The Extraordinary Measures Needed to Kill the Bill — Updated with Vote Numbers


The corruption of using the public treasury as a check book to buy the votes of Senator Nelson and Senator Sanders — in the face not only overwhelming public opposition, but also in the face of a public that now wants Congress to do nothing on health care — means that extraordinary measures are needed to kill ObamaCare.

This plan, if executed properly, will kill the bill and it will give opponents two more bites at the apple, after it passes the Senate.

There are some atmospheric conditions that will help this plan work. For example, both sides of the net roots should cease fire on posts against each other. There must be a truce until the bill is dead. The target is the bill, not each other.

So, for those on the left who have decided to kill this bill, they are welcome to join in this the kill-the-bill fun.

Rationale: There are many reasons in agreement between the right and the left and the American public about why this bill must be killed:

1. It will increase health care costs;
2. The individual mandate is massive government intrusion on individual freedom, and is a gift to the private insurers, and disproportionately impacts lower-income families;
3. The fantasies of CBO’s assumptions notwithstanding, this bill will accelerate our march to financial insolvency; and,
4. Passage of the bill merely reinforces the practice of buying votes with debt issued by the U.S. Treasury;
5. Among many other reasons, in the words of Howard Dean, the bill does more harm than good.

The Plan: First, conservatives will object to the appointment of the conferees. This is not a motion, so it is non-debatable. An objection cannot be overcome unless the Senator making the objection caves. Let’s hope Senator McConnell agrees with this approach — but regardless, the objection shall be made.

This forces two votes in the U.S. House, one vote to amend the Senate bill on the House floor, since the Senate bill likely cannot pass the House unamended, and will force another vote on final passage of the amended House bill.

So, first, conservatives force two votes in the House, by preventing the appointment of the conferees, and therefore, preventing a House-Senate Conference.

Second, the left will focus on three separate issues to kill the bill in the House. The object of these issues is not to support these policies per say, but to add items to the House bill that will be so objectionable that when the bill goes back over to the Senate, that the Dems lose one or more of their 60 votes.

The Public Option: The progressive’s net roots should hold accountable the Democratic House members who said they would not vote for the bill if there was no public option. Progressives need to produce enough votes to force the public option back into the bill. Forcing the public option back into the bill is in the progressive’s interest since it will show they have the political power to do it, and will set a precedent for a new health care reform baseline in the House for Democrats. It is in conservative’s interest for this to happen because if it does, Senator Lieberman’s vote reverts to a NO.

The Nelson Buy-Off: Both the left and the right net roots will focus on pulling the Nebraska and Vermont free pass on increased Medicaid spending, on the basis that it is a corrupt back room deal that may be unconstitutional on the basis that it violates the equal protection clause (the 14th amendment to the Constitution.)

Unions: Unions must pull the Senate tax on Cadillac health plans, and replace it with the House tax on individuals. (I know, I can’t believe I just wrote that either!) This will force Senators, when the bill goes back to the Senate, to oppose the bill which could force the Dems lower than 60 votes.

Hold the No Votes: Conservatives need to hold and add one or two more no votes to the 39 House votes against the bill, among those Democrats who have concerns about their own re-election or who have announced their retirement — since the leverage from the Speaker has substantially decreased. If every No vote on the original House bill holds, there only needs to be two additional no votes.

Pro-Life and Pro-Abortion Forces: In short, have at it. Given the Stupak amendment majority in the House, the pro-lifers must stick Stupak back on the bill, so that when it is sent back to the Senate, the pro-abortion majority can pull Stupak back off. When the bill goes back to the Senate, the pro-abortion forces can remove Stupak, just as they did a couple of weeks ago. Once Stupak is pulled again from the Senate it must go back to the House to be amended, or die there.

I am willing to coordinate these actions with the left in real-time, and work with the Progressives who want to kill the bill — to share intelligence and whip counts. This way the left and the right working together will accomplish not only what we want, but what the American people want.

Oh, I did not mention this in the original post, but should have:

we do not need any more than 42 votes on the House floor, and last time there were 39 No votes.

Assuming we have a hard base of 25 no Dem votes, then the net roots need to produce eight House votes on either the abortion or public option question.

The Stupak folks ought to be able produce ten additional no votes.

