A tea party to protest government spending and taxing is canceled. Canceled by the government.
Why? They feel too many people could show-up.
Lynn Rosko planned to hold a tax payer tea party at Jaycee Park in Cape Coral on April 1st. The idea was announced at a Cape Coral City Council meeting, then an e-mail blast by the Republican Party and it was mentioned in the local media.
With all of that attention, the City of Cape Coral felt there could be more than 500 people attending the tea party.
The government is parodying itself. You know, I’ve never been a big fan of that old Thomas Jefferson quote about the tree of liberty, but dammit perhaps he’s right and we should start with the Cape Coral City Council:
The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.
No, don’t go do bodily harm to the City Council. Show up at their next meeting — everyone who intended to take part at the tea party, take it to City Council at their next meeting. It’s not like they can shut the public out of their events.

I’ve often thought that the problem with American governance is at the local level – everyone knows what the feds are doing (they’ve got 300+ million eyeballs on them), people are vaguely aware what the state gov’t is up to (though less so in places like CA, NY & IL), but very few people have any idea what’s going on locally (not enough info, which I think is part of the plan of the local pols).
As a result, the localities are where the shenanigans really seem to happen.
Ditto...much as I hate that phrase.

Not by anything so overt as having extensive “Executive Sessions”, but by a meeting format that requires citizens who wish to speak on a subject to sign up in advance to speak. Limit the number of available spots, arrange the agenda so the point of interest to the citizens is far down the list, provide uncomfortable seating, and you can be assured that most citizens will not bother.
I’ve sat more then once through Town Council meetings, name on the list, for hours and hours, while everything except my issue was talked to death. Suddenly, when all the arranged BS was about done, Council would declare that it was very late, it was, and the need to further discuss “important” issues must continue at a later date, to be announced.
The “process” of even small town government is every bit as staged and corrupt anymore as what the Big Boys do in D. C.

First, they have local elections on the first Tuesday after the third Monday after the second three-quarter moon if the moon is in Aquarius – or some date like that that only public employees and people with their hooves in the trough know about. Second, Democrats have lots of un or under employed people who love to testify about everything so they can make any municipal assembly meeting excrutiatingly long and boring; so long that people who actually have to work for a living can’t stay until the end.
Really, there’s very little that they have a legal right to close a meeting over and in most states they have to publicly annouce the purpose of the closed meeting or “executive session,” but then nothing’s illegal if nobody complains.

In Austin, Texas to get the Save Our Springs ordinance passed, the greenies showed up to meeting after meeting, with sleeping bags prepared to wait all night. It takes persistence.
Most Cities have ordinances regarding when the City Council can go into executive session. If it seems this is being abused, have an attorney file a lawsuit.
Instead of just saying “Oh its so hard,” “Oh they have so many rules to keep us out” keep fighting. Don’t just go away quietly like they want you to. Use the rules against them. Stick with it. Good god, we are Republicans. We don’t expect things to be easy and handed to us. Act like the party of personal responsibility.

It’s ironic, I have been carrying on a conversation with Saul Anuzis over his efforts to engage the grassroots of the party (click here), and we have the Tea Party movement struggling to survive. Where is the party? Not where they should be that’s for sure.
Saul seems to think hobnobbing with a few RNC members, "politicos", consultants and a blast here and there on their grassroots email list, asking for donations, is enough "engagement" by the party elite with their grassroots. Besides, the corporate leaders of our party aren’t really interested in funding tea parties. It’s not part of their political agenda.
No, if we want our government back, we are going to have to do it without Saul Ansuiz and company.

If the gathering is a lawful exercise of freedom of speech, why are conservatives reluctant to exercise our rights to the courts to enforce our rights? If our answer is to complain and “march on the town council”, then our rights will continue to be eroded.
That’s why we have a constitution and the courts. Not using them is tantamount to cutting of our arms.

They can’t afford to go to jail and nothing has come along that has given the right a dedicated enough cohort of activists, or the support system for them, that would allow people to engage in real civil disobedience, get arrested, and take the court cases up. The downside is that even if there are such people, the media will never cover a bunch of white, suburban white collar types or knuckle-dragging tradesmen getting put in jail, nothing to see there unless the protesters have long hair, wierd clothes, or are of a fashionable race or ethnicity.

