I’m glad we are on the same team though.

While the senate does not have the legal right to adjust “qualifications” to prevent Burris from being seated, legal experts say the Senate DOES have the right to look into whether a senator’s election or appointment was valid and lawful.

According to an article in the LA Times:

“It’s true the Senate cannot add qualifications, but it has to recognize an election or a selection as valid,” said Trevor Potter, a Washington lawyer and former chairman of the Federal Election Commission. “If it has questions about that, such as after a contested election and a recount, the senators can delay a decision on seating and defer the issue to a committee.”

In Wednesday’s letter to Blagojevich, the Senate Democrats warned the governor against choosing a new senator, but they did not flatly refuse to seat such an appointee.

“Please understand that should you decide to ignore [our] request . . . we would be forced to exercise our constitutional authority under Article I, Section 5, to determine whether such a person should be seated,” the letter said.

This provision is the one the Supreme Court described in 1969 as having a narrow scope. It says: “Each house shall be the judge of the elections, returns and qualifications of its own members.”

As it stands, ALL of the democratic senators have said they will refuse to seat Burris. After that, the best hope Burris has of maintaining his appointment would be to go to court and challenge the decision as unconstitutional.

At that point, it will be a matter of how much money Burris wants to spend to claim a seat in the senate where he is clearly unwelcomed to represent the people of Chicago, who have repeatedly refused to elect him.

He lost elections at specific points in time…period.

This is about the people of my state not wanting a crook to appoint the next US Senator of our state.

We lost the edge in that battle because the elected acted like wussies and didn’t act fast enough.

Because of that, we now have a appointment of a qualified person, made by a scumbag Gov, but done legally and within his right.

Now that real fight begins

He was beaten in elections….it remains to be see if it will happen with an appointment…

He was beaten SOUNDLY… EVERY time…

Do you honestly believe the people of Chicago are going to be happy with having Roland Burris (a man they consistantly refuse to elect) forced upon them by a man who is humiliating them on a daily basis… especially after Blagojavich stated he would allowthem to decide for themselves in a special election?

It’s funny, the silliest of all in this was Lisa Madigan trying from the outset to get him declared “unfit”…as it turns out, that was the best chance to block this!

all 50 democratic senators have said they will refuse to seat him.

That’s 51 people on record so far and it has only been a few hours.

No one will attack RB….however, I do think that since the race card was thrown down, any attempt to NOT SEAT RB will be dealt with in the light of race….period.

Brilliant move …scumbaggary, but brilliant.

It’s a statement of unequivocal fact, published by them and promulgated by the Washington Post.

If Burris is seated, all of those people are simply grandiose public liars.

All we have to do is sit back and watch.

“We say this without prejudice toward Roland Burris’s ability, and we respect his years of public service. But this is not about Mr. Burris; it is about the integrity of a governor accused of attempting to sell this United States Senate seat. Under these circumstances, anyone appointed by Gov. Blagojevich cannot be an effective representative of the people of Illinois and, as we have said, will not be seated by the Democratic Caucus.“

If they seat Burris, they’ve all just admitted in the pages of the Washington Post that every single one of them is a liar, on the public record.

Now, we can imagine scenarios where everyone mentioned in that article being demonstrated as a liar to the public, in the press, in the pages of a newspaper favorable to Liberals, would not matter.

But if that’s the point we’ve reached before this next President and Congress even take office, there’s not much left to speak of in terms of this Republic anyway.
