Dem Senators are peeling off of President Obama’s government takeover of health care and its liberal fantasy land that spends more than a trillion and contains hundreds of billions in new taxes.
As James Carville told CNN, President Obama only has 57 votes.
Reuters James Pethokoukis is reporting that Senators Liberman, Landrieu and Nelson are at NO, and Bayh maybe too. Pethokoukis is reporting the same thing Hammond said in his memo, that reconciliation is a no-go. (Politico is reporting, correctly, that reconciliation rules would strip the Stupak amendment.)
As we all know, no 60 votes, no laundry. (Senator Reid needs 60 votes to break the filibuster on the motion to proceed to consider the bill. If he does not get 60 votes, ObamaCare never comes up on the Senate floor.)
There are whispers in Washington watering holes that some Dem Senators are quietly hoping Senator Nelson will vote against cloture on the motion to proceed. This will let the Senators who are up in 2010 off the hook from the nightmare of proceeding to this politically toxic bill. They want to avoid the bill, and avoid the litany of tough votes on immigration, hundreds of billions of new tax increases, the bill’s $1 Trillion plus in massive new spending, abortion, rationing of care and other killer amendments, including some on Second Amendment rights (guns).
Senator Nelson is essentially being asked to save the Democratic Party from the Jonestown Kool-Aid brigade at the White House and in the U.S. House leadership, who, even in the wake of:
1) the off-year elections results that saw the Independents vote against Democrats 2:1,
2) the Gallup poll +4 Republican Generic ballot, and
3) the brutal polling data against ObamaCare
refuse to understand that this bill is pure political cyanide.
It makes Machiavellian sense, instead of these Senators being forced to drink the Kool-Aid, for Senator Nelson to force feed the Jonestown Kool-Aid down ObamaCare’s throat. All while the other 2010 Senators vote with the White House and keep the liberal attack dogs off of themselves.
Senator Nelson is the best situated to do the deed: Moveon.org and the Deaniacs don’t get very far in Nebraska.
On the other hand, these watering hole whispers about Senator Nelson may not by true. Senators Nelson, Landrieu, Lincoln-Davis and Bayh may correctly believe that if they do not vote against cloture of the motion to proceed, the only recorded vote they will have on ObamaCare is a Yes, which will likely become the focal point of those voters in their state who are strongly opposed — and in the states the Senators mentioned above are from, “strongly opposed” make up their largest block of voters.

I continue to pray every day that this bill DIES....
JadedByPolitics (Diary) Saturday, November 14th at 12:06PM EST (link)in the Senate now I am sure God is wondering why I am asking just for this particular thing everyday but nonetheless I do
I did call Warner’s office this week and it took me all week to actually speak to a person and I let her know that my father-in-law who was a lifelong Republican said that Warner would govern in office as a moderate and thought he would make a good Senator before he passed this past year and that the four members of my household all voting age..heh…wanted him to vote to keep the governments hands OFF OUR HEALTHCARE! I let them know that other then the military there is NOTHING the government runs even a little well. According to the young lady “he has not decided” which of course is a LIE.
We shall see how is all plays out but I think calling your Senator’s day after day after day until it DIES is not unreasonable to do.

IOW, Clinton only got reelected because he *did* “go moderate”.
Obama got reelected because everyone in the Dem Party and the Establishment Media worked *overtime* to fuzzy out any socialist tendencies displayed by Obama.
And, the difference is, Obama has now been “outed” as a Commie, and he, unlike Clinton, won’t back off it.

The big three are socialized medicine, government control of the entire economy through Cap and Tax, and Card Check. Enact them all and welcome to the USSA.
I beleive they made a fundamental mistake in not taking on card check first. If they’d passed that, every business in America would be terrified of opposing the government and citizen opposition would have been marginalized and extinguished. Taking on Health care allow real opposition to organize. The UAW et al. got to greedy and in too much of a hurry to get their H&W liabliities off their back. That may prove to be the fatal mistake for this revolution as it was for Bill and Hill’s attempted revolution. The advantage to leaving the Dems in power (but with severely reduced majorities) is that we can stop this stuff, but the Dems will still get all the blame come 2012. Otherwise, Obama will finally have his biggest strawman to blame… a GOP Congress.

I am hearing that the polling in Indiana
Dan Perrin (Diary) Saturday, November 14th at 1:10PM EST (link)on ObamaCare is unbelievably bad, just awful, and the fact that the auto industry has tanked and Obama is spending like a madman is making the support at extremely low levels.
The fact that Lilly and Anthem are based in Indy is also driving the numbers down — big time.
The mood is bad.
Mayhem (Diary) Saturday, November 14th at 2:28PM EST (link)I will tell you this, Indiana will not go for Barack Obama in 2012. 2008 was a fluke here–a fluke he barely won. The state has slipped back firmly into its traditional conservative positions. The Indiana House of Representatives will get turned over to the GOP next year, and I’m guessing at least 2 of our 3 Blue Dog congressmen will lose as well.
Bayh is justified in his concern. So far, the party has yet to recruit a top tier candidate to run against him. Because the Bayhs are an established political family in Indiana, it would probably take a Mike Pence or our Lt. Governor (Becky Skillman) to knock him off. Even if they don’t get a top challenger, his worries are probably enough to make him vote no. Either way, good for us.

