“Mr. President, I send an unprinted Amendment to the desk, and ask for its immediate consideration,” are the exact words that any U.S. Senator can say when offering this amendment on the floor of the U.S. Senate.
This amendment, below, should be walked down to the floor of the U.S. Senate and voted on prior to any vote on the floor of the U.S. House, in order to prepare the legal battlefield for the court challenge against the Alice-in-Wonderland-like-Red-Queen, Speaker Pelosi, and her dictatorial and unconstitutional scheme to pass the Senate Health Care bill without voting on it. While we are uncertain that we will be fighting on this ground, it is essential to prepare the battlefield, if we do.
This amendment, I am reliably advised, was written by a former judge on the 10th Circuit Court of Appeals who was on President Bush’s short list for the Supreme Court (Roberts beat him out) and is recently retired and is teaching Constitutional law at one of the most prestigious national law schools at University on the west coast.
So, in other words, don’t mess with the language of this amendment. Just launch it, now on whatever bill is now pending on the floor of the U.S. Senate.

Intended to Proposed by Mr. _________.
Viz:
Add at the end of the bill the following new Section:
“Sec.___ . a) Inasmuch as Sections Five and Seven of Article I of the United States Constitution mandate a certain process for the enactment of a federal law and do not allow a measure to become a law by “deeming” it passed by either House of Congress, it is the Sense of the Senate and its judgment that the House of Representatives is required by the Supreme Law of the United States, to vote directly and up or down on H.R. 3590 in order to send that measure lawfully to the President, if, and only if, it shall have been approved by a majority vote of each such House taken on an identical measure; and, more particularly, it is the Sense of the Senate that, in conformity with Article I of the Constitution, the House of Representatives, unless the measure is returned to the Senate with an Amendment by the House, must vote directly on the language sent to it by the Senate precisely as it was duly enrolled at the direction of the Senate by its Enrolling Clerk, certified as an Act of the Senate by the Secretary of the Senate, and thereupon transmitted by the Senate’s Messenger to the House Chamber while the House of Representatives was in actual Session.
b) It is the further Sense of the Senate that the exact words that the Senate caused to be enrolled on parchment and taken by messenger to the House of Representatives, constitute the sole document and the only document upon which Members of the House can lawfully cast their vote, whether Yea or Nay, under the process expressly mandated by the United States Constitution; and it is also the Sense of the Senate and its judgment that to do otherwise by “deeming” rather than voting would void any purported enactment, deprive it of the force of law, justify disobedience to it, and cause irreparable violence and harm to our system of government and its fundamental law through fraud, deception, abuse of power, and usurpation of the civil rights of the People.
c) This Section maybe cited as the “Congressional Voting Rights Resolution.”.

It diminishes the power of the Senate, and particularly with aged senators, that is a big no-no. Conrad NEEDS to get the Cornhusker kickback undone. Voting for the resolution helps him save face with voters in November.
I also note that it is a “sense of the Senate” resolution, which have always been non-binding, so I’m not sure how much influence it has on swing justices. Particularly if the Republicans hold together and some Democrats vote with them, I think those Justices are more likely to see this as a PARTISAN vote than an argument about actual constitutional validity. And after the berating the President gave them at the State of the Union speech, they might take this opportunity to school him and all those who stood and applauded in Constitutional law.

Conservatives object to the constitutional damage, moderates can’t stand that the leaders can’t get along, and the loons can’t abide by the fact that bill hasn’t passed yet. If you have the votes to pass it you pacify the moderates because the bickering stops and they have short memories. If you have the votes to pass it you finally deliver for your base and make them happy. The only ones left standing out in the cold are the conservatives, and if you are Comrade Pelosi or Dingy Harry, you never cared about them in the first place.

Two interesting questions to ponder:
How many people voted N now (against the Republicans) just to keep leadership off their backs so they can vote N on the substantive vote?
How many voted Y now (with the Republicans) just to position themselves for a Y vote later?
I think the answer to question 1 will surpass the answer to question 2.
If you want to hide from Pelosi, voting N on the procedural vote makes absolute sense if you know you are going to vote N on the substantive vote. After all, you wouldn’t want Pelosi to catch on, and voters will forget about this 222-205 if you vote to kill the bill.
Its hard to think of a rationale for voting N/Y unless you merely position yourself to say that I wanted to vote for the Senate bill straight up. I don’t hear anyone in the House praising the Senate bill.