Homeschoolers are great at this, we know what the person in the office needs to see or hear and we present it.
At least homeschooling I’ve found most of these type are doing their job until 4:30. We have to present what they need to see to stamp it and go to lunch, if we can’t comply then we take it up with someone higher, not the receptionist or admin assistant. That is where I’ve seen most homeschoolers that have problems with the actual school district, they didn’t play the paper trail game correctly and they tried to battle it out wtih the wrong person.
Is this man stopping it just doing this job until 4:30? The wrong here was when this law became a law.

randy streu (Diary) Sunday, March 29th at 1:40PM EST (link)I think we all recognize that this sort of thinking cannot continue. Freedom for one — or 500 — is freedom for all. Tyranny against a group of us is tyranny against all of us. That in mind, here is my recommendation:
Get the daytime phone numbers, if possible, for the members of the council who voted to cancel the protest. And PASS THOSE NUMBERS OUT. Get fax numbers and email addresses too, and for the Parks Commission as well. Pass these numbers out to everybody, and select a time — say 10am — for everybody to start calling, emailing and faxing. Flood the office, and the personal/work phones of the city council members, with these calls, emails and faxes telling them they CANNOT rescind the First Amendment.
Is it harrassment? Damn right it is. Do they deserve the chance to do things right before we begin a harrassment campaign? Nope. They had one. It was written into the founding documents of our nation. When they knowingly disregard it, as they are doing now, it is an offense against their own people. They have already, in effect been told “no.”
When a dog continues to disobey after the “no,” it gets smacked with a newspaper. A harrassment campaing is one hell of a big newspaper, and I think, just what the doctor ordered. People, like this city council, who are predisposed to disregarding our natural rights, need a show of strength and resolve. They need to know that the people they work for outnumber them. By a lot. And they (and anyone else who thinks a little bit of power makes them above the Law) need to understand that their countrymen — regardless of state, or voting district — will not tolerate tyranny.
Further, I say, regardless of outcome, everybody should show up anyway. The originator of that area’s tea party has rescinded responsibility, so as of now, it is no longer an organized protest — just a bunch of people showing up at the park with signs.

Is there any compromise gesture your committee would be willing to offer to the organizer of the subject (now-cancelled) event in order that they may exercise their constitutionally guaranteed right of peacable assembly?
If the issue is the place of assembly, mightn’t there be another place substituted? This could be offered through your council or the Office of the Mayor. Many see the issue of insurance as an excuse to disallow a group who are unhappy with taxation to air their greivances in a peaceful, orderly fashion.
Hundreds of communities across America have been host to these gatherings which are a token and a sign of the people feeling free to express their political views without being unduly restricted by the government.
All I am asking is that some consideration be given to avert the disaffection from your electorate that must surely follow such overweening bureauocracy.
These are not Klansmen, Neonazis or anything approaching that. These are your friends and your neighbors. Please think again.

johnnychimpo Sunday, March 29th at 1:42PM EST (link)I realize it’s easy for me to suggest, not being in Florida, but isn’t the whole idea that we’re trying to send a message that we’re not going to stand for overreaching by government, whether it’s taxes or curtailing our individual freedoms (such as the freedom to assemble, to petition the government, etc)?
If we’re really serious about these Tea Parties, and about getting our message out there, wouldn’t it follow that we wouldn’t let the city’s demand for a permit stop us? And again, I realize it’s easier said then done, but at some point we need to take a stand. Show the local government that we don’t recognize their authority to take away our Constitutional right to assemble, and that we don’t need a permit to do so. It is our right, under the laws of this country, and we’re going to show up and protest anyway, permit or not, insurance or not.

CALL IT A “PATRIOTS NIGHT OUT DOWNTOWN” or whatever, a non-officially organized event that is promoted so as to PROMOTE YOUR LOCAL BUSINESSES and make the Tea Party point on the side!
If a couple 100 or 1,000 people all show up in the same general place… then fan out and get in nice polite lines outside on the sidewalks to “get-in” to the local restaurants (that won’t be able to seat them all at once) are the Cops going to demand that they cannot wait in line to eat!?!?!? Overwhelm the local Eateries and be prepared to PATRONIZE THEM and to be patient waiting outside to do so! If you don’t want to Buy A T-Shirt (I’m sure tons of places are selling T-Shirts and such), just print something out on a 8.5×11 paper (sign tips) and double-side tape it to you front and back (or Buy Buttons to wear), carry a small 4th of July sized waving Flag (4″x6″ Gadsden, 4×6″ Culpepper, and more) which you should be able to find in many stores (Dollar stores usually have a few around), simple things that will work to make your point and NOT require a Permit.

