Video: Biden, Dodd, Feinstein and Schumer Attack “Nuclear Option”


This video (H/T Drudge Report) captures an important piece of recent history, when the GOP controlled the White House and the Senate. The Democrats repeatedly attacked the Republicans for attempting the “nuclear option.” Senator Reid described the Republican strategy as an arrogant power grab.

Senator Dodd said he has never in his time in the Senate passed any bill of any importance that did not have both a Democratic and Republican leader. Then Senator Biden said “I pray God when the Democrats take back control we don’t make the kind of naked power grab you are doing.”

The out-takes from this video will make some great 30 second campaign ads if the Dems try reconciliation.

I disagree with him on one point – this President does not deserve any respect. He is a socialist at best and a Marxist at worst. Do not be frightened of a man who is attempting to tear down this country. If the GOP does not correct the president per Rove’s piece and on any other occasion where he attempt to lie to American people without the threat of a correction by a GOP member, the action will be scored as a vote for ObamaCare. All the gains by the GOP with the electorate will evaporate.

Also, if reconciliation occurs in the Senate, as hard as it will be, DeMint’s tactic of using hundreds and, if necessary, thousands of amendments to slow down the process all the way to November if necessary must be done by the GOP or it will be scored as a vote for ObamaCare with all the accompanying consequences.

The GOP better head into the summit with every intention of killing ObamaCare. They had better head out of the summit with the same attitude. No excuses.

I agree that Bush gave tax cuts to all Americans and that S-CHIP helps the poor. My point is that these were significant pieces of legislation that used reconciliation to be passed.

Using reconciliation is nothing extraordinary is my point. I’m not arguing about the merits or lack thereof of legislation; I just don’t think we should pretend that this is the first time we’re (Americans) are using reconciliation to pass laws; that’s simply not true.

1) I haven’t a clue what you’re trying to say, or what point you’re making.

2) Listen, when Rs were in power they used procedures to pass legislation with a simple majority and Ds complained. Now when Ds are in power they will use procedures to pass legislation and Rs complain. Let’s all remember that these guys are politicians; talking out of both sides of their collective mouths is a qualification for the job.

Why don’t we just get rid of the filibuster anyway, pass the bill now and have it go into effect January 2013. We have enough checks like; a whole other branch of Congress, an Executive with veto power, and a Supreme Court to strike down the unconstitutional. Can we agree on that?

After that it must be renewed, made permanent law by normal rules, or allowed to expire. Thats why Pres. Bush was asking for congress to renew the -Bush- tax cuts all the time. The D’s never accepted Bush as a Legitimate President and refused to cooperate or make permanent law. You might have noticed Bush had the grab the mangy D’s by the scruff of the neck and drag them to where they had to go (Adult-Land). Most of what Bush passed, Obama is going to retain because he would pay a severe price, exacted by the hand of the American People, if he changes it. And Charlien, don’t compare D’s to R’s. Republicans paid a very heavy political price doing what had to be done. The D’s have been useless to this country in it’s decade of crisis.

Wasn’t the “nuclear option” the Democrats were against back then eliminating the filibuster altogether, not simply getting around it through reconcilliation to pass legislation? If I remember correctly, the Republicans threatened to employ the nuclear option because the Dems were obstucting Pres. Bush’s judicial nominees…and they eventually caved thinking they’d want to use the filibuster when they in the minority. Right?

The R’s were threatening to use a mechanism which — they believed, as did Senator Byrd in the 1970′s although he had conveniently changed his mind by 200x — would disallow filibusters with regards to judicial nominations.

The R argument at the time was that while filibusters were fine and dandy for legislation — after all, you don’t HAVE to pass any particular law — voting on presidential appointees is an explicit duty of Congress. Just like voting on a budget is a specific duty. Thus, they reasoned, filibusters of judicial nominees is an illegitimate use of a legitimate procedural tool — just as the 1974 Democratic Senate agreed with respect to budgetary reconciliation, when they created the “Reconciliation” procedure and made it immune to filibuster.

That contemplated action, using a 51-vote procedure with the help of the President of the Senate (e.g. Dick Cheney), was called the nuclear option because the Dems threatened to go nuclear (e.g. shut down the Senate) in reaction to it.

The R’s backed down because John McCain is a putz. I mean, because (a) they were afraid of the Dem’s threat, and (b) they believed it likely that the D’s, once they inevitably returned to power, would in retaliation use the same 51-vote procedure to eliminate the filibuster altogether, even for “normal” (non-budgetary, non-confirmation) business, and (c) some of them had hopes of using judicial filibusters themselves, once (inevitably) a democrat won the White House.

Now, IMO, (a) is just lack of conviction, and (c) was a pipe dream. When have the R’s ever had **lls that size? (b) was at the time rather far-fetched…but now we see that the D’s are already talking about eliminating the filibuster entirely. (Or, at least their media lapdogs are.)

Which is a slightly different thing than “simply” using reconciliation to pass non-budgetary laws. In effect, the reconciliation “trick” is a way to eliminate the filibuster “just this once”, without actually going thru the procedures necessary to truly change the rules and eliminate it. Now, (a) if you believe “just this once”, then I’ve got some South Florida waterfront property you might be interested in, and (b) given the, err, likelihood that a successful “trick” would be repeated, there’s not much actual difference between the proposed “trick” and formally getting rid of the filibuster. De facto vs. de jure, in other words.

