep correcting the record of all the…. to be charitable we’ll say…. un-truthes as it pertains to Obamas promises and what is ACTUALLY IN the only HC Bill in Consideration (HR3200). Gary Peters, as discussed in this Diary Townhall, as basically all other Democrats’ Townhalls using the approved Talking Points covered the Illegal Aliens distortion (read: LIE) in the following manner:

Gary took it one further, and accidentally gave away specifically, the Lie on one of his Slides he showed. The Fact is that Illegal Aliens (non US Citizens, non-Residents) are mentioned several places in the Bill but the key to the Democrat Dodge is in one SUBsection of the Bill dealing with “AFFORDABILITY CREDITS” that would allow persons to receive Tax Credits for their own PRIVATE COVERAGE… which Democrats DO NOT WANT people to have… it specifically says that “Illegals shall be excluded from eligibility to receive ‘Affordability Credits’” AND THAT IS IT…. The truth is right in the statement Peters showed… it is LIMITED to dealing solely with “Affordability Credits” and Illegal Aliens WILL BE COVERED BY THE PUBLIC OPTION PLAN and excluded from all others (unless they want to pay for the plans themselves w/o the Credits).

The Facts/Truth are in the Bill and even the Democrats are showing you the truth while trying to imply it means something beyond what they just showed you and you just read….. YOU HAVE TO COMPLETELY PARSE THEIR SENTENCES TO FIND THE TRUTH!!!

I saw yours and thought it was worth mentioning in more “generic” terms versus your more direct technical reference (we all know they haven’t, and won’t, read any of HR 3200 ;-) lol) but probably should’ve done so as a response to your comment. The point, of course, is we all (that is, those of us paying any real attention) know the Democrat Talking Points DISTORTIONS and why there can be, and are, so many blogs on the topic.Joe got it 100% right, THEY LIE – premediated and with malice of fore-thought in so doing!!!! The Politically Brain-dead are woefully uninformed and more than happy to remain that way, comfortable in their Liberal Laziness! The Bill is, also of course, purposefully over-complicated to try and keep the idiots from paying any attention.

Keep up the good work… lots of places to keep covering these things and we have to keep repeating the truth so it is everywhere, in each and every case/example, for all to see.

Guess you can add to your quote, if this passes, you can get Vouchers for Cars or Health Insurance, but not Schools ;-) lol

Great Britain Parliament style all out shouting match every time congress meets.

Those guys have all the “Hear, hear!” Boo, etc built into their style.

BO wouldn’t know how to deal with a congress that could actually hiss at him and get away with it because John McLame didn’t feel it was improper.

Pelosi would never be able to speak in front of the entire house because the conservatives would be heckling her constantly.

I want that on CSPAN now.

Keep up the good work Sam Graves (R, MO-6)

There is a time and place for everything. If Wilson wished to call the President a liar he could have done so in a post-speech interview, and just the use of the words “lie” or “liar” would have been plenty provocative enough.

It would have gotten him plenty of attention. It would have shed light on this issue, which was very smoky, at best. And it would have still worked Pelosi and Co. into a lather.

But he shouldn’t have done it during the speech itself. It was poor.

That being said, I would have done no better, particularly when Obama laid a whopper with the claim that the deficit woud not be increased by a single dime. Obama had to be snickering himself when he said that one.

As it is, this is much ado about nothing. Wilson fell over himself apologizing. His opponent raised a bunch of money (almost all from outside his district) that won’t help him win. And by next week, this will be old news.