Many of the policies now being used to ban these tea parties were instated to combat lefty protests during the “good ole days” . Now theyve been getting in their way for almost 50 years, now when we protest were surprised to find these road blocks in our way. I suggest ignoring them.. Lets get grass roots people seriously.
-Make the tea parties on weekends so people can show up on short notice.
-Create phone trees to be used locally to notify people where to go and when to show up
- if asked by anyone (government employees of any kind especially) why you showed up just say I planned my own 1 person personal protest and STICK TO IT!!!
-This would be optional but to make a point it would do a lot. Anyone who can afford to be, should be arrested. That is, when the police show up to bust up your protest that isnt permitted some people can make a huge stink saying how they have a right to assemble. If you have a right to do something you should hardly have to get a permit to do it. And if you do have to get it a permit it should hardly be this cumbersome. Then those people need to refuse to leave and eventually get arrested for disorderly conduct or some such charge. These people would likely be retirees, independent business owners who can afford the publicity, or may be helped by it, college students etc.
-If we are going to be serious about this civil disobedience of some sort will have to come into play.

Geez just get the permit. Parks departments have legit reasons for controlling the uses in parks. And having a 500+ crowd seems like a situation the Parks dept would like to have some control over. Per the article the dept is quite willing to work with the group.
As far as the insurance requirement goes most large groups are required to have it in a park. This includes things such as soccer tourneys, large wedding parties or concerts. Bad things sometimes happen when large groups of people gather at organized event, even with the best of intentions. And a municipality is rightly concerned with it’s liability exposure .
Asked another way if you’re a resident of Coral Cape and someone gets injured at the tea party (or soccer tourney or wedding or concert) do you want your city to be on the hook for a lawsuit?

Don’t have to do it a park. Meet someone’s house. Meet at a Legion hall. Meet on the property of a business that supports the cause. None of those situations require a permit or insurance.
It’s not the use or the cause that’s in question. It’s the place. And see my follow up. This park doesn’t have the facilities to magically dump 500+ without some planning. The parking issue alone raises all kinds of liability for the city if it allows 500+.

By my count there are approx 17 parking spaces in the park, certainly no more than 40 (if that’s a lot hidden in the trees next to the water). The large lots to the south appear to be private lots for apartments/condos. It also looks like there is no on street parking near by (didn’t see any parking in the aerial).
The info from the park web site lists a restroom but from the Google aerial it looks like there can’t be more than one. It’ll be pretty messy if 500 people have to park off site, hoof to the park and then are stuck with 3 fixtures on a side.

I know this often keeps homeschool groups from meeting/forming, the parents can’t afford liability insurance. It’s ridiculous, some can’t even meet at a church they pay tithes too because of the insurance requirement.

For instance in my town a special use permit in the parks is required if you exceed the capacity of a site or want to have an event in area that isn’t “reservable”. In these cases it’s more of way to put the dept on notice that a big event will be happening and a way to control the size of it if it gets out of control (think parties hosted by college kids). The liability issue arises when the city sees an issue that is outside the norm that they want to have coverage from a possible lawsuit.

Surely, we don’t want someone to get hurt during these protests. The point is to tell the government overspending is wrong, not to see how much trouble we can cause.
I see it is back on. How did they manage it? It would be nice to know for future reference because these problems are going to keep cropping up. Keep a manual of what to do will make planning and organizing easier next time. You know, so we aren’t surprised at the red tape and have some knowledge of how to navigate it.

A 2mil policy for example, required in my town for special events in a park, isn’t really that expensive for a big group. A couple grand I think.

As I understand it, and I ain’t a lawyer, those forms that are signed saying you can’t hold a party responsible for injury are basically useless. It’s more of a thing to hold up in court to show an organization has done the minimum to warn people that what they are doing has a risk. But, as I understand, it doesn’t offer much liability protection.
The parking thing is a really a big liability for the city. Suppose the city says “Great, have you 500 person event at a park with parking for 80 people”. Then Ralph goes, has to park along a busy street a mile away and gets run over on the way back. The grieving widow sues the city because it knowing allowed a large event at a park that can’t handle the crowd. How many zeros will be on the end of that check is anybody’s guess. But if the city requires insurance they’re at least partly covered.
