Her lies show that Sotomayor knows the truth


Unwilling to have her views judged, she borrows Scalia's views for a week.

Not even Solomon, Cicero, and Daniel Webster all rolled into one could hope to equal the towering edifice, the virtual Mount Everest of discretion, discernment, judicial restraint and acumen, the champion of the law, the sister of stare decisis, the faithful servant of the Constitution that is Sonia Sotomayor.

At least as she describes herself in front of the Judiciary committee. My, my, we couldn’t even get Roberts and Alito to speak so approvingly of the text of the Constitution.

This thing, this odd juxtaposition happens for obvious reasons, of course. An actual originalist judge nominated by a Republican president must appear as moderate as possible — i.e., NOT faithful to the Constitution — in order to get past leftist Democrats who know they are misrepresenting themselves. They generally do it by rope-a-dope, dodging questions and delivering carefully worded answers that present as small a target area as possible.

An actual left-wing activist judge nominated by a Democrat president, on the other hand, will hug and kiss the Constitution like it was Suzy Kolber, loudly proclaiming that it is their life’s mission to protect the letter and meaning, executing justice without regard to race or creed. Guns? Got 7 myself! Creating laws out of whole cloth? Bad! Bad! Not me, brother!

You see, they don’t tap-dance to avoid admitting their activist ways. They just lie. They deny what they know is true. They tell big, fat, honking lies. All in order to secure the grudging indulgence of Republicans who know the nominee is lying like Joe Biden. It’s a curious sport, but there it is.

Sonia Sotomayor’s lies are particularly amusing because she has a lengthy and public history of indiscreetly and happily blathering about her activist viewpoints to anybody that would listen. And they are most particularly shameful because her self-portrait could only be that grand if she actually knew what her actual duty to the Constitution was. She clearly knows.

All the more damning.

Sotomayor has virtually no fear of having her nomination defeated. Honestly, she could kiss Pat Leahy on the lips and grab John Cornyn’s rear while singing “Look for the Union Label” and not fail to get voted out of the Judiciary Committee. So why would she choose to describe herself in a way that must be repugnant to her? Why would she say things she clearly, obviously does not mean?

It is pride.

This is a woman who, like so many leftists, knows that what she does is wrong, but doesn’t want to be called on it. She won’t admit that she judges racial issues with her sentiment and not the law, because doing so exposes her fraud. She won’t admit that she considers her position a free ticket to write government policy, because she does not want to be told that it’s wrong. Judicial activism is indefensible, and she knows it.

It is the lie that reveals that she knows what the truth is.

And I wondered why I shouted “Liar” at the nominee’s ‘rhetorical flourish’ testimony on last night’s news round-up! A rhetorical flourish she characterized as ‘falling flat…just bad’, was so flat and so bad she just had to repeat the performance 5 or 6 more times! LIAR! She’s a bald-faced, unapologetic, straight-faced liar, and since she’s formally testifying, I suspect now a perjurer! Therefore, my Republican Senators, let’s vote to confirm her! Deference, you know….

But I am deeply entrenched in the “what goes around, comes around” camp of revanchist Republican warfare against Democrats. So screw her and her rights.

If I am to understand right, there is a long-standing Senate rule that at least 1 opposite-party committee member must vote ‘yes’ to get her out of committee. For decades that vote was guaranteed to be provided by noted charlie-sierra Arlen Specter.

Is this correct? Or close?

What they did to Miguel Estrada (and many others) means I give her no quarter. None at all.

[My understanding is that the senate's rules allow the majority can at least bring tie committee votes to the floor (and even those that lose the committee vote), but I could be wrong.]

Estrada, as I understand it, was denied a floor vote by the then democratic majority.

The Senate may exercise its advise and consent function by doing nothing. There is no requirement of a floor vote, but I do accept the precedent of the Gang of 14 compromise to only filibuster and deny a floor vote for “extraordinary circumstances.”

And given that most of the legal community accepts the liberal living constitution activist theory of judicial interpretation as mainstream (though less so than it was 20 years ago before Bork and the Fed-Soc movement), we can’t say Soto is extraordinarily unacceptable.

Now, to me, such a judicial philosophy is anathema to the Oath and grounds for Impeachment, much less not a grounds to vote against her.

But, no matter if we did defeat her or cause her nomination to be pulled, the replacement would be a stealth nominee that would vote the same on the court.

I do wish she would be defeated on a floor vote, but given the balance of the court and my long desired hope that Americans could finally become educated on how vile are the democrats on judges, I think the best chance we have is what we are doing now in the hearing and for her to be barely voted in with dem votes and for her to be hung around the dems’ necks in 2010 and 2012, complete with ads and sound bites.

Also, I concur that if she’s defeated, the next one will be both more leftist and more sinister, and almost certainly an even *less* desirable person for the Court.

So we bloody her terribly, oppose strenuously, and make a mockery of her obvious bigotry and activism, making sure we make the connection that *this* is what Democrats think the courts should be like.

But ultimately, she passes.

that will denounce her views but then vote for her due to the old “elections have consequences” old- Hatch strategy, as if the election of Republicans to the advise and consent senate have no consequences and that Oaths mean nothing.

I am sure Hatch and most of the GOP will not repeat the past, but not sure how big will be our vote against her. It needs to be huge.

Soto is overweight and 55. She is not the picture of helath. She has been a type one diabetic for 50 years. She’s already outlived her actuarily adjusted life expectancy. There is a good chance that if Obama is defeated in 2012 and the next Republican president has two terms, that president might get to replace her. The next one probably will be a much more younger and healthier radical who could be on the bench for 40 years. Playing hardball isnt nice, but necessary.

“Sotomayor Hits Back Hard at Racial Charges”

I’d stake a year’s pay on the bet that if this had been a Republican nominee the headline would have read:

“GOP Nominee Hammered for Racist Remarks”

What a joke.

On the Money, EPU

This morning she was asked if, from a philosophical standpoint, she believed that a person had a right to self-defense. It was in the context of discussing the Second Amendment. The question was framed three or four ways, and the intent of the question was clear. She refused to answer, saying in essence that she would have to know the specific circumstances extant and the specific laws of the state in which the situation had evolved. She was repeatedly admonished that she was being asked to articulate her philosophical view, not to comment on a particular case.

Her refusal to answer was clearly an answer, and clearly an attempt to avoid a situation where she would have to lie so blatantly that it could not be ignored.

You are right. She is a liar, and if I understand you correctly, you are also right in that it could easily be much worse.

As with Republican response to other bricks in Obama’s statist wall, even though we cannot ultimately stop anything, it is important that we remain the party of “no”. For the time will come when we will have to answer for it if we do not.

You never never never actually need a gun, until you need a gun, and then nothing else will do.
