First Dem Amendment Fails, Mikulski Aides say there Won’t be a Vote

What is happening in the U.S. Senate you ask?

A whole lot of old Senators giving long health care speeches.

But in the news today, the media discovered the, the (wait for it) — the filibuster.

Turns out that the Mikulski amendment — designed to give the pro-abortion forces in the U.S. Senate a victory — was, well, you know (it starts with an “a” and is seven letters and ends in a “ted.”)

And the pro-abortion forces take their second defeat, first Stupak in the House, and now Mikulski in the Senate. Going with the Mikulski amendment first (abortion) does show a whiff of fear on the part of Democrats, eager to placate that group of voters, which, of course, now has had the opposite effect.

It turns out it is really, really, really hard to amend this bill on the Senate floor (see link to NYT above.)

That means the Dems are going to find it impossible to pull the public option out of the bill, and making other changes to the bill to pick up votes will be equally difficult.

Will Senators Burris or Sanders vote to pull the public option out of the bill? Not likely, given that they have both said they will vote against any bill that does not have a public option. What about Senators Rockefeller and Franken?

And if the Dems can’t pull the public option out, then they will lose Senator Lieberman’s vote on the cloture vote on the bill, and it dies.

Then why are they still on the bill? Why are they antagonizing the public with their quixotic quest, while the economy burns?

Senator Reid is essentially in some sort of strange death dance, where he pours gasoline all over the Senate floor and prepares to self-immolate.

But the Dems cannot help themselves. They cannot stop themselves. They will keep marching, right off the cliff.

They should fold. They would lose less politically. That is what you do when you have a losing hand — especially if you’ve over played it — you fold.

But they won’t, yet.

All they have to do is tell Lieberman it’s no longer CALLED public option and he’ll vote for it.

“Ah, good. Now I can vote for it, then.”

You made similar arguments that it was dead in the House, that Pelosi didn’t have the votes, yet in the end she got them. I really do hope there’s a poison pill for enough on both sides to keep any version from passing.

I wonder if any of the more astute have a stance on the probability of reconciliation. Even if the Statist can’t gain passage outright, it seems the pieces are in place for an end-around.

Clarice Feldman had a blog piece yesterday at AT which describes the situation… and the situation isn’t good.

We Should Want Them To Go Reconciliation

IJB Wednesday, December 2nd at 10:27AM EST (link)

And we should want it for two reasons:

1) It will be viewed by the electorate at-large, especially independents, as an illegitimate ‘end-around’ of the political process, and will carry with it significant political blowback, and will make the eventual bill even more unpopular.

2) As a practical tactical matter, it will be much easier to repeal/allow to expire if the Dems are forced to push it through using reconciliation.

If the GOP Senate was smart, they’d force Reid and the Dems to pass this (w/ Public Option) via reconciliation, and then try and get it to be just a 50(+Biden) vote in favor of it. As a tactical matter, that’s what we should do. (Unfortunately, I don’t think the GOP Senate is smart, and like mbecker, I suspect they’ll ultimate help pass something…)

I Disagree Wholeheartedly

Once you pass an entitlement, you can NEVER get rid of it.
The Demoncraps know this and are counting on it.
They want socialism as a waypoint to communism and passage of this horror will get them everything they want.
They must be stopped, or America is gone forever.
Once that happens, there is no point to maintaining this government.

If the American people have any spine left, they’ll overthrow this statist, fascist regime permanently and give the entire Democrat party a “Soviet Aspirin,” but by then it’ll be too late for the America we knew.

If You Work On The Assumption That They Are Going To Pass Public Option No Matter What...

IJB Wednesday, December 2nd at 6:55PM EST (link)

…And some people around here are assuming that, then the absolute possible best outcome for our side is that they are forced to pass it via Reconciliation on a 50(+Biden) vote.

Would you rather they passed Public Option with a 60-vote Filibuster proof supermajority?! (And I know Dan P. thinks they can’t, but I’m no longer so sure…) I sure don’t!

The whole “once your pass an Entitlement you never get rid of it meme” trotted out by some on our side is patently wrong in this case (start by looking up the Medicare Catastrophic Coverage Act of 1988) is wrong (and is self-defeating anyway), but the easiest way to make an unpopular boondoggle like this go away is to use Reconciliation rules to gut it and put an automatic expiration date on it (look up the rules on Reconciliation if you don’t believe me).

Tactically, if this is going to pass anyway, the best tactical move by our side is to force them to use Reconciliation to do it.

continue to “march off the cliff” like lemmings.

Dan, do you have some idea of where our Republican senators stand presently. Erick E has pointed out the the nightmare of our folks “helping to improve the bill.” We need to hear that our side is working to “kill the bill.”

