Trying to Pass the Bill without Voting on it will Rank up with the Nebraska Kickback


Even the Dem supporters and defenders know they are down big in the whip count (this one is from FireDogLake) and even Clive Cook writing in the Financial Times acknowledges that the Dems have lost the war of public opinion:

the line taken by defenders of comprehensive healthcare reform goes like this. Yes, the public opposes the Democrats’ proposals, but it is the process more than the product that voters question.

But when supporters (Cook says he is one) warn the Dems of more process perversion, then you know it’s bad for the Dems:

In the last big push to get reform through, using whatever deals, scams, ruses and parliamentary evasions fall to hand, the public and their concerns are pushed ever more to the periphery of Washington’s vision.

The White House is supporting reconciliation – a procedure that allows the Senate to accept revisions to its bill by simple majority. This defeats the Republican filibuster. It also complicates the parliamentary process, since not all provisions are allowed under reconciliation.

Already beyond abstruse, now in the realm of surreal farce, the debate is thus becoming yet more inward-looking and unintelligible. Can language on abortion be included in a reconciliation measure? (Probably not.) Can the Senate parliamentarian be overruled? (What is the Senate parliamentarian?) All that is missing is a speech in favour of the plan by Groucho Marx. Recovering voters’ respect for the outcome, even assuming the outcome is good, looks an ever more distant prospect.

While the Democrats describe their policies as good, but the process hated, they are busily pouring gasoline on the we-hate-the-process-concerns of the voters and are fixing to get 3rd degree burns all over their body.

Does anyone know why the Dems are trying to pass the bill without voting for it?

Here is why: they do not have the votes to pass it on an up or down vote.

This latest Dem perversion of the process is the same reason they did the Louisiana Purchase and the Nelson Kick-back. They did not have the votes. So they paid off the Senators.

Just like before this Whip Count from The Hill shows they don’t have the votes to win.

So they are trying to pass the bill without voting on it. It is the only way they even have a shot, just a shot, at “passing” it.

There will be court challenges and the case will live on through the fall legally and politically.

Every Member of Congress who voted yes will be reminded of their corruption of the process during their re-election campaign.

Who is surprised the Dems change the rules to attempt (and will fail) to get their way?

They are so arrogant they do it even in the face of massive opposition from likely voters who hate ObamaCare.

Can you see why rational political observers think the Dems have truly lost their minds?

The Dems are like Dr. Jekyll and Mr. Hyde — they need to locked up whenever the words health care reform are mentioned, so they do not do injury to themselves and others, including their voters (you know the people who get to pick if the Dems stay in their job.)

The Slaughter attempt to pass-it-without-voting-on-it will live on in the minds of the voters right up there with the Senator Nelson Kickback, and the Louisiana Purchase.

But the Dems are so blinded by desire to pass ObamaCare, they can’t see it the destruction they are doing to themselves, just like they could not see the backlash from the Ben Nelson Kickback and the Louisiana Purchase.

It does not even give them pause that they do not have the votes. Perhaps that’s a red flag? Not if you are delusional and irrational. It all seems normal to them.

Simply attempting to “pass the bill without voting on it” will cost the Dems the House.

Members of Congress have heard all about the “Cornhusker Kickback,” well just wait until they hear about “passing a bill without voting on it.” These will be dreaded words, sort of like: I voted for it right before I voted against it.

During the election, every Member of Congress will be asked: did you have an up or down vote on the ObamaCare? (Uh, no.) So you tried to pass it without voting for it? And you voted yes?

Toast. They are toast.

The Cornhusker Kickback was ugly, but not really unusual. Stuff like that happens all the time, and it legal. But it was a bigger stage.

“Deeming” such a major bill passed via incorporation could cause a major constitutional crisis. This is unprecedented. This is nuclear.

if Ben Nelson hadn’t caved in Harry Reid’s office on Dec. 19, the Dems would not be where they are today. Ben Nelson would be seen as a principled hero to the right and most people in his state, his wife would have a social life, health care would be defeated and the Dems would be seen as having at least one principled senator. At that point, they could have had more time for the public to forget the August townhalls, the late night votes, the bribes and buy-offs.

But now, mid March, they are in even bigger trouble than before and have repulsed both side more than I thought was possible.

If Obamacare is defeated, it will go down a more damaging way to Dems than any of us could have dreamed up.

Question: do any of you know the legal route that would be required for the Slaughter rule, if it’s used, to be challenged in court? Who brings up the charges, etc.? I have yet to find it explained. Thanks!

that is, the person must have already suffered damage, not merely allege that he would suffer damage at some future point. So I think it more likely that a House member would challenge the Slaughter rule, claiming that he was denied an opportunity to vote on the Senate bill, per Art I, Sec 7 of the Constitution. Since the case inolves the direct interpretation of the Constitution, it should go directly to SCOTUS. It seems highly likely that the requisite four member of SCOTUS would vote to take the case.

and I believe they will, they’d issue an injunction against the bill going to the WH for Obama’s signature. As to how SCOTUS would come down on the case is a whole different question, though it’s hard to believe they’d let this kind of nonsense stand in the passage of a bill of this magnitude when Art I, Sec 7 so clearly requires a vote on the bill.

The Semi-Tax Revolt

I was born in Canada. At the age of six my father moved his family to this country to escape socialism. I am 43 years old, have 25 stents (that’s right, I said 25) in three major heart arteries. I have had four heart attacks since the age of 38. If Obama, Pelsoi, Reid, et al. think I am scared of them, think again. I have defied death four times. In comparison, you are cockroaches to be stepped upon.