Furthermore, THIS proposed action is much farther along the path to de facto destruction of the filibuster than the R’s “nuclear option” — at least the R’s version could justify it based on the “duty to vote” argument. Unlike the confirmation of presidential appointees, the constitution doesn’t specifically impose a duty on Congress to vote on Nationalized Health Care…

This proposed action is also being called the “nuclear option” — by us — because this time the R’s are threatening to go nuclear over it, if the D’s actually do it.

Remember, things are called “nuclear” not because of what they are in themselves, but because of what the guys on the OTHER side would do in response.

In 2003, the R’s were talking about the “Constitutional Option” — a term which has a long history going back to the 1950′s referring to the ability of a simple majority of a legislative body to set its own rules. (I posted a link [2] below).

The Dems, in 2003, were calling it the “nuclear option” — because THEY would go absolutely ape-**** and shut down the Senate if the R’s actually followed thru. But then John Freakin’ McCain got cold feet, and the rest is history.

In this case, the R’s are — well, some of them, anyway — threatening to go ape-**** and shut down the Senate, if the D’s carry out their reconciliation tactic.

They keep saying that “See, lookit, the D’s were all for the filibuster back then, so they’re a bunch of hypocrites.”

That doesn’t work all that well, because the D’s can just use the PeeWee Herman defense: “I know you are but what am I?”

Framing the issue the way Drudge, Rush, Hannity — and posted video — have, just renders the whole issue one of simple majoritarian politics: the majority — whether held by either party — doesn’t like to be stymied by the filibuster.

But there is a fundamental philosophical difference: the D’s in the video were arguing, in 2003, that the Republican attempt to force a vote on presidential appointees — as arguably required by the Constitution — was the same as abolishing the filibuster for all Senate business.

Yet, no Republican once suggested that the rules should be changed in that way — they were just talking about using the same legislative procedure Senator Byrd used in the late 1970′s to revise the filibuster rules with a less-than-filibuster-proof vote. The change the R’s wanted to impose was to make presidential nominations, like budgetary reconciliation, immune to filibuster. Now, granted, the same procedure — if actually carried out — COULD have been used to change the filibuster rules for all business, just like Senator Byrd did, when he lowered the requirements from 67 to 60 using a 51-vote majority (it’s more complicated than “Byrd did it” — see [2], below).

But, the R’s were not threatening to do that. Their rationale for pursuing the “Constitutional Option” was predicated on the argument that the Senate had a constitutionally-mandated duty to vote on presidential appointees (or, in some variations, just federal judicial nominations because of the interaction between all three branches). That rationale would not have allowed them to follow the same procedure for any other Senate business — not that intellectual consistency is common among politicians.

Today’s Dems, on the other hand, want to use reconcilation — itself a limitation on the filibuster that was imposed by a less-than-filibuster-proof vote — in service of…passing national health care legislation.

It’s not budgetary. It’s not related to any of the Senate’s constitutionally-imposed duties, like voting on a budget, voting on a treaty, or voting on judicial nominees or other presidential appointees, or voting during an impeachment trial. It’s not SPECIAL in any way. And by using a majoritarian technique on a run-of-the-mill, routine bill (no matter how gigantic in cost and implication) — the D’s really are opening the door to the complete destruction of the filibuster. If it works once — on a “routine” bill — why not use it again and again and again? How could the D’s cabin it off, and say, well, Health Reform was “special”, we can’t do that for a jobs bill. Or a union card check bill. Or a cap and trade bill… Why not? They’re all just routine, normal bills — what makes any of them different from Health Reform? Teh Won just wants this one more than the others?

Whereas there was a very clear distinction between “confirmations” and “other stuff”.

There’s a problem with this. No matter how many times they repeat this lie, it is not believable.

I want to hear our representatives tomorrow counter these lies and point out that mandating we the people enter into a contract is unconstitutional. Dem sites have video and quotes from conservatives defending the nuclear option back then. Both sides have done a 180, so its tough to pin it on one side with impunity.

The key is that all the major players for the Dems are still in high positions of power. The GOP players are not. Bush and other GOP leaders are gone. But Obama, Clinton, Reid and Pelosi are on top of the heap. That’s what makes it potent. But conservatives need to be careful. We have not been consistent either.

There’s nuance, here — but this video (and Rush, and Hannity, etc) frame the issue such that you are correct, SY — this can easily be flipped.

The nuance is important — but doesn’t fit in a 30 second political commercial.

wanting to it is what they wanted to do it for and for D’s it is the ATROCITY that is obamacare is HATED by the American Public and they will let each and every Democrat that votes to have this monstrosity passed that it has become time for them to GO HOME!

 

Interesting that Dodd and Baucus...

…both show how little they understand our Republic.

First, Dodd completely misrepresents why we have a bicameral legislature, suggesting that the House was for “majority rule” and the Senate was supposed to act in greater consideration. This is totally not the case. The Senate originally acted as the representation of the State Legislatures, while the House acted as the representation of the People. This was changed by the 17th Amendment (which essentially negated the need for a bicameral legislature).

Then Max Baucus proves he doesn’t know the definition of “democracy,” which is “popular government” aka “majority rule,” the very thing he was railing against at the time.

p.s. I hate how even the dictionary now defines “democracy” in terms that actually define constitutional libertarian government.
