I don’t like the way the Governor and her administration dealt with this; some of it was astoundingly naive and hamfisted, especially Bailey’s stupid call to a listed State Trooper number – NEWS FLASH: they’re all monitored and taped!
I think every political manager/executive I ever worked for had a list of people they wanted to see gone, God knows I had one! If a governor had told me he/she wanted a Trooper gone, I’d have looked at the facts and either told the Gov it couldn’t be done unless the Trooper committed another bad act or that Trooper would have been gone; the press would never have heard a word of it and if the union grieved at all, it would have been a duty of fair representation grievance. But, that’s spilt milk.
When the Council announced they were going to investigate it, I emailed Elton – he’s my senator after all – and told him I’d do it and do it quick and cheap. Even though I’m a Republican, it is pretty well known that Gov. Palin and I don’t have a mutual admiration society going. I’m far and away the most qualified person outside the government (inside too, but that’s a little egotistical) to do it. Elton quickly got back rather dismissively, so I knew then that their agenda wasn’t just finding out what happened and if any rules or laws were broken.
As it turns out, they couldn’t find anything. The “personal gain” peice of the ethics law is so nebulous that you can make of it what you want, at most it is an administrative violation. Hell, doing something inside the government that makes you feel good is arguably a personal gain. Not that it will matter for the election, but this “investigation” doesn’t mean anything. The Leg has essentially no power over the Executive. If Branchflower is really certain that Gov. Palin won’t be Vice-President Palin next month, he can make a complaint to the Attorney General or the Personnel Board. Only their finding has any force of law. I’m thinking Branchflower takes his hundred grand and hustles his Democrat a$$ back to South Carolina (GC, could you look into that?) and nothing more comes of this here. Of course, tomorrow the MSM will be full how how abusive of power the hick that didn’t go to an Ivy League school is. I thought only really smart people could abuse power.
BTW, I’d have done it for $25K and given them a better product. The figure is chosen because I could do it in my sleep and I really, really want $25K in unattached cash, at least unattached to my wife, so I can buy new engines for my boat. Thus are great events determined.

If Branchflower, the investigator, or Sen. Elton wants to actually do something about it, they have to make a complaint under the Ethics Act to the AG and the Personnel Board. I cannot defend the Governor nor her staff for how they mishandled the firing, waiting three days to offer an explanation to the public why, but that’s about it.
She did not break ANY law. Alaska’s Public Safety Commissioner serves at the pleasure of the Governor. I’d ask what kind of “Public Safety” Commissioner he was, allowing for an abusive/alcoholic and death-threatening state trooper to remain on the job (regardless of his relationship to the Palins).

If you have executive authority, you do what you think you have the right to do. Somebody doesn’t like what you did, so they sue you. Maybe the judge agrees with you, maybe she doesn’t. If you lose, you take it up to the next court. Maybe your opponent runs out of money or interest. Maybe you lose interest. It is simply the way that you find out what rights and powers you have and what laws mean. If you’re John Q. Citizen, getting your name on a lawsuit is a life-changing event. If you’re a policy level government executive, the lawsuits are just a part of your morning reading.
I’d have never gotten myself into this mess, but IF the Legislature had served me with a subpoena, I’d have has some choice comments on their ancestry and sexual proclivties and ignored it unless they could attach a Supreme Court decision to it.

They don’t even deserve to be considered as “human”. My sister and aunt were victims of abusive men. It’s too personal for me.
When I heard that Monegan has had a history of domestic violence, I am so appalled. Monegan should have never been given a chance to serve the Government despite his potential (or the lack thereof) capabilities.
Sarah Palin should have not retained Monegan to power since Day 1. I am furious with the previous administration of giving this man a position in the Government.
Psychiatrists all agree that “men guilty of domestic violence” will always be emotionally and mentally unstable and have proclivities to lies and deceit.
For me, Achance, it’s not ethics. There’s a moral obligation for the Alaskan Legislature to never put itself at the side of abusive men, especially in this case when Monegan has also a serious “insubordination” issue.
My read:
It’s Monegan who is guilty of abuse of his authority by trying to force the Governor to approve his project outside of his department; going to DC with no proper representation is a grave abuse of power to me. By adding the issue of domestic violence, this is indeed a mistake of the Alaskan Legislature.
Now for Alaskan people, I hate to see you all tolerating (and putting to office) a person with history of domestic violence…whether rehabilitated or not. It’s a mental illness with lifetime chance of recurrence.

I know I’d have given the COS the two word speech.
The bottom line is that there’s only one reasonably well-paying top cop job in Alaska, the Commissioner of Public Safety, that is Republican controlled and Monegan got fired from it. He’d already been fired or pushed out of the Anchorage Police Chief job, now in Democrat hands. If he wants to work here at anything like his former glory, he has to ingratiate himself to Democrats and cop unions. So, he snuggled up with John Cyr of the Troopers’ union and did a great service for the Democrats and is now hoping to be rewarded with some sort of sinecure in an Obama administration. The head federal Marshall here is a political appointment and has a history of going to people from the AST who have done a great service.

Under Alaska law, a woman’s naked assertion that she is fearful of a man is enough to get a domestic violence restraining order, commonly called a DV Writ, against the man. It’s not legally any sort of conviction and it goes away after 20 days if you stay away from her, but it is on your record and will get dragged out by your enemies for the rest of your life.
Divorce lawyers being the scum of the Earth, most complaints for divorce are accompanied by a DV Writ and quite commonly by an allegation that all the minor children are being molested. Unfortunately, the State doesn’t have an office where you go to get your reputation back.

Technically and legally, MONEGAN RESIGNED. The word “fired” in the investigative report was WRONG.
But when a political opportunity to get revenge came, Monegan grabbed it. That’s the reason I have no respect for Monegan.
Lyda Greene and the rest of Republicans’ participation in this case is appalling. I have lost my respect to Alaskan Republicans.

This is public record, nobody including Palin denies that Monegan was removed as commissioner. I’d say removed is a pretty good synonym for fired. Yes, he was offered a job with much less status which he declined.

In many papers today the titles read: “Palin Abused Governor Power” and that sadly enough is not going to help us and only bring up more negative press

Yes, the 20 day no contact DV Writ
Achance (Diary) Saturday, October 11th at 12:43PM EST (link)is ex parte. The woman, or increasingly the kid, just shows up in front of the judge usually with divorce lawyer or “women’s issues advocate” in tow, mumbles something about being afraid and the Writ is issued.
They’re a real issue in law enforcement. Federal law says that you can’t carry a weapon when you’re under a domestic violence order. That kinda makes it hard for cops to work.
We made a general practice of ignoring the ex parte orders against Troopers, COs, and other gun toters because the things are so often just a divorce lawyer’s tactics or a teenager angry because dad wouldn’t let her pierce her tongue.
Only if the gun toter was actually charged with assault or the next level of writ, can’t remember what it’s called, issued by a judge after a hearing where the accused has counsel did we take his gun away, which ulitimately takes away his livelihood – usually the result the divorce attorney intended.
It might be obvious that I have a bad attitude about Alaska’s DV laws. They do little or nothing to protect women and children from violence and they do a lot to help lawyers make divorcing men miserable or give kids a way to harass their parents for having the audacity to act like parents.
