Howard Dean: “Kill the Senate Bill” — Updated, Sen. Nelson tells Obama NO

From Plum Line, which has published an advance look at a radio interview Howard Dean recorded for Vermont Public Radio. The interviews will air tonight at 5:50 PM:

“The gauntlet from Dean — whose voice on health care is well respsected among liberals — will energize those on the left who are mobilizing against the bill, and make it tougher for liberals to embrace the emerging proposal. In an excerpt Kinzel gave me, Dean says:

“This is essentially the collapse of health care reform in the United States Senate. Honestly the best thing to do right now is kill the Senate bill, go back to the House, start the reconciliation process, where you only need 51 votes and it would be a much simpler bill.”

Kinzel added that Dean essentially said that if Democratic leaders cave into Joe Lieberman right now they’ll be left with a bill that’s not worth supporting.

Dean had previously endorsed the Medicare buy-in compromise without a public option, saying that the key question should be whether the bill contains enough “real reform” to be worthy of progressives’ support. Dean has apparently concluded that the “real reform” has been removed at Lieberman’s behest — which won’t make it easier for liberals to swallow the emerging compromise.”


The question is whether Senator Sanders (I-VT) and Senator Burris (D-IL) or any other Senator agree, and I suspect the answer to that is a big YES.

And this just in from Bill Dupray at Patriot Room:

“It looks like Senate Democrats are down to Plan D. The liberals caved on Plan A, single-payer. Then Plan B, the public option, went by the boards. Plan C, the Medicare buy-in, went up in smoke last night. Now it’s on to Plan D, and nobody actually seems to know what that is yet. President Obama, in a sign of desperation, has summoned the Dems to the White House this afternoon for a knee-capping pep rally to get the team over the finish line, but it looks like other than cajoling, there is no real plan to reel in the wobbly members.”

Dupray then drops this bomb:

The problem is that Reid is having to play whack-a-mole with his own people. He takes care of Joe Lieberman by killing the public option and the Medicare buy-in. But then today, Ben Nelson (D-Neb) called the president and told him flat out “I am not on the bill” and that Mr. Obama should not expect the meeting to get him on board.

And yet another, smaller, but more targeted munition:

Markos Moulitsas (DailyKos) yesterday said the same thing.

“Insurance companies win. Time to kill this monstrosity coming out of the Senate.”

Some more news worth telling: Snowe is rock-solid NO (so no worries) and it is highly, highly unlikely that this is finished by Christmas, leaving the question of whether Senator Reid wants to bring Senators back after Christmas, before New Years. My guess is the whole city would revolt, on both sides of the health care debate.

Everyone is sick of healthcare.

as being the biggest problem with reconciliation from the Democrat POV. In five years, right about when most of the stuff in this bill is scheduled to kick in, it would have to be renewed. If at that time the GOP has just a few more members than they do now (which seems likely), they could filibuster and kill the thing.

Don’t forget a little history. As chair of the DNC, Howard Dean stole the nomination for Obama by refusing to count delegates in Florida — a huge state where Clinton handed Obama a major loss. Counting those delegates at the time (right after New Hamsphire) would have ended Obama’s bid.

What was Dean’s reward? At least, an Ambassadorship to Lichtenstein, right? Nope. He got zip. Nada. Nothing. When he begged for a job, Obama crew told him to go pound sand.

That’s not the way you treat a party chair who rigged the nomination for you.

And the question after that is, if Burris gets paid off in earmark promises or something else…who is going to be next in line at the trough as Dems realize that they can milk this for anything they want to get under the cover of “standing for their principles.” The next week could end up being quite interesting and providing even more fodder for campaign commercials next year than expected.

Meanwhile, the food fight will continue and eat up the clock so that Congress can do less damage on other issues like Cap and Trade or EFCA. Bring on reconciliation – this has far more upside than cloture.

Precedents matter. And reconciliation gets rid of the filibuster on this bill. If it didnt, then why would they use it? If they use reconciliation, they are getting rid of the filibuster. There is no way in Hades that the GOP would let them use the filibuster after that, because they got rid of it under this important bill. Up until now, no majority party has gotten rid of the filibuster because they are alway afraid of the precedent it will set. And they should be. The moment a majority effectively gets rid of the filibuster, they have done so forever, and that includes the next time they are in the minority.

Word on the Hill is they have 60 and this will happen before Christmas. Dean’s act is just part of the theater. It will give cover to those who need it and throw a bone to detractors. They have to save face and keep the coalition together.

They both can’t do that before January, and can’t assume that their members – after getting an earful (and a mailbox-full) over their holidays at home – will stay in line.

Maybe I missed it, but I think Joe Lieberman was right when he said that nobody talked about the “public option” during the presidential campaign. If they did, it certainly wasn’t emphasized. But almost as soon as Obama won, or when the Dems decided to focus on health care before other significant legislation, the Democratic base has been insistent that there be a “public option.” They have become obsessed about it, elevating it to a level of importance that just doesn’t make sense.