You hear that Obama. Come and get me. If your unconstitutional bill passes using the Slaughter Rule (which itself is blatantly unconstitutional) then it is my intention to increase my exemptions on my W4 form to ensure the tax revenue for your bill is denied you until next year and then I may consider paying – may. Am I entitled to the number of exemptions under penalty of perjury? You bet I am – I deem it so.

I hope millions will do the same. I am not going to wait for the Supreme Court to rule ObamaCare unconstitutional. If they do, fine, if they do not, fine. In my mind this is the last proof one needs that nullification (http://tinyurl.com/ya3dc7f and http://tinyurl.com/yls8yxo) is the only option to stop the madness that is Washington DC – REGARDLESS of what the SCOTUS ruling is on ObamaCare. To many other violations of our rights as defined in the Constitution requiring addressing. Only the states can fix this problem now and only if many of them stand together.

Washington, this time you have gone to far. Your tiny brains cannot begin to comprehend the storm that will hit you should you not kill ObamaCare NOW. If clear-headed Democrats still exist in the Congress, then I would HIGHLY recommend that enough of them get together and write a letter to Pelosi telling her exactly where she can put her bill and that they will not, under any circumstances, vote for either the Slaughter Rule OR for ObamaCare. The well has been poisoned and the game is over. Recognize that or go down in history complicit in the destruction of your own party.

Will I pay the tax penalty for underpayment? No, I will not. I deem it true that the penalty is not required of me. I deem the President and any liberal who votes for the Slaughter rule or for ObamaCare unfit for office and a traitor to this country.

I think they’d use brownshirts if that’s what it took to get this debacle through. It’s going to pass, somehow; there’s no doubt in my mind. I realize they’re all in on this, but this latest deadline just indicates to me that it’s just a matter of time and bribes before they call the vote. Hopefully it can be challenged on legal grounds.

Obama is headed to Ohio to say that the campaign is over to say that everything that needs to be said has already been said to troll for votes.

But the bigger news is that he says bribes for votes are okay … as long as they bribe two states at a time.

Still seeking votes for his proposed health care overhaul, President Barack Obama appears ready to reverse his position and allow unpopular deal-sweetening measures in the hopes of finding Democratic support for legislation whose future will be decided in coming days.

Taking a new position, Axelrod said the White House only objects to state-specific arrangements, such as an increase in Medicaid funding for Nebraska, ridiculed as the “Cornhusker Kickback.” That’s being cut, but provisions that could affect more than one state are OK, Axelrod said.

Axelrod said the principles the White House wants to apply include “Are these applicable to all states? Even if they do not qualify now, would they qualify under certain sets of circumstances?”

These wavering blue dogs might as well pair up and name their price, because that’s what’s going on now. We can call it the “buddy bribe” system. It’s worked for Alaska and Hawaii for a long time, so maybe it’s time the other 48 states get to play.

Logic seems to be in short supply on the Hill. Far be it from me to offer the President a way to save his DOOMED presidency, but it seems to me that if he was really a LEADER, and really was interested in being remembered as something besides “the President who destroyed the American health care system,” he could make one more of his infamous speeches but this time say something like: “You know, I’ve been thinking about this health care bill, and I’ve been listening to the American people. I’m going to take this off the table for now. We’re not ready to do this; there is too much disagreement about the details, and it is foolish to rush something this major through without careful deliberation. I want to include both the Democrats and the Republicans, and I don’t want to add one penny more to the national debt right now, so I’m going to suggest we take a break to focus on jobs and the economy, and come back to this next year.”

Now, I realize the chances of this happening are exactly zero, (or maybe negative 10), but what a win-win that would be for the EVERYONE. The democrats in congress won’t have to vote for a bill that everyone acknowledges is totally toxic, the Republicans will stop being called “the party of NO,” and the President will earn (maybe) the respect of the American people. Well, except for his far left base, but he hasn’t seemed particularly interested in catering to their every whim so far either, so what the heck.

Beinart makes an interesting argument. It does seem that Republicans are perceived as sticking to their guns while Democrats often appear “squishy,” as though they have no core beliefs.

And, it’s hard to determine what the political orientation of the country really is when people almost universally want low taxes but lots of benefits. The town hall attendees displayed this contradiction when they screamed for government not to touch their Medicare, which basically is socialized medicine for the elderly.

To me, the parties have more in common than they have differences – at least in practice.

Both parties are statist. They continually enact legislation that will expand the size and the authority of the state thereby increasing their power.

Both parties are corporatist in that they enact policies that enrich corporations (most often bankers) at the expense of everyone else because they need corporate support in order to win elections.

The difference seems to be that Democrats are more likely to throw some bones to average or lower status Americans to try to balance things out. The problem with this approach though is that by increasing the size of the beneficent state they end up increasing the burden on the very people they’re trying to help.

What concerns me most is that even if does pass and the SCOTUS deems parts of it unconstitutional; with what is left may still be able to grow into health care socialization? I don’t think the SCOTUS can kill the whole bill.

Again, they are more than willing to take two steps back for the ten leaps ahead they’ll get. In 1944 the Allies imagined 50% casualties during the first assault waves, but felt the losses were acceptable for the ground the army would secure- for future operations.

We really have to get past the old ways of politics as usual. They are not playing by the rules and as they gain more power they will flaunt the rules even more. Tyrants come in many different forms; some are fat greasy dictators in South America, some are high stepping military types, and others are glad-handing, Harvard educated, men and women who inject their faces with botox, plug their head with hair, and think they are destined to rule.

Once you get past this, it is far easier to see what they are willing to do in order to keep their boots on our necks.

I think the NRCC and the conservative base should state in a very public way that our #1 target in 2010 will be any dems who switch from No to yes.

As it stands now, if we hold all our NOs from last time this bill doesn’t pass. And we know the 10 who are most on the fence. They need to know that we are going to really go after them.