I read it the other day and it scared the crud out of me. Although. I have to say that part of me remains hopeful that this bill will die because of the outrage that will be expressed by the American people.

A quote I pulled from her website

“My amendment focuses on women’s health and women’s unique health needs. Keeping a woman healthy not only impacts her life, but it impacts her ability to care for her child and her parents….. Finally, my amendment would cover FAMILY PLANNING SERVICES!!!!

She rambles on for a whole page about how women are discriminated against by insurance because maternity costs more (like auto insurance doesn’t discriminate against young males ’cause we cost more) then casually slips in an “oh, by the way we’ll help women with ABORTION too!!”. But she does this in as sneaky and dishonest a way as anyone in Washington. She doesn’t use the word “abortion” once on her site. Just “family planning”, “preventive services”, and “comprehensive women’s health”. She’s a weasel if I’ve ever seen one!!

Did you see her in committee

Menlo (Diary) Wednesday, December 2nd at 12:00PM EST (link)

I wrote about that back in July when she offered up the same amendment in committee. It met a different fate there, but you can see what happens when she is asked about it.

Watch Republicans Blow It

crosley (Diary) Wednesday, December 2nd at 12:02PM EST (link)

The goal of Republicans Senators when it comes to modifying this bill is to make it as bad as possible. Republicans shouldn’t help Democrats improve it, even if it’s “conservative” policy amendments that are being added. In fact, Republicans should help left-wing Democrats add as many “bad” amendments to this bill as they can. The only way to kill this bill is to spook moderate Democrats. I wouldn’t count on these left-wing Democrats that say they won’t vote for anything short of Universal Health Care. Since when is the word of a liberal worth anything?

I can easily see enough Republicans joining moderate Democrats to remove the public option amendment, thereby allowing passage to get over 60 since that has become the principle objection for the moderates. Figures like Snowe, Lieberman, Nelson, etc will vote at the very least to allow it to proceed once the public option is stripped, where then Reid will only need 50 votes for passage, which will be no problem.

Defeat it by talking it to death

Freedoms Truth (Diary) Wednesday, December 2nd at 4:47PM EST (link)

Every Amendment needs a cloture vote. Vote against ALL cloture votes. Make EVERY Democrat vote AYE on everything.

Your insight is exact.

roscopico (Diary) Friday, December 4th at 9:59PM EST (link)

And our fears have merit on the bases you establish. It spooks the he11 out of me to see the Senatorial front line buckle. They are (almost unanimously) cowards or stupes. Either way: we lose.

Republicans MUST defeat removal of "public option"

Menlo (Diary) Wednesday, December 2nd at 12:06PM EST (link)

In their case, we must treat their voting to remove it is the exact same thing as voting for the bill.

This is where Snow and Collins can be useful to Republicans for a change...

AceInTX (Diary) Wednesday, December 2nd at 12:22PM EST (link)

I know…Ace is giving Snow and Collins a positive comment? How likely is that?…Lucifer is pulling out a blanket as we speak because it’s getting cold down there…

All this assumes we can keep them on our side in the end…but for the moment, the Democrats are staying at this suicidal kamikaze attempt at passing this in the hopes they can get the Maine Twins or one of the other RINOs we haven’t heard anything from in a while on board…They’ll keep flailing themselves till they know that’s impossible…my only fear is…if one of these weasels decide they want the lavishing press they will receive for helping to pass this…someone like Voinovich who will be leaving next year anyway.

In fact Voinovich is the one I fear most because he’s made his contempt for Conservatives plain for all to see…what better way to put a thumb in their eye than to stick us with this on his way out the door. He’ll be praised by the press and receive a hero’s welcome to K Street because the Dems will pay him anything to buy his vote…

All I can say is…Pray earnestly and continually in this because every time I think we’ve slain this beast the Dems keep pulling the rabbit out of their hat…and so far they’ve managed to do it all alone…and out RINOs are chomping at the bit to grasp the brass ring and be declared a hero by the Press and the inside the beltway punditry for doing the hard work of saving us all from the privations and uncertainty that comes from the free exercise of out liberties!

Old L is probably mega confused right now with the sudden global cooling that’s occurring down there – Ace and eburke saying nice things about Snowe, Collins, and McCain all on the same day. He’s probably thinking the world’s about to come to an end.

I can give McCain credit where Credit is due…but of course we can’t forget even in being right…he’s doing it for the wrong reason simply because it’s an election year and I think he’s running scared at the moment even though he doesn’t have any credible competition…He must be vulnerable…and must know it…the only issue is…who can be put up against him to beat him…