This is not difficult math. And MoveOn.org is already telling its members to oppose the Senate bill.

I loathe the idea of an unconstitutional public option as much as I loathe my forced social security and medicare taxes but I’m open to proposing a very well defined public option that is a) 100% optional, b) is only paid for by those who opt in, c) is forbidden from undercutting private insurers, d) is run by an independent body free from politics (possible?), and e) the plan has to pay for all those without insurance that the Left is always whining about out of plan premiums with no taxpayer subsidies.

If the Left really wants a public option because of their irrational hatred for capitalism then let them have it. What I strongly object to is being forced to participate in and fund such a plan myself when I’m quite satisfied with the private plan I have myself.

I’m sick of being treated as a member of a commune but don’t care if the communists want to form their own commune as long as they leave me, and my money, out of it.

Frankly I’m surprised they are opposed to the current bill. The Left’s decades, nay generations old strategy has been one of incrementalism. This bill would get them a starting point from which they could continue to build.

In the interest of cooperation, them getting what they want and we getting what we want, we need to strike a deal. They can have their public option and we get increased competition. Individuals would be free to join either independent system.

They should know that they will never get a public option without some compromise because most Americans are simply NOT socialists and don’t want government intrusion into our lives.

I believe federalism is the answer. Just need to convince them.

Our newely elected Governor and Atty. General here in VA are big 10th amendment advocates. Lots of talk about the 10th amendment in the campaign by Ken Cuccinelli, and, I have faith he will not lose sight of that now that he has won. They also are very much into creating jobs from drilling for our off shore oil and gas resources (Vladmir has taught me about the difference between reserves and resources). There is no question that the Red states in particular are looking for every out they can find from the edicts of the federal government. I think Federalism will become the word of the day for many. Your first step is absolutely key – preventing formation of a conference – for anything else to work; otherwise, the leadership will slice and dice out of sight to get enough votes to rush it through without meaningful debate.

On the other hand, if no conference, then we get public visibility and more floor votes and the opportunity for amendments.

Regarding the Vermont and Nebraska (and Louisiana Purchase): now that this has been exposed, is this a poison pill on the House side that will increase House opposition (if they get to vote; see previous sentence)? Thus I wonder if killing these provisions may have the effect of making the bill easier to pass.

Meanwhile, killing these provisions won’t change the votes of Nelson and Sander; they can’t change course if these get pulled without becoming the source of public ridicule and full discredit from all sides. Having sold themselves, there’s no going back. So we don’t gain votes against the bill by killing these provisions.

On the other hand, if the bill passes in the end, then letting these bribes stand is being a party to a morally offensive act. I’m torn.

One question that Moe frequently asks; do the netroots on the left actually have any power over Democratic legislators? Even if we enter into an alliance of converging interests on this bill, can the left deliver any Democratic legislator’s vote?

Will they sit back and watch 2 states, even Democrat ones get the Christmas tree full of goodies, and, go home with nothing, when they may have committed political suicide for nothing? That has been all over fox today, and, I know the hard left doesn’t watch fox. It may become a Democrat fight as they have no morals or scruples, money talks, and, empty hands walk.

The current head of the DNC, my still current Governor Kaine, has been very quiet on the issue, hence Howard Dean making his noise. The unions are making noise because the Public Option is gone, as well as their tax breaks for their cadilac plan. The pro-choice people are making noise because of the Stupak amendment, and to a lesser degree the Nelson waterd down amendment.

I seriously doubt that the Democrats can or will marry the House and Senate bills. They are far apart. Pelosi promised that no bill would pass her House without a Public Option. I have a hard time believing that some will give up their goals just to get something to Obamas desk. Even if they are promised incrementalism in the future, they aren’t blind to the fact that many won’t be there to see their goals rewarded in the future. On the other hand, some probably don’t care what they vote for because they don’t want to be there i the future. Pelosi has them by the cajones (sp) and she and Harry will tighten the vice.

Look at all the stuff Mr Haney (Senator Ben Nelson) and Professor Irwin Corey (Senator Bernie Sanders) got for their piddly little holdouts. And…they’re not professional pork gatherers and fleecers!