The Law of Delay
Freedoms Truth (Diary) Saturday, November 14th at 1:50PM EST (link)#1: ObamaCare is not dead and like a vampire will never be dead unless a conservative run either the Congress or the White House. They have, alas, until Dec 2010 to do something.
#2: Dems will face a DISASTER next year if all they do is pass a budget-busting ObamaCare monstrosity and show up in Nov 2010 with trillion dollar deficits and double-digit unemployment:
“A CNN poll released Nov. 6 found that 47% of Americans believe the top issue facing the country is the economy, while only 17% say its health care. However, the bulk of the president’s efforts over the past six months have been not on the economy but on health care, an issue in which he continues to draw negative ratings.”
#3: The way out for Dems (or they are thinking this way now) is the PIVOT – pass ObamaCare now to placate the base, then PIVOT to focus on the economy and deficit to sound like they are addressing those anti-Big Govt and deficit concerns. Of course since ObamaCare has a hidden $3 trillion / 10 year price tag, the one thing they can do to is simply NOT DO OBAMACARE and that would do more than anything else to address the deficit/spending issues.
#4: The way forward for the GOP is to simply make every single legislative item as extended a battle as possible. Filibuster EVERYTHING, play every parliamentary trick possible to slow everything down…
bogging everything down will force the Obama side away from the pivot strategy and into the ‘ballast’ strategy – they will start throwing the agenda overboard to get a lift in Nov 2010…
#5. they may want to fit in a second-stimulus too – GREAT! – that’s an opportunity to take them off these other items and to get GOP agenda items of tax and regulation relief, ie 2010 campaign items, ON the table. We should be ready.
Conclusion:
Delay helps us. A delayed bill screws up the Dem pacing and strategy big-time. Even if we are forced to have ObamaCare in the Spring of 2010, the Dems may throw in the towel on Amnesty and Cap-and-trade and union card check, simply because they wont want that 35 seat Dem loss to turn into 55 seat Dem loss in Nov 2010. but go look back at #2, they wont be in great shape AT ALL if all they have if ObamaCare as their signature accomplishment and FUNemployment remains bad.
THE GOP MUST BE 100% FOCUSSED RIGHT NOW ON FORCING A DELAY OF EVERY OBAMA AGENDA ITEM AS MUCH AS POSSIBLE.

DavidSage (Diary) Saturday, November 14th at 3:42PM EST (link)I usually laugh when I hear silly conspiracy theories, but I really could see a situation where a Soros-type, wealthy liberal fundraiser makes an offer even a sitting Senator can’t refuse. For a lot of these Senators, the big money comes once they leave the Senate, so they’re looking forward to those type of jobs anyway.
I could see a group of liberal fundraisers creating some new PAC and offers the top job to a “retiring” Senator. Or an incredible offer at a top law firm, lobbying firm, i-bank, hedge fund, etc.
If someone like Soros is willing to throw down a few hundred million for all sorts of liberal causes, do really think it’s impossible for someone to buy off a Senator? This is the holy grail of the Left, and they’ve never been this close.
I think our saving grace is a lot more Democrat Senators than just 3 want this to fail. If 57 Democrat Senators really wanted this thing to pass, I think they could find a way.

bags64 Saturday, November 14th at 5:33PM EST (link)How long is the House’s passed bill ‘active’ or ‘live’ before it would require a revote? Does it simply sit out there forever, until the Senate decides to act?
Same question w/ the previously passed cap-and-trade bill the house passed.

Until the end of this Congress, usually
Dan Perrin (Diary) Saturday, November 14th at 6:27PM EST (link)Sept-Oct. 2010, but there is a big shift in perception during an election year among members of Congress. They believe that people will remember things done in an election year.
Agrees,Time is a big killer of legislation
jacon4 Sunday, November 15th at 6:13AM EST (link)especially in an election year, it just sits there getting picked at and theres alot of picking going on in the house version. If harry doesnt get a vote to start debate by the xmas break, i’d say its over for obamacare in this congress.
so the "official" amount of time the senate
bags64 Sunday, November 15th at 6:16AM EST (link)has to act on a passed bill by the house is until a new congress is seated?
Why not put ObamaCare on the 2010 ballot and let everyone vote on it in the election?
David123 (Diary) Saturday, November 14th at 11:12PM EST (link)An amendment could be attached to the bill stating, “All provisions of this law shall be null and void if a majority of the voters do not vote in favor of it on election day, November 2010.”

Didn't Lincoln already support one version?

Senator Lincoln would be smart to

57 votes is alarming enough
scottbomb (Diary) Sunday, November 15th at 1:53AM EST (link)If it DOES come to the senate floor, what are the odds are that it gets passed?

well, I am still at 30% for passage, 70% for death

They have 57 votes... what are the odds
Lloyd Davis (Diary) Sunday, November 15th at 2:00AM EST (link)some Republicans will not be able to resist and will follow the lead of the Dems. Like a moth to a flame. The same flames that will burn as Emperor Obama fiddles.

effective contact?
hoosierdad Sunday, November 15th at 6:00AM EST (link)Here’s a question: What’s the most effective method of contacting your Senator? Do they and their staff pay more attention to one or the other: E-mail, phone calls, fax, snail mail?
And what about contacting their DC office or regional offices?
Or is the answer “all of the above!”
the answer is a the most effective way to
Dan Perrin (Diary) Sunday, November 15th at 9:38AM EST (link)contact your Senator is to hold a demonstration in front of his office in your State Capital, film it, and put the highlights on youtube and invite the media.
Get the tea partiers and the pro-lifers and the Chamber of Commerce and the anti-taxers and the Second Amendment right guys and the Seniors worried about Medicare — United Seniors or 60+ groups and demonstrate!
Failing that, faxes and phone calls and emails are good, so are letters to the editor.