Dear Ms. Xxxx:

Knowing of your interest in the ongoing debate in Congress over health care reform, I wanted to update you on a number of votes and positions that I have taken during the process.

Together with 60 of my colleagues, I voted in favor of proceeding to debate the proposed health care reform legislation. I have yet to decide whether I will support final passage of the bill.

I have stated on several occasions my concerns that the Obama administration should have begun the health care process with a clear, detailed proposal, from which legislation could then be put into place. Instead, the legislation now before the Congress is the product of five separate congressional committees, three in the House and two in the Senate. I and my staff have carefully worked through thousands of pages of sometimes contradictory information, and have done our best to bring focus to the debate and clarity to any final product.

Our country needs health care reform. While a strong percentage of Americans are satisfied with their health care, the system is not working for millions of others. Spiraling costs for health care also have placed our biggest industries at a severe competitive disadvantage worldwide, and have become unsustainable for many small businesses.

But true reform must be done in an effective and responsible fashion, without creating a cumbersome, overly-bureaucratic system. The bottom line should be to achieve a more cost-effective health care system that increases accessibility, affordability, and quality of care, and which does not burden our economy along the way.

The process also requires openness, so that the American people understand exactly what is being debated. At the start of this debate I was one of eight Senators who called on Senate Majority Leader Harry Reid to post the text and complete budget scores of the health care bill on a public website for review at least 72 hours prior to both the first vote and final passage. This request was agreed to, affording proper transparency in the process.

Over the past few weeks, I have taken a number of difficult votes. As with every other issue since I came to the Senate I have voted my conscience throughout this process. I have broken with my party six times, including four votes to send the current legislation back to committee for a more thorough review. I voted five times against proposed cuts to Medicare due to my concerns about taking half a trillion dollars out of that system at a time when the pool for Medicare is about to expand with the retirement of those in the Baby Boom generation. I am a long-time supporter of Medicare Advantage programs which have, in my view, improved services in rural areas of Virginia, and I did not want to see cuts to benefits or services.

On the issue of abortion, I studied the bill closely to ensure that no taxpayer dollars will be used to fund abortions. I am convinced that this legislation strictly adheres to the requirements of the Hyde Amendment. It also includes clear conscience provisions for providers and consumers who elect to reject a plan that offers such coverage.

Since drug prices in the U.S. have risen dramatically in recent years?a 9% jump in 2009 alone?I have cosponsored an amendment to lower prescription drug costs. The measure would allow Americans to safely import lower-priced, Food and Drug Administration-approved drugs from other approved countries, and save the federal government nearly $20 billion over the next ten years.

In summary, I have been working actively to improve the health care reform bill for the good of our country and without bowing to party politics. As we continue to debate the bill and amend it, I remain hopeful that the Senate can reach consensus on fair and effective health care legislation. Whether this is so will determine my vote on final passage.

As the Senate continues to debate health care reform, please be assured that your views will be very helpful to me and my staff. I hope that you will continue to share your thoughts with us in the years ahead.

I just checked out comments on Daily Kos re: the Senate Bill. No, I do not make it a habit to visit Daily Kos, and God only knows what kind of cookies it planted in my hard drive. Anyway, the folks who posted comments are almost uniformly livid. Without the public option or Medicare expansion they view the bill as a pure sellout to the insurance industry, and as an unmitigated disaster that should be abandoned. With public option or Medicare expansion they get the camel’s nose in the door, and will pay any price for that. But unless they get the camel’s nose in the door they vehemently oppose a bill that they view as making things worse for consumers and better for insurers. And they don’t give a damn what Obama or Reid say about it. This gives me hope.

I talked to Sen. Burris this afternoon

in the hallway near John Kerry’s office in the Russell S.O.B. It was at about 4:30 and he had just come in, still wearing his coat. He was smiling. I wished him a Merry Christmas and he responded with a “Happy Holidays.” He definitely had a twinkle in his eye.

Long day waiting for Sen. Webb to return to his office — he never did while I was there. Sen. Kerry brushed by me and mumbled a greeting, but was in no mood to talk.

Oh well. The rally had a good turnout, especially considering there was only short notice. They definitely knew we were there and they knew why.

People attribute supernatural powers to their opponents too often. This is a poisonous piece of legislation. I would be surprised if it passes as written. Don’t forget, that CBO score had better be damn good, otherwise some of the wavering Dems may pull the rip-cord.

pathetic act in this drama called “hope and Change” The principal players stand in the wings and wring their hands, hoping for a smash hit, while these tiny bit players like Burris and McCaskill get there 15 minutes of fame by criscrossing the stages of the Sunday Morning news shows and rehashing their empty heads. Unfortunately we are forced to stay to the end of the show. But we at least can resoundly boo and hope that the conservative talent scouts are watching this drama carefully.