eburke (Diary) Thursday, March 18th at 4:43PM EST (link)If you look at who voted how, there are at least 9 ‘yes’ votes of Dems who voted ‘no’ in November, represent significantly red districts and have, in the last 48 hours, reiterated their firm opposition to the Senate bill (in fact a couple of them just voted ‘no’ in the Budget Committee on Monday)
On the other hand, Lipinski (who is down on whip counts as being a ‘no’ but who I figured was really squishy ’cause he voted yes last time) voted against the rule. Harry Mitchell from AZ was a yes in Nov and voted against the rule.
Look, I recognize with the carrot of pork and patronage and the stick of broken body parts, this will be a struggle to the very end. But the bottom line is that the expectation of party fealty on procedural votes (and that’s what this was) is even *higher* than it is on final votes. That’s why someone like Ike Skelton, who was a ‘no’ in November, and who just firmly reiterated his opposition a couple of days ago, voted for the leadership position on this. He’s the Chairman of the powerful Armed Services Committee and for him to snub the leadership on a leadership vote would have been the ultimate apostasy.
I look at this and am shocked that there were 28 Dems who stepped to the plate and opposed their leadership on a procedural vote which party leaderships *rarely* lose.

Unfortunately for us, the best I can read from this is that there are still too many undecided Dems, not necessarily that there are too many ‘no’ votes, yet. Whatever deadline they set, I think they will keep it alive until they have the votes. However, at some point, this will start wearing thin on everyone.

I understand that the stakes are important; that the carrot of pork and the stick of broken body parts is tough to withstand but the bottom line is that Pelosi is still running uphill.
There are 37 firm no’s; only one no (Kucinich) has announced as a ‘yes’. There are nine no’s from the November vote listed as undecided. Within the ‘undecideds’ are “yes’s” that are part of the Stupak dozen who he says are standing firm. The Dems have to run the table on *all* of them to pass this.
Can they do it? Of course they can. Will they? If they do, let’s not let it be because our side got dispirited and pulled back at the moment the greatest heat needed to be applied. IMHO, that is what this whole last couple of days has been about – creating the appearance of momentum so that wavering Dems will cave and opponents will give up.
I firmly believe that a lot of the yes’s from Nov. purposely moved to ‘undecided’ for the express purpose of declaring ‘for’ the bill in the last days in order to create an illusion of ‘undecideds are breaking for the bill’ which the sycophants in the MSM will then trumpet. It’s frustrating to watch people who daily and rightly rail on the MSM for their lying and total lack of objectivity be sucked into the vortex of that which they know to be filled with filth and lies.

But the fact remains that they’re the ones running uphill not us. They are the masters of lies, subterfuge, misdirection, cheating, you name it. They. Have. No. Morals. I believe that they need to get this to one of two votes so they can pull out the “do you want to be the one that kills this?” card. I believe that to even get it that close, they need to create an aura of inevitability to get the first 7 or 8 to cave so they can then get the last 2 or 3.
I’m just saying “Screw ‘em!” If we lose this, then let’s lose kicking and screaming and punching and gouging right up until they close the vote on Sunday. Let’s not get so caught up in their lies, deceit and utter lack of scruples that we become discouraged and give up the fight before the final blow has been stuck.

For one thing–geography. A Dem from Alabama would be more likely to remain strong than somebody from CA.
For another thing–principle. A pro-lifer would be more likely to stay strong than to cave.
For another thing–fear. A Dem in a close race in a swing district has more to fear than Pelosi and is more likely to vote no and stick to it.

Close bills are often taken to the floor for a vote, even if they don’t have the number they need. What happens is that extreme pressure is exerted on the holdouts until the leadership gets what they want.
Republicans did this on the Medicare Part D vote. According to Wikipedia:

The bottom line here is that even if Stupak got language in the bill that said “No Federal money can ever be used, directly or indirectly to pay for an abortion for any reason.” The language would be redlined out in the next budget bill or “must pass” legislation. It would be included in a clause on military readiness on page 4400.

Not many people, including apparently many at RS, are going to go look and see if they were originally in favor of the bill to start with.
And the sycophantic LSM, as you so aptly noted, keeps cheerleading for them. Bottom line – there’s be 3 no to yes switches; there have been 10 yes to no switches plus the Stupak Dems.
Your count is exactly where mine is – the Dems can only lose 2 more of the 15 – 20 truly understanding and they’re toast. And Mitchell voted against the Slaughter Solution today and he was a yes. Could just be cover but the leadership usually doesn’t take kindly to folks bucking ‘em on procedural votes.
