Do not freak out about Sen. Snowe talking to the Dems.
Senator Snowe has rejected moving forward on any health care bill with the Democrats using reconciliation. This is GREAT NEWS. Without reconciliation the Dems will be in a de novo — start at the beginning — situation, which is where they should start.
If the desperate Dems try reconciliation, this time, they will have a far more serious Republican strategy of “outright war” to deal with — and the repercussions of being on ObamaCare on the Senate floor and in Senate Committees for months and months.
The Dems would be so bloodied and beaten and wounded by the end of their attempt, ObamaCare would not pass, and they would have destroyed the less than one percent chance to explain to the American people that they are not dangerous radicals that ignore what the people want, and keep cramming ObamaCare down the public’s throat because they, the Dems in Washington, know better.
“Snowe made it very clear she could not support any form of a bill that came through the reconciliation process—a legislative move she called “wrong and untenable….”
“I hope they reject the reconciliation route. I think that would be wrong and untenable,” Snowe said. “There are things in the bill that could be supported regarding small business that I have worked with Sen. Durbin, Sen. Lincoln, and the small business community… some tax incentives, allowing plans to be purchased across state lines—that would all be invaluable to small business who are undeniably facing a crisis with health care cost.”
The Dems have repeatedly wanted and acted in Dem-only mode for health care reform and have had their heads handed to them in NJ, VA and MA. There is no guarantee they will not continue their arrogant and self-destructive behavior. The voters aren’t stupid, if the Dems keep pushing a Dem-only approach — with even fewer, more liberal Dems, then the public will think they are even more dangerous and more crazy than they think they are now — and when NPR gets a 5 point generic ballot edge for the GOP — which doubles to 10 points when you look at likely voters, and the Dems keep pushing and keep ignoring the public, then they really, truly have lost their minds.
For the Dems to try to pass health care via reconciliation, the House and Senate Democrats must overcome substantial ill-will towards each other, and begin to trust each other.
We will mop the floor with them, if they try reconciliation and their political pain and back-biting will reach unheard of levels. BIG FUN.

This at least would help defuse a really disastrous situation. So I’m wondering–how many moderate senators subscribe to the notion of just moving on? Right now Bayh is in real danger. So is Murray. So is Lincoln. Webb and Warner are getting nervous. Nelson is in shock, talking out of both sides of his mouth. Schumer can’t like his most recent numbers either. And Lieberman’s numbers aren’t that great with independents lately. So it’s a real question whether they’ll go for it. It could backfire big time even, even with “safe” senators. The independent vote is the ball game with most elected officials. I think most think it means “moderate.” But it now apparently means fiscal conservative–and no health bill.

The first rule of politics should be “first do no harm”. Unfortunately the urge to “do something” runs strong in the personality type that runs for public office. Even many so-called conservatives have the unspoken, and maybe unknown to themselves, desire to remake society.
Obama himself is always saying that Americans are looking to Washington to do something for them. Pols believe themselves to be more qualified and innately capable to solve our problems than We the People are ourselves.
I think that rather than have a litmus test for politicians on our side we should just ask of them to do whatever they can to get government out of the way and out of our lives. There are plenty of legitimate functions for government to do that can keep the busy bodies…busy.
If nothing else the Democrat’s kamikaze push for Obamacare has exposed the general public to the radical agenda of the Left and hopefully will energize people to stop and then roll back the Leftists gains over the last few decades. So although I want Obamacare to fail I also want them to keep pushing for it.
The GOP however can’t just sit back and reap the rewards and then go back to their establishmentarian behavior or else they will wind up handing power back to the Democrats in a few election cycles. That’s why it’s important that we elect conservatives whenever and wherever we can. It’s mushy moderates that thwart our agenda even more so at times than the Left by accepting the premises of the Left and negotiating from positions of weakness rather then forcing the Left to move to the right. Snowe is one of them. So I won’t believe Obamacare is dead until there is still nothing passed in August.

I’ve similarly heard from many on the far left who have grumbled and whined but never said no explicitly and firmly. They may “have concerns” or “have a hard time,” which essentially translates into a yes vote meant to placate their liberal base or some special interest group.
I don’t doubt for one minute that Senate bill, whether it has minor tweaks or not, will pass somehow.

It may not stem a lot of losses–but it’ll prevent a tsunami. That’s got to be the thinking of a lot of moderates. But the ideological yearning on the left is fierce. They’re true believers, like suicide bombers. That’s why in the end the Supreme Court may have the last word.

Of course, even without that, I’m not arguing that it is constitutional. I am arguing that whether it is is irrelevant to the judges that sit on the federal courts. They don’t follow the Constitution any more than Congress, and probably less so. As to the quote below, whether an action by Congress is unprecedented and/or extreme is irrelevant either way.
The Supreme Court is a figurehead because it has deny certed itself out of relevance.

Sen Ensign brought up the unconstitutionality of the mandates in an amendment. Hatch at that time said the Senate “cannot ignore this question by simply punting it to the courts.” But Baucus said, “We have looked at this question seriously and concluded that the penalty is constitutional. And those who study constitutional law as a line of work have drawn that same conclusion.” So they shot down Ensign’s amendment, 60-39. So when did the change occur? Simply because some guy on the Kos website claims this is not proof of anything. It is human nature not to follow through. It can happen. If there is one thing, which I have learned from studying the Original American Revolutionary period, it is this. Never get comfortable. Never let down your guard. Power corrupts, We formerly lazy patriot, helped to create this mess, which the liberal have spearheaded, to begin with, by getting comfortable and letting down our guard and not getting involved.