Surely there are a few Congresscritters who see dollar signs in all of this. And, surely, there are some constituents who are pressing their elected Representative to get their cut.

2. Passing the bill without a popular vote provision will make the bill even more unpopular and expose representatives who vote in favor of such a bill to even greater voter anger.
3. If our representatives aren’t going to represent us, then I would prefer direct democracy over representative “democracy”.

I think it would be not wise to do this with the current WH occupant, and, the Liberal majorities. Crap, we just had a liberal Clinton appointed judge rule against ACORN funding. While the courts are still so Liberal leaning, and, ACORN can still do it’s voter fraud dirty deeds, they would make darn sure that the legislation passed, and, overwhelmingly. If you make less than $250,000/yr and you pay taxes on buying drugs or medical supplies, you should get a tax credit on your 1040 for all the taxes you paid for drugs and medical supplies.

Should we all with GOP Senators call and ask them to object to the appointment of the conferees? I’m in Tennessee so that would mean calling Corker and Alexander…neither of which are super conservative.

But should all do it for our own senators or should we call DeMint and Coburn and ask them to do it?

When do they do this? Immediately or after a certain point?

Does it just take one objection? Does McConnell have to approve?

As I recall, they said they’d do anything to stop this thing so I wouldn’t be too surprised if they were open to out of the box ideas.

Reid has sold out the Public Option, Abortion, etc. At some point it gets too much for a couple Progressives. Also, the fact that Reid has opened the treasury to some, but not to all is going to cause other Dems to demand special consideration. I think 5 days is going to be too long for this bill to survive Dems feckessness.
As for positive action, any way we can help this thing roll down hill faster will be useful. This thing is already painful to the far left; twist the knife, mock them. I sent a letter to my Dem Senator quoting her own words. Write your GOP senator demanding he stall the bill.
Considering how this year started, I think the party and grassroots have been very effective. The opposition message is clear. The Independants are moving our way. Their is a lot to be grateful for.
I suggest we not confuse our message with gimmicks like supporting the Public Option (publicly). Lets get out of the way and let Dems destroy themselves.

I personally think Nancy Pelosi and Harry Reid have already worked out what will stay in and what will be removed, what can get the majority of votes in the house and in the senate. First off, let’s not be fooled here. Does anybody think that the libs are going to think independently about this? Hell, no. libs do what they’re told.

This is how it will go down: After much wrangling and bribery, the bill(!) will get its 60 in the Senate. Reid and Pelosi then will jointly declare victory and announce that the House and Senate will commence to fixing the bill in joint conference.

There will NOT be a single Republican anywhere near where this gets discussed. Not a one. While in conference, they’ll rip out any and all abortion protections and put the public option back in. Oh, and likely a bunch more tax increases with a topping of even more pork.

Then this new bill, resembling nothing like what was voted on already, will be shoved through the House in the dead of night and in a similar fashion in the Senate.

I think Dan deserves a very big thanks for having thought this through and come up with an offensive game plan. It may not work, but then again, stranger things have happened. I’m reminded of Calhoun (don’t let this go to your head, Dan :) ), the great conciliator. This certainly is better than just giving up and getting drunk.

Of course, Dan’s strategy depends upon collaboration with the progressives. Of note, over at firedog she has a piece in a somewhat similar vein, citing as an example the left and right joining against Bernanke’s appointment. But if an effort like Dan’s is going to be mostly met with derisive remarks about the left, then Dan’s idea dies right here. Personally, I think the stakes are too high not to try everything we possibly we can.

I agree with dennis above, and I would add my thanks and appreciation to Dan and his faithful reporting on this cancerous bill as it metastasizes its way through congress and eventually to the country. .Therefore, a significant amount of chemo is needed to treat this “tumor”, and this is as good a plan as I’ve seen anywhere. So…have any congressmen/women been contacted about your plan, and what is their opinion? I assume you will update us on the progress of this plan, assuming it gets off the ground? How will we know if the left is cooperating? BTW, I’ve had the privilege of reading Red State often, but seldom ever posting…but watching this thing weave through congress has motivated me like nothing ever has before.

Especially if it goes to conference. There are profound differences between the House and Senate bills, and I seriously doubt that either side would pass the others’ version without change. That means there will be some serious negotiating needed to get a reconciled bill. That will not be easy.

And even if it DOES pass eventually, it’ll be a while. And the longer this takes, the more the odds drop. And the closer to the 2010 elections it gets. And the more pissed off the public will be, with less time for them to forget.

As certain as I have been up to this point that something would go through both House and Senate, I am not at all certain that they can come up with a joint bill. There may not be enough bribe money available to pay off all of the dissenters.

What happened to Sanders’ threat? Burris? What about the others adamant over public option or nothing? Dean have back-pedalled, and so have the rest. Why? When it lacks even drug re-importation? When the mandates are abominable?

IT WAS ALL A CHARADE. As long as they get “A bill” It will be enough to shoehorn whatever regulations they want. The back and forth is all about liberals getting the most they can, but in the end they fall into line.

The 60 vote Senate threshold was the hardest part of the process, and it did take them longer than they thought to get here, but they are here.

One brilliant idea I’ve seen here: Sunset the bill. Some other thoughts: If this doesnt even come into full force in 2014, then we have several years to scale it back and defang the worse medicaid-medicare-budget-busting elements, and the mandates and the taxes and the rest.

We will need a new President in 2013 in order to do that. IT WILL BE A LONG HARD SLOG TO UNDO THE DAMAGE THE DEMOCRATS WILL CREATE IN THE NEXT FEW WEEKS.

Reconciliation would have *forced* the entire thing to be sunsetted after 5 or 10 years (can’t remember which), which would have knee-capped the bill if the GOP took over the House next year.

Now they’ve managed to pass (a much less horrid bill, admittedly) using ‘regular order’, which means it won’t be sunsetted at the end.

There is some good news in that, as you say, some previsions will take years to establish, which will still allow a GOP House to strangle it in the crib.

But Reconciliation would have put a clock on the whole thing, which would have been my preference.

Correct me if I am wrong, but doesn’t the Senate need only 51 votes on the conference bill? I thought conference bills were not subject to filibusters. This means that once all the filibuster votes are done in the Senate, they don’t need Nelson. In fact, at that point, 9 Democratic Senators can vote against it and it will still pass.

Sure, it would be a pretty ugly thing to do to Nelson (and in a strange way it would serve him right). They might probably never be able to count on his vote again. On the other hand, what’s he going to do – switch parties?

I was just trying to consider if there are other ways to delay this into 2010. Something that Sen. Reid hasn’t taken seriously in his choreography.

But have any Senate staffers picked up on this idea of stopping conference? Or is this something you’d keep quiet about if you did get nibbles?

And we have to make sure that Nancy won’t just push through the Senate version. After all, do we know how many of the House Democrat no votes were “free pass” votes once she had enough yes votes to pass the bill.

I sent an e-mail to my dem. Senator informing him that if he voted for this monstrous fiasco, he will never get another vote from me.

Dirty Harry is sticking it to the folks and they don’t appear to have any way to stop it. Keep up the pressure, it might have some effect.

What they are hoping for by getting it done now, perhaps the voters will forget about it by next May’s primaries or for certain, by next November election.

Don’t let that happen, they must be held accountable for thinking the voters are too stupid to think for themselves, or they don’t know what is best for them.

Stating that a Dem. Senator will never get another vote from someone is pretty useless. Any staffer that heard that would immediately know that you were not a lib anyway, and would never have voted for that Senator in the first place. Now if you were to give them your name and address and demonstrate that you were a registered Dem., or at a minimum an Independent, you might at least get their attention.

I like the strategy Dan. What worries me is that Pelosi would be able to round up all the votes to pass the Senate bill in this scenario. Stupak is key here in this scenario. Do you think he and his fellow lynchpin pro-life Democrats vote to torpedo this bill? Eric Cantor via NRO seems to be confident that Stupak will hold. If the conference is allowed, the liberals on the conference will try to put the public option back in, kill the abortion language so federal funding is allowed, and likely take out the provisions that Nelson was able to get. Senators are already warning the House not to mess with their bill. They are basically trying to intimidate the House into accepting their version. These conferences can drag on for months and the longer this drags out, the better. The people are going to digest this thing and approval ratings are going to plummet even further. Hence, whatever takes the most time, that is the option we should go with :)
